HomeMy WebLinkAbout08-03-1983 Minutes City of San Bernardino, California August 3, 1983 This is the time and place heretofore set for an Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino at their Regular Meeting held Monday, August 1, 1983, at 9:00 a.m., in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. The City Clerk has caused to be posted the Order of Adjourn- ment of said meeting held Monday, August 1, 1983, at 9:00 a.m., and has on file in the Office of the City Clerk an affidavit of said posting together with a copy of said Order which was posted on Tuesday, August 2, 1983, at 10:00 a.m., in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. The Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Holcomb at 7:05 p.m., in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. INVOCATION The Invocation was given by Monsignor John Bradley of St. Bernardine's Church. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Council Member Hernandez. ROLL CALL Roll Call was taken by the City Clerk with the following be- ing present: Mayor Holcomb: Council Members Castaneda, Reilly, Hernandez, Marks, Quiel, Frazier, Strickler: City Attorney Prince, City Clerk Clark, City Administrator Matzer. Absent: None. BIDS REJECTION - INSTALLATION OF IRRIGATION SYSTEM, LANDSCAPING - HAMPSHIRE AVENUE FLOODWAY - CONTINUED FROM AUGUST 1, 1983 This is the time and place continued to for a recommendation from the Director of Public Works/City Engineer that the bids re- ceived for the installation of landscaping and an irrigation sys- tem for the Hampshire Avenue floodway be rejected and authoriza- tion to re-advertise for bids. (1) Council Member Castaneda made a motion, seconded by Council Member Hernandez and unanimously carried, that all bids, received on July 19, 1983, for installation of an irrigation system and landscaping for Hampshire Avenue, in accordance with Plan No. 6178, be rejected: and the Director of Public Works/City Engineer be authorized to re-advertise for bids. RES. 83-257 - RESOLUTION OF THE CITY OF SAN BERNAR- DINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH TOWARD UTILITY RATE NORMALIZATION (TURN) RELATING TO FUNDING FOR REPRESENTATION AT UTILITY RATE HEAR- INGS BEFORE THE PUBLIC UTILITIES COMMISSION. (2) The City Clerk read the title of the resolution. Council Member Castaneda made a motion, seconded by Council Member Marks and unanimously carried, that further reading of the resolution be waived and said resolution be adopted. Resolution No. 83-257 was adopted by the following vote: Ayes: Council Members Castaneda, Reilly, Hernandez, Marks, Quiel, Frazier, Strickler. Noes: None. Absent: None. ORD. MC-297 - ORDINANCE OF THE CITY OF SAN BERNAR- DINO AMENDING CHAPTER 3.44 OF THE SAN BERNARDINO MUNICIPAL CODE TO INCREASE THE SERVICE USERS TAX FROM SIX PERCENT TO BIGHT PERCENT, EFFECTIVE OCTOBER 1, 1983, TO PROVIDE THAT REFUNDS OF LOW INCOME SERVICE USERS TAXES SHALL TERMINATE ON DECEMBER 31, 1983, TO PROVIDE FOR EXEMPTION OF LOW INCOME SERVICE USERS FROM SERVICE USERS TAXES EF- FECTIVE JANUARY 1, 1984, TO PROVIDE FOR CAPPING OF CHARGES AND ESTABLISHING SUNSET PROVISIONS, AND DE- CLARING THE URGENCY THEREOF. FINAL (3) The City Clerk read the title of the ordinance. Council Member Castaneda made a motion, seconded by Council Member Reilly and unanimously carried, that further reading of the ordinance be waived. The Mayor and Common Council discussed the proposed ordinance. Mayor Holcomb explained at length why he felt the increase in utility tax was necessary. Mr. Jim Lynas of 1160 Sonora, stated that the Council should engage in a continuing overview of the City's budget, suggested that a sunset clause of this fiscal year be placed in the ordi- nance which would not be based on fund balances, and that the utility tax be reduced by 1% per year. Dave Rodriguez also spoke and questioned whether the exemp- tion in the utility tax would apply to small businesses. Mayor Holcomb explained to Mr. Lynas certain efficiencies that have taken place in the City the last few years: fewer em- ployees, better production and better management. Council Member Castaneda made a motion, seconded by Council Member Reilly, that said ordinance be adopted as an urgency mea- sure. Ordinance MC-297 was adopted by the following vote: Ayes: Council Members Castaneda, Reilly, Marks, Quiel, Frazier, Strickler. Noes: Council Member Hernandez. Absent: None. OUT-OF-STATE TRAVEL - CITY ATTORNEY In a memorandum dated August 3, 1983, Ralph Prince, City Attorney, requested authorization to attend the annual conference of the National Institute of Municipal Law Officers in Milwaukee, Wisconsin, on August 17-20, 1983. Council Member Quiel made a motion, seconded by Council Mem- ber Marks and unanimously carried, that the City Attorney be au- thorized to attend the Annual Conference of the National Institute of Municipal Law Officers in Milwaukee, Wisconsin, August 17-20, 1983. PLANNING, BUILDING AND FIRE DEPARTMENTS SURVEY Council Member Quiel referred to a survey prepared anonymously soliciting comments concerning the City Building, Fire and Planning Departments. He stated that neither he nor Council Member Strickler had anything to do with the survey. - 2 - 8/3/83 ADJOURN MEETING At 7: 55 p.m., Council Member Castaneda made a motion, seconded by Council Member Strickler and unanimously carried, that the meet- ing be adjourned.
