On May 3, 1991, the Mayor and Common Council adopted the Development Code to implement the General Plan. COUNCIL ACTION STAFF REPORT Subiect: Permitted Uses in Commercial Heavy Development Code Amendment Mayor and Common council February 3, 1992 REOUEST That planning staff be directed to prepare a Development Code Amendment to allow miscellaneous indoor and outdoor recreational uses as permitted uses in the CH, commercial Heavy, land use district. BACKGROUND When the General Plan was adopted, property on Foothill Blvd. in west San Bernardino was designated CH, Commercial Heavy on the land use map. subsequent to the adoption of the General Plan, but prior to the adoption of the Development Code, a conditional use permit for a go-cart track was approved at the site. When the Development Code was adopted, miscellaneous indoor and outdoor recreational uses were inadvertently left off the Table of Permissible uses in the commercial Heavy designation. Due to this omission, the owner of the go-cart track is unable to intensify the use at his recreational facility. (He wishes to introduce a video arcade indoors.) In order to consider his request, a Development Code Amendment to allow miscellaneous indoor and outdoor recreation facilities in the commercial Heavy district is necessary. Miscellaneous indoor recreation facilities requires approval of a Development Permit in the commercial Zones in which it is permitted. Miscellaneous outdoor recreation facilities requires a Conditional Use Permit approval in those same zones. RECOMMENDATION It is requested that the Mayor and Common council direct planning staff to prepare a Development Code Amendment to permit miscellaneous indoor recreation facilities, subject to approval of a Development Permit in the commercial Heavy designation: and to permit miscellaneous outdoor recreation facilities, subject to approval of a Conditional Use Permit in the Commercial Heavy designation. .~ "..t:"
