Recitals. 10 A. Subrecipient has requested financial assistance from 11 City for fiscal year 1985/1986 from funds available through a 12 community development block grant from the United States of 13 America to City. 14 B. Subrecipient represents that the expenditures 15 authorized by this agreement are for valid community development 16 purposes, in accordance with Federal law and regulations, and that 17 all funds granted under this agreement will be used for no purpose 18 other than those purposes specifically authorized. The specific 19 purpose of this agreement is to conduct an early 20 intervention/dropout prevention program known as "Project Early 21 outreach" which is designed to motivate elementary school students 22 toward higher academic achievement and career aspirations; 23 heighten students' awareness of positive and negative 24 opportunities; and increase parental awareness, support, and 25 involvement in the educational endeavors of their children. A 26 copy of Subrecipient's proposal is attached hereto, marked Exhibit . 27 I and incorporated herein by reference. 28 2. Payments. City shall reimburse Subrecipient for . . . - - . . . 1 allowable costs incurred under the scope of this agreement and 2 applicable Federal regulations, which have not been paid for or 3 reimbursed in any other manner or by any other agency. 4 Reimbursement will be made at least on a monthly basis, with the 5 total of all such reimbursements not to exceed $44,692.00. City 6 shall advance Subrecipient the sum of $10,000 within ten days of 7 execution of this agreement. The remaining sum of $34,692.00 8 shall be paid monthly in six equal installments of $5,782.00 at 9 the end of each month in arrears. 10 3. Term. This agreement shall commence May 1, 1986, and 11 terminate October 31, 1986. 12 4. Use of Funds. The funds paid to Subrecipient shall be 13 used by it solely for the purposes set forth in Paragraph IB of 14 this agreement, and in accordance with the program budget, a copy 15 of which is attached hereto, marked Exhibit II, and incorporated 16 herein by reference. A variation in the itemization of costs, as 17 set forth in the proposed budget submitted to City, not to exceed 18 10% as to any particular line item, shall be allowed, provided the 19 prior written approval of City is obtained, it being understood 20 that the total amount of the grant shall not be varied thereby. 21 At the end of the term, all unexpended funds shall be returned to 22 City by Subrecipient. The parties intend that grant funds be 23 utilized within the time period covered by this agreement, and any 24 funds not used shall revert to the City. No reserve for the 25 future shall be established with the funds except as may be 26 authorized to meet commitments made for services provided during . 27 the period of this agreement but not yet paid for at the 28 conclusion of this agreement. -2- . . . 19 20 21 22 23 24 25 26 . 27 28 . . . 1 5. Accounting. Prior to the final payment under this agree- 2 ment, and at such other times as may be requested by City, 3 Subrecipient shall submit to City's Finance Director an accounting 4 of the proposed and actual expenditures of all revenues accruing 5 to the ..Jrganization for the fiscal years ending June 30, 1986, an 6 June 30, 1987. Financial records shall be maintained by Subreci- 7 pient in accordance with generally accepted accounting principles, 8 in a manner which permits City to trace the expenditures of funds 9 to source documentation. All books and records of Subrecipient 10 are to be kept open for inspection at any time during the business 11 day by the City, its officers or agents, and by any representative 12 of the United States of America authorized to audit Community 13 Development Block Grant programs. Standards for financial 14 management systems and financial reporting requirements 15 established by Attachment "F" and Attachment "G" of Office of 16 Management and Budget Circular No. A-lID shall be fully complied 17 ith by Subrecipient. Subrecipient acknowledges that the funds 18 provided are Federal funds. Subrecipient's financial management system shall provide for accurate, current and complete disclosure f the financial results of the program sponsored by this greement. It is the responsiblity of Sub recipient to adequately safeguard all assets of the program, and Subrecipient shall assure that they are used solely for authorized purposes. 6. Services Available to Residents; Monitoring and Reporting rogram Performance. A. The services of Subrecipient shall be made available to ixty students from 6 elementary schools in the San Bernardino nified School District. No person shall be denied service -3- . . . . . . . 1 because of race, color, national origin, creed, sex, marital 2 status, or physical handicap. Subrecipient shall comply with 3 Affirmative Action guidelines in its employment practices. 4 B. Subrecipient shall also monitor the program's activities 5 and submit written reports to the Executive Director of the 6 Redevelopment Agency of the City of San Bernardino, in accordance 7 with Attachment "H", Office of Management and Budget Circular No. 8 A-IIO. Failure to provide such performance reports may prevent 9 the processing by City of Subrecipient's requests for 10 reimbursement, and may justify temporary withholding as provided II for in paragraph 11 hereof. The program will be evaluated 12 quantitatively and qualitatively. Monitoring of activities will 13 be made by an outside educational evaluator, Dr. Keith Dolan, .14 Professor of Education and Coordinator of Administrative Services, 15 California State University, San Bernardino. 16 The quantitative process will include: 17 (1) An initial testing of all students entering the program 18 using the California Test of Basic Skills (CTBS). 19 (2) Periodic objective tests to monitor progress of the 20 student in math and reading. The testing intervals will 21 be established by Dr. Dolan. 22 (3) A final testing of all students to measure student 23 improvement. The CTBS will be used for the final.test. 24 The qualitative evaluation will include: 25 (1) An initial student evaluation using the San Diego 26 Reading Attitude Scale (SDRAS) developed by Dr. Dolan. 27 (2) Conduct interviews with students, parents, teachers and 28 administrators at the beginning of the program for each -4- . . . . . . . 1 student with follow up interviews to ascertain the 2 degree of positive change. 3 (3) A final test using the SDRAS. 4 The evaluation process will include regular monthly reports 5 and a thorough analysis of all collective data. 6 7. Procurement Practices. Subrecipient shall comply with 7 procurement procedures and guidelines established by Attachment 8 "a" to Office of Management and Budget Circular No. A-I02, 9 "Procurement Standards." In addition to the specific requirements 10 of Attachment "a" to Circular No. A-I02, Subrecipient shall 11 maintain a code or standards of conduct which shall govern the 12 performance of its officers, employees or agents in contracting 13 with and expending the Federal grant funds made available to 14 Subrecipient under this agreement. Subrecipient's officers, 15 employees or agents shall neither solicit nor accept gratuities, 16 favors, or anything of monetary value from contractors or 17 potential contractors. To the extent permissible by State law, 18 rules, and regulations, the standards adopted by Subrecipient 19 shall provide for penalties, sanctions or other disciplinary 20 actions to be applied for violations of such standards by either 21 the Subrecipient's officers, employees or agents, or by 22 contractors or their agents. Subrecipient shall provide a copy of 23 the code or standards adopted to City forthwith. All procurement 24 transactions without regard to dollar value shall be conducted in 25 a manner so as to provide maximum open and free competition. The 26 Subrecipient shall be alert to organizational conflicts of 27 interest or non-competitive practices among contractors which may 28 restrict or eliminate competition or otherwise restrain trade. -5- . . . . . . . 1 subrecipient agrees to adhere to the procurement rules specified 2 in office of Management and Budget Circular No. A-l02 Attachment 3 "0" in its expenditure of all funds received under this agreement. 4 8. Anti-Kick Back provisionsl Equal Employment Opportunity. 5 All contracts for construction or repair using funds provided 6 under this agreement shall include a provision for compliance with 7 the Copeland "Anti-Kick Back" Act (18 U.S.C. 874) as supplemented 8 in Department of Labor Regulations (29 CFR, Part 3). This act 9 provides that each contractor or subgrantee shall be prohibited 10 from inducing, by any means, any person employed in the 11 construction, completion or repair of public work, to give up any 12 part of the compensation to which he is otherwise entitled. 13 Subrecipient shall report all suspected or reported violations to 14 city. All contracts in excess of $10,000.00 entered into by 15 Subrecipient using funds provided under this agreement shall 16 contain a provision requiring compliance with Equal Employment 17 opportunity provisions established by Executive Order No. 11246 as 18 amended. 19 9. prevailing Wage Requirement. Any construction contracts 20 awarded by Subrecipient using funds provided under this agreement 21 in excess of $2,000.00 shall include a provision for compliance 22 with the Davis-Bacon Act (40 U.S.C. 276a to 276a-7) and as 23 supplemented by Department of Labor Regulations (29 CFR). Under 24 this act, contractors shall be required to pay wages to laborers 25 and mechanics at a rate not less than the minimum wages specified 26 in a wage determination made by the secretary of Labor. In 27 addition, contractors shall be required to pay wages not less 28 often than once a week. Subrecipient shall place a copy of the -6- . . . -------......- . . . . 1 current prevailing wage determination issued by the Department of 2 Labor in each solicitation and the award of a contract shall be 3 conditioned upon the acceptance of the wage determination. 4 Subrecipient shall report all suspected or reported violations to 5 City. 6 10. Approval of City of any Charges; Use of Program Income. 7 City reserves the right to require Subrecipient to obtain the 8 prior written approval of City of any charges or fees to be 9 charged by Subrecipient for services provided under this 10 agreement, and of any rules and regulations governing the 11 provision of services hereunder. Program income represents gross 12 income earned by the Subrecipient from the Federally supported 13 activities. Such earnings exclude interest earned on advances and 14 may include, but will not be limited to, income from service fees, 15 sale of commodities, usage and rental fees. These funds shall be 16 used first for eligible program activities, before requests for 17 reimbursement, or shall be remitted to the City. Subrecipient 18 shall remit all unspent program income to the City within thirty 19 (30) days subsequent to the end of the program (October 31, 1986). 20 Interest earned on funds advanced under the agreement shall be 21 paid to the City. 22 11. Temporary Withholding. The Executive Director of the 23 Redevelopment Agency of the City of San Bernardino is authorized 24 to temporarily withhold the payment of funds to Subrecipient when 25 the Executive Director determines that any violation of this 26 agreement has occurred. Funds shall be withheld until the 27 violation is corrected to the satisfaction of the Executive 28 Director or of the Mayor and Common Council. Subrecipient shall -7- . . . . . . . 1 have the right to be heard by the Mayor and Common Council if 2 Subrecipient maintains no violation of the agreement has occurred, 3 which hearing shall be held within 45 days after the funds have 4 first been withheld, provided Subrecipient requests such hearing 5 within 15 days after such first withholding. 6 12. Records Retention. Financial records, supporting 7 documents, statistical records, and all other records pertaining 8 to the use of the funds provided under this agreement shall be 9 retained by Subrecipient for a period of three years, at a 10 minimum, and in the event of litigation, claim or audit, the 11 records shall be retained until all litigation, claims, and audit 12 findings involving the records, have been fully resolved. Records 13 for non-expendable property acquired with Federal funds provided 14 under this agreement shall be retained for three years after the 15 final disposition of such property. 16 13. Property Management Standards. Non-expendable personal 17 property, for the purposes of this agreement, is defined as 18 tangible personal property, purchased in whole or in part with 19 Federal funds, which has useful life of more than one year and an 20 acquisition cost of three hundred dollars {$300.00l or more per 21 unit. Real property means land, including land improvements, 22 structures and appurtenances thereto, excluding movable machinery 23 and equipment. Non-expendable personal property and real property 24 purchased with or improved by funds provided under this agreement 25 shall be subject to the property management standards specified 26 in Attachment "N" of Office of Management and Budget Circular No. 27 A-102, "property Management Standards." 28 14. Termination for Cause. City reserves the right to -8- . . . . 1 terminate this agreement and any and all grants and future . 2 payments under this agreement in whole or in part at any time 3 before the date of completion of this agreement whenever City 4 determines that the Subrecipient has failed to comply with the 5 conditions of this agreement. In the event City seeks to . . 6 terminate this agreement for cause, City shall promptly notify the 7 subrecipient in writing of the proposed termination and the 8 reasons therefor, together with the proposed effective date. 9 Subrecipient shall be given an opportunity to appear before the 10 Mayor and Common Council at the time at which the Mayor and Common 11 Council are to consider such recommended termination, and shall be 12 given a reasonable opportunity to show cause why,. if any exists, 13 the agreement should not be terminated for cause. Upon 14 determination by the Mayor and Common Council that the contract 15 should be terminated for cause, notice thereof, including reasons 16 for the determination, shall promptly be given to Subrecipient, 17 together with information as to the effective date of the 18 termination. The determination of the Mayor and Common Council as 19 to cause shall be final. 20 15. Termination for Convenience. City or Subrecipient may 21 terminate this agreement in whole or in part provided both parties 22 agree that the continuation of the project would not produce 23 beneficial results commensurate with further expenditure of funds. 24 In such event, the parties shall agree upon the termination 25 conditions, including the effective date and, in the case of 26 partial terminations, the portion to be terminated. The 27 Subrecipient shall not incur new obligations for the terminated 28 portion after the effective date and shall cancel as many -9- I . . - - . . . 1 outstanding obligations as possible. City shall allow 2 Subrecipient full credit for the City's share of the non- 3 cancellable obligations properly incurred by the Subrecipient 4 prior to termination. 5 16. Hold Harmless. Subrecipient agrees to indemnify and 6 save harmless the City and its employees and agents from all 7 liabilities and charges, expenses (including counsel fees), suits 8 or losses, however occurring, or damages, arising or growing out 9 of the use of or receipt of funds paid under this agreement and 10 all operations under this agreement. Payments under this 11 agreement are made with the understanding that the City is not 12 involved in the performance of services or other activities of 13 subrecipient. Subrecipient and its employees and agents are ~ 14 independent contractors and not employees or agents of City. 15 17. Amendment. This agreement may be amended or modified 16 only by written agreement signed by both parties, and failure on 17 the part of either party to enforce any provision of this 18 agreement shall not be construed as a waiver of the right to . 19 compel enforcement of any provision or provisions. 20 18. Assignment. This agreement shall not be assigned by 21 Subrecipient without the prior written consent of City. 22 19. Notices. The corporating ID!!mbers of the agency had a strong aJDJDitIISlt to outreach services for educatiooally disadvantaged students. Subsequently, q,&ation RETAIN (Rescue Educational Training and Initiative lbw) was desigped to provide e.....n".,,;c .,d support services that ueet the needs of low-achieving, high- risk potential dropoot students. To provide these services, the Provisional Accelerated I.earn:i.Dg (pAL) Center was established. For the PAL Center to be effective in outreach services, i.rdi.viduals DUSt be se=ed ~ are interested in ranaining or re-entering education and exposing than to the conc(ete barriers that DUSt be overCCIIE if the students are to ~ ccmpetitive and graduate. The PAL Center has been carefully structured to fulfill these requirements. NEEm IIENITFlCATION Research shows that at least one-fourth of California's ninth graders do not ccmplete their high school studies. PROGRAM OBJECTIVES To insure achievement of the program goal, the following objectives have been developed and designed to: assist students uith ,,""<Jemic studies, study skill devel~t, and s,."n...mc ~t in the areas of reading, writing, and math; help students develop effective ('lTmnrU.cation skills, increased se1f- estean, and increased awareness of their potential; provide educational and career opportunities and assist in planning options for accessing those opportunities; . provide exposure to positive role ucdels who will uctivate elanentary students toward higher aspirations; increase parental support and camli.tIIEnt for the education of their children; and assess. the impact of Project Early Clltreach on participants. Project Farly.OJtreach will recruit 60 students from 6 elementary schools in the San Bernard:iro lhified Scb:x>l District. 1.0 Students will receive 4-6 b:lurs per week of individualized sr.:wl-ic b.1tor- ing and study skills training by credentialed teachers, student intems, or cmpetent volunteers. 2.0 Students will be assisted in developing oral call1l.1Di.cation skills, receive individual and group camseling, learn coping strategies for negative i1f1uences (i.e., drugs), and participate in self-enhancement activities. 3.0 Students will explore MI1l"Stional and career opportjnities through readings, speakers, A-V materials, and field trips which will include University tours. 4.0 Students will be mentored by successful professionals who 'VOlunteer time to serve as role mxIels. . 5.0 Parents will bring their children to sessions, participate in parental support groups, and participate in a series of parent education programs designed to provide parental skills to assist their children in academics. 6.0 A ccmprehensive and statistical proceduie will be designed to evaluate the effectiveness of the Project Early tlutreach services The program will include the following c:oup:ments: - Screening and Selecticn - Exposure to Positive Role Models - Needs AssesSIlE1lt - Survival Skills Training - Orientation and Goal Setting - Parent Effectiveness Training - R...-liation The PAL Center proposes to offer elementary school students the acadanic, personal and social support activities to combat those influences that inhibit growth and contribute to student dropout. COlUlJSION We all realize the critical educational needs of our youth. The dropout rate is still escalating and no one entity can effectively address all the factors that ~act. There m.JSt be a collaborative effort by all concerned organizaticns, groups, and individuals. The pressing needs of our youth MUST supersede politics or any individual ideologies.
