STAFF REPORT
The plan check services proposals from BSI Consultants, Inc., ESGIL Corporation,
and Van Dorpe & Associates are all comparable in cost and quality. We would
recommend BSI Consultants, Inc. because they are closer in location and readily
available.
The purpose of our proposing a plan check service is to shorten our plan checking
time to two or three weeks. George Worley, Plan Check Engineer, left the City
January 3, 1986, and Jack Rosebraugh, Superintendent, retired March 14, 1986.
Charles P. Dunham, C.E., Plan Check Engineer, joined the City February l~, 1986,
and has been in charge of the Building & Safety Department since March 10, 1986,
subsequently filling the jobs of two (2) positions, plan checking and superintending.
The Building & Safety superintendent also functions as the code enforcement super-
visor until this position is authorized and filled. The plan checker is serving
as public counter permit clerk until this position is authorized and filled.
The architects, engineers, contractors, and developers are entitled to the timely
service they are paying for by their plan check fees and we desire to provide them
that privilege and service. The backlog for plan checking has increased because
of the volume of construction.
The construction activity valuation for February, 1986, was $20,375,966, March
$16,482,526 and April $11,943,874. The valuations are close to our all-time high
on record.
The urgency to add this to the supplemental agenda is that the backl04 of plan
checking is seven to eight weeks.

Special Inspection
Administration
There is an increasing emphasis being
placed on the role of the deputy inspector
with typically little or no regulation of the
inspeaor's performance compounded "im
minimal obligation on the part of the
inspector. BSI has a method for keeping
records of whether or nor a deputy inspector
is authorized to perform certain inspections,
what scope of inspeaion the inspeaor
agrees to be responsible for, and for which
job inspections are intended to be provided
for. By monitoring mis, responsibility is
placed on the deputy inspector to assure
proper execution of his duties.

INTRODUCTION
Philosoohy
Through our experience in providing contract services to
cities, aSI has identified concepts and ideas that are
essential for a consultant to possess, in order to
effectively fulfill the building department requirements
of a city. They are as follows:
The experience and staff to respond to each city's
needs in a timely, efficient, and cost effective
manner.
Administrative and management ability must be of high
caliber to identify problem areas and provide for
their correction in a timely and sure manner. The
ability to recognize and develop the attributes and
strengths of staff members, and to utilize them to
their full potential must be demonstrated.
A reputation for quality performance and integrity to
successfully administer all aspects of the City's plan
check responsibilities.
A Project Manager that is a leader with the ability to
establish goals and objectives for the department and
then lead the staff in a team effort to accomplish the
tasks leading to each objective.

The representative of BS1, as manager of plan check
services, will have the knowledge and experience to
orchestrate these concepts and ideas and make them work
to the benefit of the City. This will result in
excellent department performance.
BS1 acts as an extension of the City's staff with
capabilities and experience in all aspects of municipal
plan check needs. Since ,the company does not perform
design work for private developers, no conflict of
interest can result during our tenure, allowing BS1 staff
to maintain objectivity in the enforcement of building

The scope of regulations that affect the design and
construction of buildings has become increasingly diverse
and complex. It is essential to the proper operation of
a building department that its staff be aware of and well
trained in the interpretation and application of codes
and their enforcement. Continually updated training is
essential to maintaining quality code enforcement
services.
The following sections outline in more detail the scope
of services, approach, unique qualifications, special
concerns, personnel, and experience that BSI offers the
City of San Bernardino to meet your day-to-day building
department needs.

SCOPE OF SERVICES
The proposed scope of services has been formatted to
accommodate all of the City's plan check needs. The
following is the itemized scope of services which BSI's
plan check staff is prepared to provide to the City of
San Bernardino.
Task 1 - Project Manager-Liaison
BSI recognizes the need to ensure an adequate level of
commitment to the City of San Bernardino by key
personnel. A project manager will be assigned that will
fully commit all work efforts to the proper function of
the Plan Check Department. The BSI Project Manager will
serve as an extension of the City's staff, fully capable
of providing all necessary plan check services.
The Project Manager will be responsible for the quality
of all services provided by the staff. He must be
capable of dealing with a diversity of personalities and
many different levels of administrative, technical,
professional, and manual labor categories that are
involved in the scope of building code enforcement. The
Project Manager and staff will represent the City in a
professional manner in the public arena.
BSI will also provide continual documentation providing
updated information on the status of all plans in the
process of being checked. ~

Task 2 - Plan Check
Plan Check Schedule
BSI will maintain an acceptable turnaround time on plan
check. If fluctuations in workload necessitate overtime
or additional staff, it will be provided at BSI's
expense. The proposed turnaround time is based on
experience on the average response time when sufficientl~
staffed to provide cost effective services and meet the
demands of the average workload. Fluctuations in
development create intermittent cycles of heavy
workloads. The anticipated average turnaround time for
initial plan review will be as follows:
New residential and small to average commercial
within two weeks from receipt of plans.
. Major commercial structures within thirty days.
This schedule has been proposed as it is perceived in the
industry as being above average and should easily
accommodate the needs of the developers.
Plan Check Services
Plan checks will be in accordance with all local, state,
and federal regulations with which local jurisdictions
are mandated to enforce as well as all codes and
ordinances in effect by adoption at the time of plan
check. The specific codes, regulations, and ordinances

Building Codes
The Uniform Building Code is supported by ancilliary
codes such as the National Electrical Code, Uniform
Plumbing Code, Uniform Mechanical Code, and any others
specifically designated in the City Ordinances. The
contents of the ordinance itself where relevant to the
Building Department is also designated as enforceable.
As requested in your request for proposal, BSI proposes
to respond to your request to check the plumbing,
mechanical and electrical plans as well as the
architectural and structural.

Since revisions are continually being made to the codes
to allow for new methods and materials in construction,
it is essential that every jurisdiction maintain a well
trained staff in order to provide quality plan check
and inspection services. BSI provides quality
enforcement of the building code. Our thorough
understanding of the code and the intent with which it
was written permit consistent and proper enforcement
while maintaining the respect of both the client and
the public.

Development. Effective September 15, 1985, these
standards pursue a different approach than the
O.S.A. regulations in that they apply only to
apartments and address adaptability as opposed to
accessibility.

energy regulations have been radically modified and
continue to change, considerable confusion in the
building industry has resulted. BSI will provide a
format, if so desired, implemented during the plan
check stage, that is easily understood by both the

relations and improved quality of the end product.

. Federal Flood Plain Regulations
Many jurisdictions have areas that, due to either their
proximity to water or their elevation, are subject to
federal flood plain regulations. If so desired,
applicability will be checked and, if subject to these
regulations, BSI will provide enforcement of these
regulations during the plan check stage. This alerts
the developer at the earliest possible time in order to
permit advance planning.
Grading Ordinance and Soils Engineering
BSI responds to the critical nature of proper building
pad and site design and their impact on proposed
structures by anticipating potential problems and
addressing them in the plan check stage. The firm has
trained staff capable of administering grading
ordinances and reviewing soils reports for sound
engineering practice and overseeing proper
construction methods.

COMMUNITY INVOLVEMENT
While the position of the enforcement agency is often
characterized as being one of opposition to development,
this is not the case. BSI believes that enforcement is a
part of development. A professional, consistent, and
well trained staff will earn the respect of the
developers while enforcing the codes. BSI will uphold
the enforcement of all codes related to building
construction, but will also strive to develop good
community relations.
OFFICE HOURS AND PLAN TRANSMITTAL
BSI proposes to perform plan check services through its
central plan check office in Orange County. In order to
provide an established work environment at BSI's office,
it is proposed that the plans be forwarded as the City
deems necessary, by mail or courier. From BSI's Orange
County office, plan checks, rechecks, and verbal
communication with the applicants would be made.
Corrections would then be handled directly with the
applicant by mail. Should review of the plans in person
be necessary, an appointment would be made with the
applicant. This system is believed to be most convenient
for all parties involved.
Completed plans will be stamped, signed, and forwarded by
mail, with a transmittal form, directly to the City. The
method by which BSI transfers plans eliminates the
possibility of the plans being tampered with when being
forwarded to the City.

A questionnaire is sent to every applicant upon
completion of plan review and approval by aSI. These
opinions of BSI's performance will be forwarded to the
City to keep you updated on the level of quality that aSI
is providing.

For this service, it is ~ro~osed that Scott Fazekas serve
as Project Manager. His extensive background includes
su~ervision of building division staff, ins~ections, ~lan
check, and com~laint investigations. As a graduate in
Architecture from California State Polytechnic University
at Pomona, a CABO Certified Building Official, ICBO
Certified Plans Examiner and Building Inspector, and a
State Licensed Combination Building Ins~ector, he worked
for the City of New~ort Beach and Costa Mesa Building
De~artments for 12 years. There he has dealt with
architects, engineers, designers, develo~ers, building
owners, contractors, ~lan checkers, and ins~ectors to
assure safe and ~ro~er building construction through the
a~~lication of federal, state, and local codes and
regulations. Mr. Fazekas has ~lan checked buildings of a
wide variety of construction and occu~ancy ty~es. He has
also instructed 'code classes with Rancho Santiago
Community College District and has lectured at and
organized code related seminars.

COMMUNICATION
While effort on the part of City's staff will be minimal,
input from the City's management team is welcome and
considered an essential ingredient in developing a plan
check service operation that will meet the City's needs
and expectations.
Scott Fazekas will serve as the Project Manager for BSI
and will be available to represent the City in all
matters as specified in this proposal as well as to
confer and work with the City regarding any of their
concerns. BSI is willing to attend meetings with the
City as necessary to assure ongoing communication and to
enhance BSI's ability to be responsive to the City's
needs. BSI will provide updated information on the
status of plans in the process of being checked.
If BSI's services are to be utilized, it is requested
that the City forward any ordinances, policies,
interpretations, etc. to BSI to permit us to provide plan
review services consistent with those of the City, also
relating to us, the editions of codes which the City is
currently enforcing.

PROFESSIONAL FEES
BSI proposes to provide the services outlined in this
proposal for compensation in the amount of 80% of the
plan check fee collected by the City. The appropriate
edition of the Uniform Building Code and the most current

fees.

Bernardino, a municipal corporation, located in the County
of San Bernardino, State of California, hereinafter referred

"ENGINEER. "
WITNESSETH:
WHEREAS, ENGINEER represents that he has that degree of
specialized expertise contemplated within California
Government Code Section 37103 and holds all necessary
licenses therefor to practice and perform the services
herein contemplated, and
WHEREAS, the CITY requires said specialized services to
perform the work, project, and activity herein contemplated
thereby exempting this agreement from bid requirements, and
WHEREAS, no official or employee of CITY has a
financial interest in the subject matter of this agreement
contemplated within the provisions of California Government
Code Sections 1090-1092, and

WHEREAS, ENGINEER declares that he shall perform the
services herein contemplated in compliance with the Federal
and California laws related to minimum hours and wages (40
U.S.C. 276A et.seq. and California Labor Code Section 6300
et.seq., and California Labor Code Section 1410 et.seq.) to
the extent same are applicable herein; and
WHEREAS, the parties hereto intend to set forth all
their rights, duties, obligation and liabilities with
respect to the work, project, or activity contemplated
herein and services to be performed by ENGINEER thereunder.
NOW, THEREFORE, in consideration of the mutual promises
of the parties, and other good and sufficient consideration,
the parties agree to the following terms, conditions, and
convenants:
CITY does hereby appoint ENGINEER in a contractual
capacity to perform the following services in accordance
with the terms and conditions hereinafter set forth:
I. PLAN CHECKING SERVICES
ENGINEER shall, upon request of the City Building
Official, review plans for compliance with the CITY's
Building Code regulations falling within the purview of the
Building Official. Pertinent CITY policies and regulations
wil~ be provided by the CITY. Employees of ENGINEER shall
have the power and duties of the plan checker of the CITY
when performing such work. The CITY shall provide direction
as to which editions of the codes are to be used by ENGINEER
and will furnish copies of any amendments to such codes.

II. COLLECTION OF FEES
All fees to be collected from any applicant in
connection with the carrying out of the functions as set
forth in this agreement shall be collected by the CITY.
III. COMPENSATION OF ENGINEER
CITY agrees to adopt fees comparable to those
contained in the then current edition of the Uniform
Building Code. CITY agrees to utilize a nationally
recognized standard of establishing building valuation such
as Building Standards Magazine or a comparable publication
as deemed proper by the Building Official. A copy of any
schedule to be used will be provided to ENGINEER by CITY.
A. ENGINEER shall be compensated in an amount
equal to eighty percent of the permit fees collected by
CITY.
B. ENGINEER shall invoice CITY monthly for
services rendered and CITY shall pay ENGINEER upon
completion of the initial plan review.
IV. TERMINATION
This agreement may be terminated with or without
cause by CITY at any time after giving the ENGINEER written
notice specifying the effective date. In the event of such
termination, ENGINEER shall be~ompensated for such services
up to the point of termination.
This agreement may be terminated by ENGINEER only
by providing CITY with written notice no less than thirty
(30) days in advance of such termination.

V. GENERAL CONDITIONS
A. ENGINEER shall provide no services for any
private client within the corporate boundaries of CITY
during the period that this agreement is in effect.
B. CITY shall not be called upon to assume any
liability for the direct payment of any salary, wage, or
other compensation to any person employed by ENGINEER
performing services hereunder for CITY.
C. ENGINEER shall indemnify and hold harmless
CITY, its officers and employees from and against any and
all damages to property or injuries to or death of any
person or persons, including property and employees of CITY,
and shall defend, indemnify, and hold harmless CITY, its
officers and employees, from and against any and all claims,
demands, liabilities, suits, actions, or proceedings
therefor, resulting from or arising out of the negligent
acts or omissions of ENGINEER, its employees or
subcontractors.
D. It is further understood and agreed that
ENGINEER is, and shall be, acting at all times as an
independent contractor herein and not as an employee of
CITY. ENGINEER shall secure at his expense, and be
responsible for any and all payment of Income Tax, Secial
Security, State Disability Insurance Compensation,
Unemployment Compensation and other payroll deductions for
ENGINEER and his officers, agents and employees and for all
business licenses, if any, in connection with the services
to be performed hereunder.

VI. IMPLEMENTATION
The CITY shall provide ENGINEER with written
notice at which time these services will be implemented.
IN WITNESS WHEREOF, the parties hereto have subscribed
their names, CITY by its Mayor and Clerk, and ENGINEER by
its Vice President, the date of the year first above written
in this Agreement.

Mr. Fazekas manages the tim's Building Services Divis ion and has worked

struction through the application of federal, state, and local codes and

Mr. Fazekas has plan checked building types and occupancy groups which
encompass the entire spectrum of categories listed in the Unifom
Building Code. He has also contributed to the furtherance of both the
design and code enforcement professions by presenting and speaking at
code-related seminars and by instructing code classes with the Rancho
Santiago Community College District.
From I:ecember 1982 to January 1985, Mr. Fazekas served as Plan Check

Plan Check Services
PROPOSAL
SCOPE OF SERVICES
Plan Checking:
Van Dorpe & Associates, Inc. will check plans, specifications and
calculations submitted to the City by developers for conformance
to the following codes as adopted by the City:
Uniform Building Code
Uniform Mechanical Code
Uniform Plumbing Code
Title 24, Part 2, Building Regulations
National Electrical Code
Plans of average complexity will be checked and returned within
ten days. Rechecks are completed in three or four working days.
All corrections and rechecks are typed with appropriate code
references. We will meet with the applicant's engineer or discuss
corrections by telephone if approved by the Building.Official.
Other Services:
If requested by the City, Van Dorpe & Associates, Inc. will
provide other services such as .review of preliminary designs for
code compliance, participation at meetings with developers or
their design professionals and field inspection services.
COMPENSATION
For the architectural and structural plan checking, the
compensation will be an amount equal to 65 percent of the plan
check fee. Title 24 Energy Regulation checking will be done at a
fee of 15 percent of the plan check fee. An additional fee for
rechecks will be charged only if there are substantial changes in
the plans and the City receives an additional fee.
Where separate electrical plans are submitted and an electrical
plan check is required in addition to the buildin~ code plan
check, we will provide the electrical plan check for 10 percent
of the building permit fee. When signed HVAC and plumbing plans
are submitted and a mechanical plan check is required in addition
to the building code plan check, we will provide the mechanical
plan check for a fee of 10 percent of the building permit fee.

as an engineering and code consulting firm with emphasis on
assisting municipal government in plan checking, inspection and
administration of all City codes. Since that time, VAl has
provided assistance to over 20 California cities including the

Mr. Chou is the Vice President of Van Dorpe & Associates, Inc.
and is a senior plan check engineer with extensive experience in
civil and structural engineering including design and plan
checking of structures of numerous variety. Projects include the
design of wood frame and tilt-up concrete buildings as well as
multi-story buildings of concrete and/or steel moment resisting
frames. Other projects include concrete block shear wall
buildings and buildings with other types of rigid shear walls and
diaphragms.
Mr. Chou has experience in residential as well as commercial and
industrial plan checking, including single family dwellings and
multi-family dwellings. He is familiar with all provisions of
Title 24 including handicapped regulations, noise regulations and
the energy conservation standards. He is experienced in energy

coordination and substructure mapping as an assistant division
engineer.
Mr. Harris also represented the City Engineer at local and
national meetings and on related committees, task forces and
associations involving municipal, county, state and utility
agencies. He was instrumental in the formation and continuing
growth of the Utility Location and Coordin~tion Council of the
American Public Works Association in 1973 and was named as a
member of a national research team of six consultants to
investigate permitting practices in the field in 1972 for the
purpose of updating ASCE Manual of Practice No. 14. He continues
to serve on several education and uniform practices committees of
those organizations.
Since retiring from the City of Los Angeles in 1981, Mr. Harris
has been engaged as a consultant and senior engineer with several
organizations as a forensic engineer, government liaison
engineer, substructure investigations specialist and director of
governmental/utility affairs for a cable TV construction company.
Mr. Harris is an active member of the Southern California Chapter
of the American Public Works Association, as well as the national
APWA, longtime member and delegate at large of the Los Angeles
Substructure Committee, member of the City and County Engineers
Association, and sustaining member of Underground Service Alert.
In addition, he has served as a consultant and instructor on the
Work Area Traffic Control program at the University of California
Institute of Transportation Studies from 1978 to 1984.
As Vice President of Client Relations of Van Dorpe & Associates,
Inc. (VAI), Mr. Harris' duties include liaison and coordination
with public works and utility agencies as well as project manager
of related projects.

CONTRACT AND STATEMENT OF WORK
FOR PROVIDING BUILDING INSPECTION DEPARTMENT SERVICES
This contract is made by the City of SAN BERNARDINO
a municipal Corporation, hereinafter called CITY, and Esgil
Corporation, a California Corporation, hereinafter called
CONTRACTOR.
RECITALS
WHEREAS, CITY desires to employ the services of a
contractor to provide Building Inspection Department services
involving providing plan checking of proposed building
construction plans; and
WHEREAS, CITY desires to implement a high level of
professional and technical Building Inspection Department
services at a cost less than the fees paid by the permit
applicants; and
WHEREAS, CITY does not wish to increase staff size where
equal or better services can be provided at a lesser cost to
the CITY by using contractor services provided by the private
sector; and
WHEREAS, CITY does not wish to risk having to fund
deficits incurred in the operation of the Building Inspection
Department during low periods of activity in the cyclical
construction industry; and
WHEREAS, CITY wishes to avoid conflict of interest
problems by contracting with a corporation that performs no
work for the private sector and provides services exclusively
to government entities; and
WHEREAS, CITY wishes to contract with a firm directed by
persons having experience and knowledge in the interpretation
and application of complex regulations providing for protection
of the public; and
WHEREAS, CITY desires to contract with a firm presently
successfully providing plan review services to building
inspection departments; and

WHEREAS, CONTRACTOR'S founding directors are both
registered Professional Engineers in the state of California
and they have served fifteen and thirteen years, respectively,
in high level regulatory management positions in local
government; and
WHEREAS, CONTRACTOR presently provides services to 43
cities and counties in California; and
WHEREAS, CONTRACTOR is willing to enter into a contract
with the CITY to provide building inspection department plan
check services to the CITY in accordance with this contract;
and
THEREFORE, in consideration of the promises and mutual
covenants and agreements herein contained, it is agreed between
the parties hereto as follows:
I. DESIGNATION OF CONTRACTOR
CITY does hereby appoint ESGIL CORPORATION to provide
professional services for the review of proposed
building plans for conformance to regulations
contained in the state mandated building, plumbing,
mechanical and electrical codes, as those codes are
amended by the CITY; in state laws governing energy
conservation in buildings, provisions for access to
buildings by handicapped persons and provisions to
attenuate noise in buildings; to perform additional
work when requested by CITY; and to perform all of
the above described work in accordance with the terms
and conditions hereinafter set forth.
II.
CONFLICT OF INTEREST
The CONTRACTOR expressly affirms that neither the
CONTRACTOR corporation or any of its officers or
directors will perform work or provide services to
entities other than government entities during the
time this agreement is in force in order to ensure
the CITY that the CONTRACTOR will not have a conflict
of interest in discharging the work covered by this
agreement.

III. WORK TO BE PERFORMED BY CONTRACTOR AND COMPENSATION

A. Plan Review Services scope of Work
1. Perform traditional preliminary plan review
consultations in Esgil Corporation's main
office by meetings or by telephone.
2. Perform traditional initial plan review of
submitted plans to determine compliance with
CITY adopted:
Uniform Building Code
Uniform Plumbing Code
Uniform Mechanical Code
National Electrical Code
California State, Title 24 (Energy
Conservation-and Handicapped Access
Regulations)
Noise Attenuation
3. Provide the applicant's designee and the
CITY, a typed list of items needing
clarification or change to achieve
conformance with the above regulations.
4. Perform all necessary liaison with the
applicant's designee, either by telephone,
mail or meeting in Esgil Corporation's main
office, and perform all necessary rechecks
to achieve conformance to the regulations.
5. Perform all necessary liaison with the
Building Official or his designee, either by
mail, telephone or in Esgil Corporation's
main office, to insure compliance with
U.B.C. Sections 105 and 106 and to insure
compliance with local policy
interpretations.
6.
Perform plan reviews of revisions to plans
that have p~eviously been approved for
permit issuance, or perform plan reviews of
major changes to plans prior to such
approval, when such major changes are not
required to achieve code conformance.

7. Attend meetings related to proposed building
projects at the request of the Building
Official at locations other than Esgil
Corporation's Plan Check Office.
B. Compensation For Plan Review Services
1. Compensation for work performed under
Sections A. 1-5 shall be 80% of the Plan
Review Fee calculated per Section 304 of the
1982 U.B.C. for each building plan checked.
The construction valuation shall be based on
the most recent valuation multiplier
published by the International Conference of
Building Officials in Buildinq Standards or
on the architect's estimated construction
cost, or on the Building Official's cost
estimate, whichever is greater.
Subsequent to the CITY adopting, or the
state mandating the use of the 1985 Uniform
Building Code, the Plan Review Fee shall be
calculated per Sec. 304 of the 1,985 UBC for
each building plan checked.
The value to be used in computing the
building permit and building plan review
fees shall be the total value of all
construction work for which the permit is
issued as well as all finish work,
painting, air conditioning, elevators, fire
extinguishing systems and any other
permanent equipment.
Not withstanding the above, the minimum
CONTRACTOR fee for any proposed project
shall be one hundred dollars ($100.00).
Plan check fee for each repetitive
identical building shall be 20% of the plan
check fee rather than 80% of the plan check
fee as noted above.

2. Compensation under Section A. 6. shall be
calculated either the same as B. 1. or shall
be based on Esgil Corporation's current
Labor Rates Schedule. The method to be used
will be at the discretion of Esgil
Corporation.
3. Compensation for work performed under A. 7.
shall be based on the attached Labor Rates
Schedule (Attachment A) as modified each
January 1 and July 1.
IV. WORK TO BE PERFORMED BY THE CITY
A. The CITY shall perform the following work:
1. Arrange and pay the cost of shipping one set
of plans and documents to the CONTRACTOR'S
office in San Diego or such other location
as the CONTRACTOR may designate in writing.
2. Obtain from the applicant, at the time of
the project submittal, the necessary items
to allow plan checking to be completed in
the shortest overall time frame. Necessary
items include, but are not limited to,
complete plans, construction specifications,
soil reports, Title 24 energy calculations,
structural calculations, the name and
address and telephone number of the
applicant's designated contact person and
similar items that may be unique to a
particular project.
3. Provide the valuation for the proposed
construction or instruct the CONTRACTOR to
calculate the valuation in accordance with
Sec. III. B. 1.
4. Provide the CONTRACTOR with copies of any
CITY ordinances that modify the regulations
listed in III. A. 2.

5. Collect sufficient plan check fees or
deposits from project applicants to ensure
the CITY will not suffer a loss if the
applicant decides to abandon the permit
process after the CONTRACTOR has completed
the initial plan check.
V. EXTRA WORK
A. The CONTRACTOR shall not perform extra work
without written authorization from the Chief
Building Official.

A. The CONTRACTOR agrees to provide adequate
resources to achieve the following service
delivery goals for timely performance of the
work over which the CONTRACTOR has decision
authority.

For the purpose "of measuring performance, the work-
days specified in Paragraph VI. exclude the day plans
were received and include the day a plan review has
been completed. Workdays do not include Saturdays,
Sundays, or CITY holidays.

INDEMNITY CLAUSE
The CONTRACTOR shall indemnify and hold harmless the
CITY and its agents and employees from and against
all claims, damages, losses and expenses, including
attorneys'fees, arising out of or resulting from this
contract provided that any such claims, damage, loss
or expense is caused by a negligent act, error or
omission of the contractor, its employees or agents.
The CITY shall indemnify and hold harmless ESGIL and
its agents and employees from and against all claims,'
damages, losses and expenses, including attorneys'
fees, arising out of or resulting from this contract
provided that any such claim, damage, loss or expense
is caused by any negligent act, error, or omission of
the CITY, its employees, officials or agents.
IX. INSURANCE

CONTRACTOR shall obtain and maintain a policy of
liability insurance from an insurance company
authorized to be in business in the state of
California, in an insurable amount not less than one
million dollars ($1,000,000) combined single limit.
This insurance shall be in force during the life of
this agreement and the insurer shall agree to provide
the CITY with thirty (30) days Notice of Cancellation
or change in the policy.
The CITY shall be named as an additionally insured on
this policy. CONTRACTOR shall furnish a certificate
of said insurance to CITY prior to commencing any
work.
CONTRACTOR shall obtain and maintain a policy of
Errors and Omissions'insurance from an insurance
company authorized to be in business in the state of
California, in an insurable amount not less than one
million dollars ($1,000,000) combined single limit.
This insurance shall be in force during the life of
this agreement and the insurer shall agree to

x. TORT LIABILITY
It is agreed that any Esgil employee assigned to
perform the plan checking functions required under
this contract shall do so under the direct
supervision and control of the Building Official;
that the said Esgil employee shall be a servant of
the CITY, as that term is used in Section 810.2 of
the Government Code; and that any tort claims made on
account of the performance of the said employee shall
be subject to the provisions of the California Tort
Claims Act.
XI. TIMELINESS OF PAYMENTS TO THE CONTRACTOR

The CONTRACTOR shall submit on the first workday of
each month his invoice for the work performed during
the prior month. Payment of approved items on the
invoice shall be mailed to the CONTRACTOR prior to
the twenty-fifth (25th) day of each month the invoice
was submitted. Payments not made within the above
time frame shall, when paid, be increased one and
one-half percent per month, or portion of a month,
for each month the payment was delayed.
CONTRACTOR PERFORMANCE OOCUMENTATION
The CONTRACTOR shall note on the initial plan check
correspondence:
A.
The day of the week and the date the plans were
received;
B.
The day of the week and the date the initial
plan check was completed;
The day of the week and date the applicant's
designee was notified the initial plan check was
completed; and
C.."
D.
The calculated number of workdays to complete
the initial plan check.

XIII.
NON-ASSIGNABILITY
This agreement is for the professional services of
CONTRACTOR and is non-assignable without the prior
written consent of the CITY.
XIV. FINAL DECISION AUTHORITY
The CITY'S Chief Building Official shall have final
decision authority over the results of the plan check
by the CONTRACTOR and all work performed by the
CONTRACTOR shall be to the satisfaction of the Chief '
Building Official.
In instances where the permit applicant takes
exception to the CONTRACTOR'S interpretation of the
regulations contained in Title 24, the Building
official shall render a final decision utilizing, as
deemed appropriate, the resources of the CITY
Attorney and/or the Board of Appeals.
XV. TERMS
Either party may terminate this agreement, with or
without cause, by providing thirty (30) days written
notice to the other party.

NOTES:
1. Preferred rates apply to the following:
a. Clients where Esgil Corporation, by contract performs
all multiple residential, industrial and commercial
plan checking.
b. Clients where Esgil Corporation, by contract, provides all
of the Building Inspection Services.
c. Clients where Esgil Corporation, by contract, will provide
staff on other than a short term intermittent basis.
2. The percentage increase stated in certain existing contracts
need not be applied to the hourly rates.
3. The rates do not include expenses resulting from transportation,
meals, lodging and similar costs when Esgil Corporation is
providing services outside the greater San Diego County area.
4. Esgil staff normal work days are Monday thru Friday. Field in-
spection or office work on Saturdays, Sundays or City holidays,
will be performed only at the specific request of the Building
Official. Billings for work performed on Saturdays, Sundays or
City holidays shall be at 1-1/2 times the rates shown above and
a minimum of 4 hours if the person worked 4 hours or less and a
minimum of 8 hours if the person worked more than 4 hours.

1 ESGIL CORPORATION will provide plan checks and all required re-
checks for a portion of the plan check fee collected from the
applicant placing no cost on the taxpayers.
2 ESGIL CORPORATION will assist you during periods of unanticipated
high workload, loss of experienced employees, or periods of staff-
ing or budget constraints.
3 ESGIL CORPORATION will reduce your public counter waits by provid-
ing rechecks for all plans we check.
4 ESGIL CORPORATION plan check times will be stated in the contract
and will be shorter than the times presently realized by the
typical government agency.
5 ESGIL CORPORATION collectively serving many government entities,
can Provide professional staff that would normally not be afford-
able by a single government entity.
6 ESGIL CORPORATION is highly skilled in employee incentive methods,
modern management methods and productivity methods resulting in
high quality performance with the resultant benefits to our clients.
7 ESGIL CORPORATION was founded by persons having years of diversi-
fied professional regulatory management experience and the
principals are Professional Engineers.
8 ESGIL CORPORATION staff are highly experienced in government plan
checking operations and can provide you with high quality plan
review services in all aspects of code requirements.
9 ESGIL CORPORATION does not provide services to developers and
provides services only to government entities thereby avoiding
any conflict of interest problems.

Association of California, Fire Protection Engineers Association,
California County Building Officials Association, I.C.B.O.,
I.A.P.M.O., I.A.E.I., and California Building Officials.
11 ESGIL CORPORATION presently has insurance protecting Esgil
Corporation, and its'clients, against any liabilities
resulting from Esgil. staff specifically performing building
department plan checks for government entities.
