BACKGROUND CUrrently, the land use classification of Miscellaneous Amusement and Recreational Services (No. 799A) includes bookies, race book makers, card rooms, fortune tellers, gambling establishments not using non-coin operated machines, the teaching of games, lottery clubs, off-track betting operations, etc. These indoor amusements and recreational uses are permitted under the staff administrative process of a Development Permit, Type I (building permit) for uses in an existing building and a DeveloPment Permit, Type 2 for new buildings. Chief Robbins has requested that the Planning staff look into this issue of gambling facilities for the possibility of prohibiting completely and/or allowing only in limited areas through the city's Conditional Use Permit process (letter attached). FUNDING REOUIREMENTS It is estimated that it will take approximately 15 hours of staff time of one associate planner including clerical support for a cost of $450.00 to process this Development Code Amendment. RECOMMENDATION That the Mayor and Common Council direct staff to initiate a Development Code Amendment relative to where gaming uses should be permitted, if at all. 5-0264 ~;~:.. The'Develop- ment Code allows card rooms and other types of gambling under the general. .category '. of miscellaneous indoor amusement and recreation s~rvices with only a development permit. ~ . ' .', The type of. business. ~Ba'rbecue Bills, r 'Inc." plans is '.high stakes gambling in the 'form of legal .car.d.. games. . . There are a few similar types 'of businesses in Southern' California. Police . problems exist at all 'locations. ,. Corporate' members talk of / possibly buying the Hiltori"Hotel (Hospitality Lane), the Maruko Hotel on "E" Street or other buildings of that size for this venture. There is talk of employing as many as 500 people to run this operation. . This project has a .very real possibility of being a detriment to the public interest, health, safety, convenience, or welfare of the city.
