On November 18, 1991, the Community Development Commission considered the item and requested that additional information be presented at the next meeting. DEVELOPMENT DEPARTMENT OF THE CITY OF SAN BEIllWIDINO STAFF REPORT SeverlWater/Refuse Charae Rebate Proaram On December 2, 1991 the Community Development Commission approved the Sewer/Water Refuse Charge Rebate Program and appropriated approximately $146,000 from its low/moderate income housing fund to finance said program. Briefly, the program viII rebate to eligible households (those households at or below fifty percent (50%) of the median income) increases approved in 1991 for sewer, water and refuse charges. The program is to be administered by the Finance and Water Departments and funded by the Development Department. Based upon the City's experience with the Utility Users' Tax Exemption Program, staff feels the $146,000 will cover the first year's rebates. Because the program as implemented will be city-wide in nature, mutual benefit resolutions are necessary to facilitate the use of twenty percent (20%) set-aside housing funds within and without all existing redevelopment project areas. Based upon the foregoing, staff recommends adoption of the attached resolutions. KENNETH J. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, FINDING BENEFIT TO ITS VARIOUS REDEVELOPMENT PROJECT AREAS IN THE USE OF LOW AND MODERATE INCOME HOUSING FUNDS FOR THE PURPOSES OF SUBSIDIZING CERTAIN HOUSING COSTS ON BEHALF OF LOW AND. MODERATE INCOME HOUSEHOLDS WHEREAS, the city of San Bernardino, California (the created and existing pursuant to the Constitution and the laws of the State of California; and 11 12 WHEREAS, the Community Development Commission of the 13 City of San Bernardino (the "Commission") on behalf of the Redevelopment Agency of the city of San Bernardino (the "Agency"), is a redevelopment agency, a public body, corporate and politic of the State of California, organized and existing pursuant to the Community Redevelopment Law (Part 1 of Division 24) commencing with Section 33000 of the Health and Safety Code of the State of California (the "Act"); and WHEREAS, pursuant to Health and Safety Cooe Section 33334.2 (g), the Agency may use its Low and Mooerate Income Housing Funds inside or outside of a project area upon a resolution of the Agency and the Mayor and Common Council of the city (the "Council") which determines that such use will be of benefit to the project; and 27 fir . 28 III - 1 - 1 e . . 1 WHEREAS, pursuant to Health and Safety Code 2 section 33334.2(e)(8), the Aqency may provide subsidies to, or 3 for the benefit of, very low income households, lower income 4 households or persons and families of low or moderate income, to 5 the extent those households cannot obtain housinq at affordable 6 costs on the open market; and 7 8 WHEREAS, the city and the Aqency have previously 9 adopted various redevelopment plans for various project areas 10 located throuqhout the city (collectively, such project areas 11 shall be referred to as the "Project Areas"); and e 12 13 WHEREAS, many low and moderate income households reside 14 throuqhout the City, both in and adjacent to the various Project 15 Areas of the Aqency; and 16 17 WHEREAS, the City has previously experienced difficulty 18 in providinq affordable housinq to persons employed within the 19 City as well as within the various Project Areas, and has 20 suffered a job housinq imbalance which has neqatively impacted 21 upon the development potential of the various Project Areas and 22 the City qenerally; and 23 24 WHEREAS, the city has recently caused an increase in 25 certain water, sewer and refuqe charqes (collectively hereinafter 26 referred to as "utility Charqes") which apply to all residents of 27 the. City, includinq low and moderate income households; and 28 III e - 2 - ~ . . . . . 1 WHEREAS, because of the increases in these Utility 2 Charges, many of the low and moderate income households within 3 the City are experiencing difficulty in paying such increased 4 Utility Charges which is impacting upon their ability to obtain 5 or retain affordable housing; and 6 7 8 9 10 11 WHEREAS, the Agency deems it desirable to assist such 12 low and moderate income households by providing subsidies for the 13 costs of the increases in the Utility Rates presently being 14 assessed within the City; and 15 16 WHEREAS, in order to promote the city's health, safety 17 and welfar., it is important that the Agency assist in funding 18 the increase in Utilities Charges for certain low and moderate 19 income households throughout the City who qualify under the 20 City's income quidelines; and 21 22 23 24 25 26 27 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 28 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: - 3 - WHEREAS, such Utility Charges comprise a portion of the housing costs of the low and moderate income households within the Project Areas and within the City generally; and WHEREAS, it is appropriate at this time for the Council to make certain findings and determinations and take certain action with respect to the payment of the costs of increased Utility Charges. ~ . . . 1 SECTION 1. The Recitals hereinabove are true and 2 correct and are incorporated herein by this reference. . 3 4 SECTION 2. The Council hereby approves the funding 5 by the Agency of subsidies to certain low and moderate income 6 households within the city in order to fund a portion of the 7 costs of such households' Utility Charges, which portion is 8 attributable to recent increases in such charges, for the reasons 9 set forth in the Recitals hereinabove. The Council further finds 10 and determines that no other reasonable means of financing such 11 subsidies is presently available to the city and that the City 12 and the Agency require the use of revenues attributable to the 13 low and moderate income housing purposes generated from the 14 various Project Areas to fund such costs of increased utility 15 Charges on behalf of qualifying low and moderate income 16 households. 17 18 SECTION 3. The provision. of subsidies for the 19 payment of the increased portion of the Utility Charges will 20 improve living conditions within the various Project Areas of the 21 Agency and make such Project Areas more desirable for development 22 and thereby further assist in eliminating blighting conditions 23 within such Project Areas. 24 25 SECTION 4.
