WESTERN MOBILEHOME ASSOCIATION Representing California Mabifehome Park Owners and Operators Since 1945 December 18, 1989 STATEMENT TO THE SAN BERNARDINO CITY COUNCIL by Clay Hage, Regional Director The San Bernardino parkowners Association opposes the Mayor's proposal to extend the Rent Increase Moratorium for four more months. To extend the rent freeze is unfair and unnecessary. Unfair because the freeze is the second in two years. Unfair because the tenants have stalled negotiations since September 24, and the moratorium only rewards them for their tactics. parkowners initiated the talks and welcomed a freeze to promote talks. We shouldn't be punished for coming to the table with proposals while the other side comes to the table with chisels to chip away at them. . Six times we have brought proposals to the table, six times the tenants' committee has chopped them to pieces. On December 8, the parkowners were ready to adopt a City-spon- sored compromise, only to have the tenants scuttle the plan. On December 15, even the mayor backed off the City proposal and watered it down even further to the tenant's advantage. parkowners have been subjected to a position of negotiating against themselves. Since September 6, the rules have constantly changed. The parkowners have had to bear the burden of tenants delaying tactics and the mayor's blatant parti- sanship in changing the groundrules for negotiations. The continued freeze is unnecessaary. Our side will continue to negotiate under the threat of a full-blown rent control ordinance. We are close to a settlement, which would now be in place if the tenants had NOT dragged their feet.--- Remember the self-imposed 6-month freeze from September 1987 to March 1988. Remember that it was the parkowners who proposed an agreement draft to negotiate on September 6. Remember that it was the parkowners who brought ideas to the table on six occasions. Remember that the parkowners were ready to accept your compromise two weeks ago. , An extended freeze is an insult to our willingness to cooperate, communicate and negotiate. The tenants' com- mittee has been irresponsible and should not be rewarded for it. . We will continue the talks and agree to an equitable solution before the middle of January. ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION- 2(E) OF ORDINANCE NUMBER MC-675 ENTITLED AN "ORDINANCE. PROVIDING THAT RENTS FOR MOBILE HOME SITES SHALL NOT EXCEED THOSE IN EFFECT ON THE EFFECTIVE DATE OF THIS ORDINANCE. " TO EXTEND THE MORATORIUM PERIOD, AS DEFINED THEREIN, FOR AN ADDITIONAL ~ DAYS AND SETTING FORTH THE URGENCY THEREOF. ~9'() THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION l. WHEREAS, those conditions relative to the general health, safety and welfare in existence at the time of the original adoption of Ordinance Number MC-675 continue in existence at this time. SECTION 2. 2(E) of Ordinance Number MC-675 is amended to read as follows: "Moratorium Period": The period of time beginning on the effective date of this ordinance and continuing for 240 calendar days thereafter; or until such time as the Mayor and Common Council establish a procedure for the adjustment and for regulation of rents, whichever occurs first. SECTION 3. This is an urgency ordinance which shall take effect immediately upon its adoption. The facts supporting the urgency are that the original mobile home rent "moratorium" ordinance is about to expire and the mobile home tenants/owners and the mobile home park owners are still engaged in negotiations to achieve a fair and equitable solution to the problem of significant rent increases for persons living in mobile homes who cannot seek other housing in the same way that an apartment renter could. ETC. balance will be upset while negotiations are still proceeding. To extend this ordinance will protect the public health, safety and welfare in that the provision of affordable housing for a significant segment of our community is essential to the betterment of the City as a whole, and this ordinance will help to attain that end.
