STAFF REPORT
On May 15, 1989, the Mayor and Common Council initiated proceedings tor the
acquisition of off site improvements within Tract 14185 located generally in
the Cajon Boulevard and June Street area under the provisions of the 1913
Improvement Act.
On August 7, 1989, the firm of GFB-Friedrich & Assoc. were brought on board
to perform the necessary Assessment Engineering for the project.
Due to unforeseen scheduling, time constraints, additional meetings with the
developer (Century Homes), and the necessary modifications to the
preliminary assessment roll, the estimated costs for the services were
greatly expanded and were not covered in the original estimate through no
fault of the Engineer. This District is complicated in it's timing and
coordination and the additional time necessary to inspect and certify
construction and make necessary changes involves many hours of investigation
and calculation.
This Amendmen,t will increase the original amount by 54,604.00 from
532,800.00 to 537,404.00.
It is therefore recommended that the First Amendment to the Agreement be
approved and the Resolution adopted.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO ALTHORIZING AND DIRECTING THE
EXECUTION OF A FIRST AMENDMENT TO AN AGREEMENT WITH GFB-FRIEDRICH &
3 ASSOCIATES. INC., FOR PROFESSIONAL SERVICES RELATIVE TO THE FORMATION OF
ASSESSMENT DISTRICT NO. 977, LOCATED IN THE CAJON AND JUNE AREA.

WHEREAS. on the 7th da\" of August, 1989. Resolution No. 89-
299 was adopted b~' the w,ayor and Common Counei I of the Cit,' of San
Bernardino. authorizing the execution of an Agreement for Professional
Services with GFB-FRIEDRICH & ASSOC.. INC. relative to the formation of
Assessment District No. 977 located in the Cajon and June Street area; and
WHEREAS. additional services of the consultant were necessary for the
formation of said Assessment District No. 977.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CIT) OF SAN
12 BERNARDINO AS FOLLOWS:
13 SECTION 1. The Mayor is hereby authorized and directed to execute on
e 14 behalf of said City a first Amendment to an Agreement for Professional
15 Services with GFB-FRIEDRICH & ASSOC.. INC. relative to Assessment District
16 No. 977 for the acquisition of off site improvements within Tract No. 14185
17 located generally at Cajon Boulevard and June Street. a copy of which is
e
18 attached hereto marked Exhibit "A". and incorporated herein by reference as
19 fully as though set forth at length.

This resolution is rescinded if the parties to the first
SECTION 2.
21 Amendment to an Agreement for Professional Services fail to execute it within
22 sixty (60) days of the passage of this resolution.

1 FIRST AMENDMENT TO AN
2 AGREEMENT FOR PROFESSIONAL SERVICES
3 This FIRST AKENDMENT to an Agreement for Professional Services. made
4 and entered into this day of 1991. by and
5 between the CITY OF SAN BERNARDINO. hereinafter referred to as the "CITY".
6 and GFB-FRIEDRICH & ASSOC.. INC., hereinafter referred to as "CONSULTANT".
7 WITNESSETH
8 WHEREAS. Ci. ty and Consultant have entered into an Agreement for
9 Professional Services executed on the 9th day of August. 1989. for professiona
10 services relative to the formation of Assessment District No. 977 for certain
11 acquisition of improvements in the Cajon and June Street area; and
12 WHEREAS. additional professional services were needed by the City from
13 Consultant for the formation of said Assessment District.
14 NOW. THEREFORE. it is mutually agreed. as follows:
15 SECTION 1. Section 4. paragraph A of said Agreement for Professional
16 Service shall be amended as follows:
17 "Tbe City shall reimburse the Engineer for actual costs (including
18 labor costs. employee benefits, overhead. profit. other direct and indirect
19 costs) incurred by the Engineer in performance of the work, in an amount not
20 to exceed S37,404.00. Actual costs shall not exceed the estimated wage rates
21 and other costs as set forth in Exhibit "3". attached hereto and incorporated
22 herein as though set forth in full."
23 SECTION 2. Exhibit "3" of said Agreement for Professional Services
24 shall be amended to change to the following:
