OF SAN BER.RDINO - REQUEST .R COUNCIL ACTION STAFF REPORT A request was received by this office to vacate a portion of the North/South alley, froll JlIIIes AdllllS, owner of a small apartment building which he is refurbishing. His two neighbors, P. Aguilar to the North, and the American Red Cross to the South, are both very anxious to have this portion of the alley closed. On 11-04-91, authorization was given to proceed with the proposed vacation, and Plan No. 8600 was approved. All of the interested City Departments and utility Companies were notified of the proposal on 11-07-91, with a reply due by 12-09-91. The responses are attached for your information. Reservations of easements for public utility purposes were requested by Southern California Edison and Comcast Cable, as set forth in the attached Resolution of Intention. On 01-13-92, a Notice of Exemption was filed with the County Board of Supervisors, and a finding of consistency with the General Plan was made. The remaining fee of $375.00 has been paid and it is recommended that favorable consideration be given to the requested vacation. The Resolution of Intention, which sets a protest date of 03-02-92 has been attached hereto for your action also. Upon the approval of said Resolution, all adjacent property owners will be noti- fied by mail of the hearing date. 75-0264 n1-11-Q2 ? . . RESOLUTION OF TIlE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER TIlE VACATION OF A PORTION OF TIlE NORTH/SOUTII ALLEY LYING WEST OF "E" STREET, BETWEEN MAGNOLIA AVENUE AND EVANS STREET AND RESERVING EASEMENTS FOR PUBLIC UTILITIES THEREIN. BE IT RESOLVED BY TIlE MAYOR AND COMMON COUNCIL OF TIlE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declare their intention to order the vacation of a portion of the North/South alley lying West of "E" Street, between Magnolia Avenue and Evans Street, described as follows: That portion of Block C of Gatch's Subdivision, as per plat thereof, recorded in Book 3 of Maps, Page 66, Records llf the County of San Bernardino, State of California, described as follows: Beginning at the Northeast corner of Lot 6 of said Block B; thence South along the East line of said Lot 6 to the Southeast corner of said Lot 6; thence East along the Easterly prolongation of the South line of said Lot 6 to a point on the West line of Lot 3 of said Block C; thence North along said West lines of Lots 3, 2, and 1 to the Northwest corner of said Lot 1; thence West along the Westerly prolongation of the North line of said Lot 1 to the Point of Beginning. SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion of said alley, elect to proceed under and in accordance with the provisions of the "Public Streets, Highways and Services Vacation Law", being Division 9, Part 3, ot the Streets and Highways Code of the State of California. SECTION 3. That the hour of 10:00 A.M. on the 2nd day of March, 1992, in the Council Chamber of the City Hall, San Bernardino, California, be, and the same hereby is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation .ay appear before said Mayor and Common Council and offer evidence in relation 28 thereto. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any public utility and there is hereby reserved for future general public utility purposes and for this City an easement reasonably necessary to locate such public utility facilities over, in, under or across the real property hereinabove described and to use. maintain, repair. replace or renew such facilities. There are hereby specifically reserved for Southern California Edison and Comcast Cablevision, easements over the entire portion of the alley being vacated. to construct, place. operate. inspect, maintain. repair. replace and remove such aerial and underground electrical and television transmission struct- ures as the companies may from time to time require. consisting of poles. anchors. wires. cables. conduits. manholes. markers and necessary fixtures and appurtenances. Said easements include rights of ingress and egress. SECTION 5. That the City Engineer of the City of San Bernardino is hereby directed to cause Notices of Street Vacation to be posted as required by the Public Streets, Highways and Services Vacation Law. SECTION 6.
