STAFF REPORT

The proponent for this annexation filed an application with the Local Agency Formation
Commission for annexation to the City of San Bernardino.
On June 4, 1990, authorization was given to proceed with the proposed annexation
of the area generally located East of Highway 18, North of 40th Street, and at that
meeting, Resolution No. 90-203 was adopted, determining the amount of property tax to
be transferred from the County to City, if the proposal is approved.
On July 18, 1990, LAFCO adopted their Resolution No. 2269, approving the
annexation with conditions. Part of those conditions set forth requires the City to
initiate proceedings for the annexation of the territory directly South of the
proposed area, since this annexation would create an "island" of un-incorporated
territory. That proposal has been initiated and filed with LAFCO, and the City may now
proceed to finalize this proposal.
Since the annexation was requested by 100% of the property owners within the proposed
territory, no public hearing is required on the matter.
The attached resolution orders the annexation, and its adoption is recommended.

WHEREAS, pursuant to the provisions of the Cortese-Knox Local
Government Reorganization Act of 1985, Division 3, commencing with section
56000 of the California Government Code, proceedings were initiated by the
Common Council of the City of San Bernardino, to annex to the City of San
Bernardino, certain contiguous uninhabited territory hereinafter described;
and
WHEREAS, the landowner in the proposed annexation has requested
annexation to the City of San Bernardino to receive extended urban services;
and
WHEREAS. the Local Agency Formation Commission has set forth the
following terms and conditions in its Resolution No. 2269 :
"Condition No. 1. The conducting authority for this
proceeding shall be the City Council of the City of San Bernardino.
"Condition No.2. The boundaries are approved as set forth
in Exhibit "A" attached.
"Condition No.3. The following distinctive short form
designation shall be used throughout this proceeding: LAFC 2584.
"Condition No.4. Approval of this proposal is conditioned
upon the initiation by the City of San Bernardino of a proposal for the
annexation of the remaining island area created by this proposed annexation
to the City.1he condition shall be deemed fulfilled upon the issuance of a
Certificate of Filing for the subsequent proposal. Completion of the
conducting authority proceedings for LAFCO 2584 shall be held in abeyance
for a period not to exceed six. months in order for the City to fulfill this

condition.
"Condition No.5. Upon completion of Condition No. 4 above,
the City , as conducting authority, is authorized to proceed without notice,
hearing or election with 100% landowner consent.
"Condition No.6. Included in the City's resolution
depicting final action shall be the detachment from County Service Area 38
and County Service Area 70 without split of assets or liabilities.
"Condition No.7.
The date of issuance of the Certificate
of Completion shall be the effective date of this annexation. "
BE IT RESOLVED BY TIlE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the City elects to proceed without hearing, as
13 authorized by LAFCO Resolution No. 2269 as a result of 100% of the property
owners within the proposed area are in consent of the annexation.
SECTION 2. Said territory herein described as Annexation No. 347
designated as LAFCO 2584, is hereby annexed and incorporated in and mad~ a
part of the City of San Bernardino.
SECTION 3. The territory herein referred to as being annexed to
the City of San Bernardino is more particularly described in the Exhibit
"A", attached hereto and incorporated by reference as though fully set forth
in length.
SECTION 4.
The above described territory will be subject to
taxation equally with the property within such municipal corporation.
SECTION 5. The regular County Assessment Roll is utilized by the
City of San Bernardino.
SECTION 6. The property herein annexed is declared to be a part
of Ward 4 and the boundaries of Ward 4 are hereby altered to include said
annexed territory, and has a designated land use of RL (Residential Low),

Plan as it currently exists.
SECTION 7. The area included in the above annexation is hereby
4 detached from County Service Area 36 and County Service Area 70, without
5 split of assets or liabilities.
