STAFF REPORT
SUBJECT
Agreement for Service with.Glen Helen Raceway Park.
BACKGROUND
Glen Helen Raceway Park provides spectator events at Glen helen
Regional Park. The events draw large crowds sometimes in excess of
15,000 people. To facilitate traffic movement and minimize the
overtime impact to residents in the area, the police department
provides personnel for traffic control at key intersections. Glen
Helen Raceway Park reimburses the full cost of this service to the
City.
Using trained police personnel for traffic control ensures
qualified personnel are performing this function. This creates a
natural coordination with the police department in the event of an
emergency or an unanticipated event. Using personnel on overtime
eliminates a drain on existing police services.
FINANCIAL IMPACT
None:
Glen Helen Raceway Park reimburses the City for all
overtime cost incurred.
RECOMMENDATION
It is recommended the Mayor and Common Council adopt the Agreement
for Services with Glen Helen Raceway Park to provide overtime
personnel for traffic control during events at Glen Helen Regional
Park. All costs of services will be reimbursed to the City by Glen
Helen Raceway Park.
Failure to adopt this agreement will impact the flow of traffic to
and from Glen Helen Raceway Park events at Glen Helen Regional
Park. This impact will result in traffic congestion and increase
the potential for traffic accidents during the events. Both would
negatively impact the city of San Bernardino and the residents in
the area of Glen Helen Regional Park. Uncontrolled traffic has the
potential of increasing demands on existing police services,
resulting in a cost to the City for services provided.

SAN BERNARDINO AUTHORIZING THE EXECUTION OF A CONTRACT WITH GLEN
HELEN RACEWAY PARK.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

6 SECTION 1. The Mayor of the City of San Bernardino is
7
hereby authorized and directed to execute on behalf of said CITY
8
a contract with Glen Helen Raceway Park relating to traffic
9
control services within CITY jurisdiction, a copy of which is
10
attached hereto marked Exhibit "AU and incorporated herein by
11
reference as fully as though set forth at length.

SECTION 2.
The Authorization to execute the above
~ referenced agreement is rescinded if the parties to the

AGREEMENT FOR SERVICES
(Glen Helen Raceway Park)
3 THIS AGREEMENT, made and entered into this
day of
4 1998, by and between the City of San Bernardino, acting by and
5 through the San Bernardino Police Department, hereinafter called
6 "CITY" and Glen Helen Raceway Park, hereinafter called "GHRP".
7 WITNESSETH: By and in consideration of the covenants and the
8 conditions herein contained, the GHRP and CITY do hereby agree
9 as follows:

1. CITY agrees to provide one Police Officer and four
11
Community Service Representatives (C.S.R.'s)* with
12
vehicles for traffic control during various events
occurring at the Glen Helen Raceway Park. Traffic
control services will be provided, as needed, at the
15
following locations:
16
a. 1-215 Northbound off ramp at Palm
17
b. Palm and Kendall
18
c. Palm/Institution and Cajon Boulevard
19
2. The S.B.P.D. coordinator shall be Cpl. Lance Otey, Area
20
Corporal for Area B, telephone number (909) 384-5786.
21
The GHRP coordinator shall be Mr. Larry Minor,
22
telephone number (909) 384-9342.

3. The term of this agreement shall be May 1,
, 1998
through December 31, 1999.
4. In consideration for the above services and upon
receipt of an itemized invoice, GHRP agrees to pay the
City in accordance with the following rates:
Police Corporal (On call - Not Used) $44.07 per hour
CSR II
$23.83 per hour
CSR I
$22.11 per hour
Vehicle/Equipment Usage
$79.76 ($99.70) per event
. Events with expected attendance of more than 15,000
will require one additional CSR.
5. This agreement may be amended by written mutual
Consent of both parties hereto.
6. In event of disaster or unforeseen emergency, CITY
shall be excused from providing scheduled traffic
control services without prior notice to the other.
7. The rates indicated in this agreement are for estimate
purposes only. In the event of a wage increase, GHRP
agrees to pay the increased rates.
8. GHRP agrees that reasonable additional charges may be
assessed for S.B.P.D. supplies expended (flares),
additional equipment utilized, damage to uniforms or
property repaired or replaced at CITY expense, etc.,
which are directly related to the services referenced
herein.

9. GHRP agrees that any cancellation of this request for
service later than 4:00 p.m. on the day preceding the
requested service may result in a charge of four hours
for each officer assigned.
10. No additional gifts, donations, or gratuities may be
accepted by S.B.P.D. personnel in their behalf or in
the behalf of the Department.
11. GHRP shall indemnify, defend and hold CITY, its
officers, employees and agents, free and harmless from
any claim, demand, liability, suit, judgement or
expense (including, without limitation, reasonable
costs of defense) arising out of or related to CITY's
performance of services under this agreement, except
that such duty to indemnify, defend and hold harmless
shall not apply where injury to person or property is
caused by CITY's willful misconduct or sole negligence.

Dear Mr. Minor:
At the Mayor and Common Council meeting of April 20, 1998, the City of San Bemardino
adopted Resolution 98-96 authorizing the execution of a contract with Glen Helen
Raceway Park.
Enclosed are an original Agreement for Services and two (2) duplicate original
agreements. Please obtain signatures where indicated and retum an original and one
duplicate agreement to the City Clerk's Office, P.O. Box 1318, San Bernardino, CA
92418. Please keep a fully executed duplicate original agreement for your files. Said
agreements have been executed by the Mayor, City Attorney, and the City Clerk.
