The total amount of the fee waiver request exceeds $2,000, the amount that may be waived by the Mayor or Mayor's designee pursuant to Sec.3.l3.025 of the Municipal Code. Therefore, Council action is required. Staff prepared a memo to present this item to the Ways & Means Committee, but missed the agenda posting deadline for the April 18 committee meeting. In the interest of presenting the request to the full Council in advance of the planned event, the Ways & Means chairman authorized direct presentation to the Mayor and Council. FINANCIAL IMPACT: The total fee waiver is $2,934.99, as outlined on Attachment 1. RECOMMENDATION: Staff recommends that the Mayor and Common Council approve the waiver of fees associated with the Temporary Use Permit for Our Lady of the Assumption Annual Family Fun Fair. The applicable fees that can be waived are as follows: Temporary Use Permit Archive fee Police services Fire permit Refuse services $ 420.00 4.75 2,027.72 160.68 321.84 $ 2,934.99 (00 I -000-4710) (001-000-4720) Pursuant to Section 3.13.025 of the Municipal Code, the Mayor or Mayor's designee may waive established fees in an amount not to exceed $2,000 per event. Since the total fees exceed that amount, the Mayor and Common Council will make the determination of whether or not to waive the fees. Our Lady of the Assumption has held this annual Fun Fair for many years, with no detrimental impacts to the City of San Bernardino and staff recommends that the fee waiver be approved. These would include the TUP, police costs, etc. e The city of San Bernardino has undergone moyor demographic ('ha"ge in recent years. Rapid growth in some areas has been countered by economic downturn in others. Our school is located in one of the latter areas. Located on a city/county boundary line, fewer and fewer of our students now reside in the neighborhood surrounding Our Lady of the Assumption School. Consequently, our enrollment has consistently decreased over the past five years. At the same time, energy costs have risen significantly. Add to this our school's mission to assist any and all with scholarships whenever feasible, and it is readily apparent that the payment of over $2,000 in city imposed fees for our annual FunFair will pose a financial hardship for our school, especially since the FunFair is our major fundraiser of the year.
