HomeMy WebLinkAbout15-Building & Planning . . . ~ BOARD OF BUILDING COMMISSIONE~ ORDER NO. 1309 REPORT NO. 89-3375 1 ORDER OF THE BOARD OF BUILDING COMMISSIONERS OF THE CITY OF SAN BERNARDINO AUTHORIZING TIlE ABATEMENT OF A PUBLIC NUISANCE. 2 3 WHEREAS, pursuant to the San Bernardino Municipal Code, Title 15, 4 Chapter 15.28, the Building Official has posted a bui1ding(s) located at 5 787 W. 10th Street , San Bernardino, California, and has 6 notified person(s) having an interest in the above property that the bui1d- 7 ings(s) or premises constitute a public nuisance; 8 WHEREAS, pursuant to San Bernardino Municipal Code, the Building Official 9 has served a "Notice of Hearing Before the Board of Building Corrmissioners of 10 the City of San Bernardino", relating to abatement of said nuisance, to the 11 person(s) having an interest in the above property, and has prepared a 12 declaration of mailing of the notice, a copy of which is on file in these 13 proceedings; and 14 WHEREAS. a hearing was held to receive and consider all relevant 15 16 17 18 20 21 22 23 24 25 26 27 28 evidence, Objections or protests on October 13 , 19~, and WHEREAS, the Board of Building Commissioners heard the testimony and examined the evidence offered by the parties relative to the alleged public nui sance, 19 NOW, THEREFORE, IT IS ORDERED BY THE BOARD OF BUILDING COMMISSIONERS OF THE CITY OF.SAN BERNARDINO AS FOLLOWS: SECTION 1. Based upon the evidence submitted, it was found and determined that the bui1ding(s) and/or premises located at 787 W 10th ~t San Bernardino, California, constituted a publiC nuisance for the reasons set forth in Exhibit "A". attached hereto and incorporated herein by reference as though fully set forth at length as the findings of fact of the Board. I I SECTION 2. Based upon the evidence submitted, it was determined that the! City of San Bernardino was required to initiate abatement actions; that the i I City incurred costs in the sum of $ 1,703.10 to abate the above property; f 1 /5 . . 1 and that these costs and future costs to the City to abate the above property . 2 shall be the personal obligation of the owner(s) as well as a lien on the 3 above property. 4 SECTION 3. If the bui1ding(s) is not demolished within the prescribed period of time, the bui1ding(s) will be dmo1ished by the City and the costs shall be the personal obligation of the owner(s) as well as a lien on the above property.
