STAFF REPORT
The proposed formation of Underground Utility Assessment District No. 20, was
approved by the City's Underground Utility District Committee at their meeting of
10-04-90. This project was recommended based on the proposed widening of 40th
Street, from Kendall drive to Electric Avenue.
Utility companies are required by Rule 20 of the Public Utilities Commission to
set aside a certain portion of their revenues to finance the cost of
undergrounding overhead facilities within districts established by local
agencies. Each agency is allocated a certain amount of funds based upon the total
number of overhead services within the agency's boundaries. The Underground
Utility Committee of that agency reviews and designates areas proposed for the
establishment of a district.
Portions of the proposed district are within City boundaries, and portions of the
district are within County jurisdiction. The project will be a joint project
between the City and County, and the County will use their portion of their Rule
20 allocation for the project.
Once the district is established, property owners within the district will be
required to complete the undergrounding from their property lines to the service
points at their own cost. A hearing date will be established at a later time, and
~all property owners within the proposed district will be notified by mail of the
.,roposal .
If the attached Resolution is adopted. all property owners within the proposed
district, and affected utility companies, will be given mailed notice of the
DroDosal.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO NOTICING A PUBLIC HEARING
RELATIVE TO TIlE FORMATION OF UNDERGROUND UTILITY DISTRICT NO. 20, GENERALLY
LOCATED ALONG 40TH STREET, BETWEEN KENDALL DRIVE AND PALM DRIVE.
WHEREAS, Chapter 13.36 of the San Bernardino Municipal Code of the
City of San Bernardino provides for the establishment of an underground
utility district within said City upon a finding by the Mayor and Common
Council after a public hearing that the necessity, health, safety or welfare
requires the underground installation of utilities within said district; and
WHEREAS, the Underground Utilities Committee of said City has
recommended the formation of an underground utility district to include the
real property described in the following resolution.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of
the City of San Bernardino as follows:
SECTION 1. NOTICE IS HEREBY GIVEN that the public hearing will be
held before the Mayor and Common Council of the City of San Bernardino on
Monday, March 18, 1991, at the hour of

Chambers, 300 North "D" Street, San Bernardino, California, to determine
whether the public necessity, health, safety or welfare require the
formation of Underground utility District No. 20, located along 40th Street,
between Kendall Drive and Palm Drive, more particularly shown on Drawing No.
8271 in the Engineering Division, City of San Bernardino, and on file in the
office of the City Clerk of said City, a copy of which is attached hereto
and made a part of this description of Underground Utility District No. 20.
SECTION 2.
The City Clerk is hereby directed to notify all
affected property owners as shown on the last equalized assessment roll and
all affected utility companies by mailing a copy of this resolution to them
at least ten CI0) days prior to the date of said hearing.
