The City Clerk has caused to be posted the Order of Adjourn- ment of said meeting held Friday, June 24, 1983, at 1:00 p.m., and has on file in the Office of the City Clerk an affidavit of said posting together with a copy of said Order which was posted on Monday, June 27, 1983, at 10:00 a.m., in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. The Adjourned Regular Meeting of the Mayor and Common Coun- cil of the City of San Bernardino was called to order by Mayor Holcomb at 2:32 p.m., on Tuesday, June 28, 1983, in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. ROLL CALL Roll Call was taken by the City Clerk with the following be- ing present: Mayor Holcomb; Council Members Castaneda, Reilly, Hernandez, Marks, Quiel, Frazier, Strickler; Deputy City Attorney Fenton, City Clerk Clark, City Administrator Matzer. Absent: None. APPOINTMENT - COCKE - CIVIL SERVICE COMMISSION Mayor Holcomb appointed Warren Cocke of 2875 North Valencia Avenue to serve as a member of the Civil Service Commission. Council Member Strickler made a motion, seconded by Council Member Quiel and unanimously carried, that the appointment be confirmed. HIGHLAND CITYHOOD ELECTION Mayor Holcomb presented and explained his request for au- thoriz~tion to notify LAFCO that the City will support an elec- tion on the detachment from our City if all City residents are permitted to vote on the detachment and if the proponents of Highland Cityhood pay for the election. (S3) Council Member Strickler made a motion, seconded by Council Member Quiel, that the Mayor be authorized to notify the Local Agency Formation Commission that the City will support an elec- tion on detachment from our City if all City residents are per- mitted to vote on the detachment from the City and if the pro- ponents of Highland Cityhood pay for the election. The Mayor and Common Council discussed the motion. Council Member Marks made a substitute motion, seconded by Council Member Quiel and unanimously carried, that the Highland Cityhood election item be continued to Tuesday, July 5, 1983, in the Council Chambers of City Hall, 300 North "0" Street, San Ber- nardino, California. PUBLIC HEARING - REVENUE SHARING FUNDS - CONTINUED FROM JUNE 20, 1983 This is the time and place ing to present the proposed use 1983-84 fiscal year. continued to for a public hear- of Revenue Sharing Funds for the (1) Warren Knudson, Director of Finance, presented a memorandum dated June 27, 1983. He stated in his memorandum that current Revenue Sharing legislation expires September 30, 1983 and renewal is being considered by Congress. The 1983/84 revenues as estimated assume the same funding level that is currently being received. He further stated in his memorandum that if increased funding is received as a result of Revenue Sharing revenue, further public hearings may be necessary to designate use of the funds. If de- creased funding results, further budget cuts may be necessary. A decision can be expected by late September and the Mayor and Common Council will be informed as soon as information is avail- able. Council Member Marks made a motion, seconded by Council Mem- ber Frazier and unanimously carried, that the hearing be closed. Council Member Marks made a motion, seconded by Council Mem- ber Hernandez and unanimously carried, that use of revenue shar- ing funds as proposed in the 1983-84 preliminary budget be au- thorized. PRELIMINARY BUDGET ADOPTION - CONTINUED FROM JUNE 20, 1983 This is the time and place continued to for the adoption of the preliminary budget for fiscal year 1983-84. (2) City Administrator Matzer spoke regarding action taking place in the State legislation regarding a cut in subventions which might affect the City's revenue. He also answered ques- tions regarding the Operating Contingency Reserve Fund of $400,000 and the fund balance from fiscal year ending June 30, 1983. CITY NURSERY BUDGET Annie Ramos, Director of Park and Recreation, presented a memorandum dated June 21, 1983 listing the inventory of the City Nursery and the wholesale value and stating that the City Nursery is too costly to operate in the same manner and that it would be in the best interest of the City to at least consider retaining 40% of the Nursery operation.for a one year period and re-evaiu- ating it at that time. The City Council referred to a memorandum dated June 27, 1983 from the Director of Park and Recreation regarding the City Nursery, summarizing information requested by the City Administra- tor and the Council on the cost of operating the Nursery, a plan for phasing out the Nursery operation, inventory of the Nursery and obtaining estimates from commercial nurseries on costs of planting materials. The Council also referred to the memorandum dated June 21, 1983 from the Director of Park and Recreation, analyzing the Nursery's inventory and presented estimates from a commercial nursery for the City's annual requirements in tree planting. The Park and Recreation Director answered questions regard- ing the number of trees the City planted which is estimated at 500 and regarding the inventory on hand at the Nursery. COUNCIL MEMBER FRAZIER EXCUSED Council Member Frazier was excused from the Council Meeting. Harold Martinez, Street Tree Supervisor, answered questions regarding the inventory at the City Nursery. MAYOR HOLCOMB EXCUSED At 3:23 p.m., Mayor Holcomb was excused from the Council Meeting and Mayor Pro Tempore Strickler assumed the duties of the Mayor. - 2 - 6/28/83 Harold Martinez, Street Tree Supervisor, answered questions regarding the purchase price for trees through bid process. After a lengthy discussion, Council Member Quiel made a motion, seconded by Council Member Marks and unanimously carried, to eliminate the City Nursery, to go out to bid to local nurseries and wholesalers to sell the stock on hand at the City Nursery and that this action take effect immediately. The Director of Park and Recreation answered questions re- garding a fence that was recently purchased for the Nursery. Council Member Quiel made a motion, seconded by Council Mem- ber Marks, to immediately salvage the fence, to take it down and put it in storage. Annie Ramos, Director of Park and Recreation, stated that the fence might be used by San Gorgonio High School. Council Member Quiel made a substitute motion, seconded by Council Member Marks and unanimously carried, to either sell the fence to San Gorgonio High School or to remove it immediately and bring it to the City yards. Council Member Marks made a motion, seconded by Council Mem- ber Quie1 and unanimously carried, that $20,000 be put in a special account for fiscal year 1983-84 for the purchase of park trees and that no money be expended from this account without specific approval of the City Council. STREET TREE TRIMMING BUDGET Council Member Marks made a motion, seconded by Council Mem- ber Hernandez and unanimously carried, to consider the Street Tree Trimming budget next. Harold Martinez, Street Tree Supervisor, answered questions regarding the Street Tree budget and tree trimming, stating that the division trims 25,000 trees per year. City Administrator Matzer answered questions regarding tree trimming in other cities, stating that cities are experiencing severe cut-backs in this service. The City Administrator agreed to provide the Council with a report on tree trimming. LIBRARY BUDGET - CONTINUED FROM JUNE 24, 1983 This is the time and place continued to for recommended op- tions from the Library Board of Trustees which are available for a potential savings resulting from a reduction of library hours. The Council discussed their previous action which continued the Library budget to this meeting. Steve Whitney, City Librarian, was present to answer ques- tions regarding further reductions in the Library budget. Council Member Marks made a motion, seconded by Council Mem- ber Castaneda, to table the action on further reductions to the budget for the Library Board. The motion failed by the following vote: Ayes: Council Members Castaneda, Marks, Strickler. Noes: Council Members Reilly, Hernandez. Absent: Council Members Quie1, Frazier. After further discussion, Council Member Marks made a motion, seconded by Council Member Hernandez, that the discussion on the Library budget be continued to the next budget session. - 3 - 6/28/83 The Council discussed holding the next budget session on Wednesday, June 29, 1983. The City Librarian pointed out that it would be unrealistic for the Library Board of Trustees to meet and answer the Council's inquiries regarding further reductions on June 29, 1983. Council Member Marks made a motion, seconded by Council Mem- ber Castaneda, to table the request for the Library Board of Trustees to come up with additional cuts for fiscal year 1983-84. The motion carried by the following vote: Members Castaneda, Hernandez, Marks, Strickler. Member Reilly. Absent: Council Members Quiel, Ayes: Council Noes: Council Frazier. STREET SWEEPING BUDGET Manuel Moreno, Superintendent of Public Services, presented a survey of other cities which shows that most cities sweep resi- dential streets two times per month without a specific charge for street sweeping. An opinion from Allen Briggs, Assistant City Attorney, dated June 27, 1983 was presented. The opinion concluded that the City may make an abutting property owner responsible for debris in the streets, and provide that the Refuse Department shall remove debris from the streets and charge the costs thereof to abutting property owners through levy of a rubbish and garbage removal fee. Bill Woods, Executive Vice President of the San Bernardino Area Chamber of Commerce, asked the Council to consider reducing refuse pick-up to once per week. It was the general concensus of the Council that the refuse service should continue as is. The Public Services Superintendent answered questions and stated that he had attended a Board of Supervisors meeting and found that the dumping fees would not be increased before August 1, 1983. The City Clerk answered questions stating that the Council had set a public hearing for July 18, 1983 to consider an in- crease in refuse fees, adding the street sweeping charges to the refuse bill, and for a report from the City Administrator regard- ing the formation of a benefit assessment district. Council Member Reilly made a motion, seconded by Council Member Castaneda and unanimously carried, that the public hear- ing on the refuse fee increase and street sweeping service charge be held on Monday, August 1, 1983, instead of July 18, 1983, at 9:00 a.m.. in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Administrator pointed out that it would not be necessary for him to prepare a report on a benefit assessment district as the Council's previous action would make a benefit assessment district unnecessary. PAY RAISES - NON-SAFETY EMPLOYEES Council Member Marks made a motion, seconded by Council Mem- ber Hernandez, that $650,000 be tentatively put into an account for salary adjustments for non-safety employees for fiscal year 1983-84 under the following guidelines: $500,000 be available for general cost of living adjustments; that $125,000 be available for equity adjustments; that $25,000 be available for the imple- mentation of department head merit incentive program. The Council discussed Section 186 of the Charter which main- tains raises for Police and Fire employees and the availability revenues to provide raises to non-safety employees. - 4 - 6/28/83 I The motion carried by the following vote: Ayes: Council Members Castaneda, Reilly, Marks, Strickler. RECESS MEETING At 5:02 p.m., Council Member Marks made a motion, seconded by Council Member Hernandez and unanimously carried, that the meeting recess until Wednesday, June 29, 1983, at 1:30 p.m., in the Council Chambers of City Hall, 300 North "D" Street, San Ber- nardino, California. RECONVENE MEETING At 1:34 p.m., the Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino reconvened on Wednes- day, June 29, 1983, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll Call was taken by the City Clerk with the following be- ing present: Mayor Pro Tempore Strickler; Council Members Castaneda, Reilly, Hernandez, Marks, Frazier, Strickler; City Attorney Prince, City Clerk Clark, City Administrator Matzer. Absent: Mayor Holcomb; Council Member Quiel. PARK EXTENSION CONSTRUCTION FUND Dan Rodriguez, Park Superintendent, was present to answer questions regarding the Park Extension Construction Fund. COUNCIL MEMBER QUIEL ARRIVED At 1:40 p.m., Council Member Quiel arrived at the Council Meeting and took his place at the Council Table. Each ward account has been allocated a total of $6,000 for capital improvements. The Park Superintendent also answered questions regarding the park construction fee fund and the Mitchell School proposal. He explained that the Foran Bill will forbid the City to use park construction fee funds which are paid by developers in areas far away from the development which generated the fees. Dan Rodriguez, Park Superintendent, answered questions re- garding parks that have been landbanked, including Buckboard, Al Guhin, Blair Park extension and the Rio Vista extension and gave an update on the status of these parks. Council Member Marks made a motion, seconded by Council Mem- ber Quiel and unanimously carried, to accept the Mitchell School proposal and instruct Park and Recreation staff to prepare fund- ing estimates for alternate levels for development of the Mitchell School site. CUSTODIAL MAINTENANCE BUDGET City Administrator Matzer presented a memorandum dated June 29, 1983 recommending a $90,000 additional cut in the custodial maintenance budget and explaining how the cuts would be accom- plished in each City facility. Wayne Overstreet, Superintendent of Public Buildings, an- swered questions regarding reduced service levels at the Central City Mall, contracting for custodial service, and layoffs within the department. Council Member Quiel made a motion, seconded by Council Mem- ber Hernandez and unanimously carried, that the City Administra- tor's recommendations in his memorandum dated June 29, 1983 for further reductions in custodial services be approved. - 5 - 6/29/83 MEETINGS AND CONFERENCES ACCOUNTS The City Administrator gave a breakdown on the amount budgeted for meetings and conferences throughout the various departments. He stated that the total amount budgeted is $92,972, that $56,605 of that is reimbursable training costs, mostly in the Police De- partment. The training account for the Fire Department is $4,600 and in the Police Department, $5,854 is for non-reimbursable travel and conference expenses. Council Member Marks made a motion, seconded by Council Mem- ber Hernandez, that the meetings and conferences accounts, exclud- ing elected officials, Police reimbursable training accounts and Fire Department reimbursable, be reduced by 10% for fiscal year 1983-84 and that the Police non-reimbursable meetings and con- ferences account be reduced by $2,000. After a lengthy discussion, Council Member Castaneda made a motion, seconded by Council Member Hernandez, to move the previous question. Council Member Marks stated that he would like to amend his motion. Council Member Hernandez withdrew his second to the motion to move the previous question. The motion to move the previous question died for lack of a second. Council Member Marks made a motion, seconded by Council Mem- ber Hernandez, that the meetings and conferences account, except for Police reimbursable training account and Fire Department re- imbursable account, be reduced by 10% for fiscal year 1983-84 and the Police non-reimbursable account be reduced by $2,000. Council Member Castaneda made a substitute motion, seconded by Council Member Hernandez, to remove all meetings and conferences accounts for the Council members. After discussion, Council Member Hernandez withdrew his second to Council Member Castaneda's motion. The motion made by Council Member Marks and seconded by Coun- cil Member Hernandez, that the meetings and conferences accounts, except for Police reimbursable training account and Fire Depart- ment reimbursable account, be reduced by 10% for fiscal year 1983- 84 and the Police non-reimbursable account be reduced by $2,000, carried by the following vote: Ayes: Council Members Reilly, Hernandez, Marks, Quiel, Frazier. Noes: Council Members Castaneda, Strickler. Absent: None. RECESS MEETING At 3:14 p.m., Council Member Marks made a motion, seconded by Council Member Hernandez and unanimously carried, that the meeting recess for ten minutes. Absent: Mayor Holcomb. - 6 - 6/29/83 ORD. MC-284 - ORDINANCE OF THE CITY OF SAN BERNAR- FINAL DINO REPEALING SECTION 3.52.140 OF THE SAN BERNAR- DINO MUNICIPAL CODE RELATING TO THE UNIFORM TRAN- SIENT OCCUPANCY TAX TO ELIMINATE THE RESTRICTION THAT ALL TAXES AND PENALTIES PAID SHALL BE EXPENDED ONLY FOR PROMOTING AND ADVERTISING THE CITY, TOURISM, ESTABLISHING A CONVENTION AND CULTURAL CENTER AND RE- LATED PURPOSES, AND DECLARING THE URGENCY THEREOF. The City Clerk read the title of the ordinance. Council Member Hernandez made a motion, seconded by Council Member Marks and unanimously carried, that further reading of the ordinance be waived and said ordinance be adopted. Ordinance MC-284 was adopted by the following vote: Ayes: Council Members Castaneda, Reilly, Hernandez, Marks, Quiel, Frazier, Strickler. Noes: None. Absent: None. TRANSIENT OCCUPANCY TAX The Council discussed the recommendation that transient oc- cupancy tax be increased to 10% which would bring in an additional $255,000 in revenue in fiscal year 1983-84. Council Member Marks made a motion, seconded by Council Mem- ber Quiel and unanimously carried, to accept a raise in transient occupancy tax from 6% to 10% and direct the City Attorney to pre- pare the appropriate ordinance for final Council action. ADMISSIONS TAX The Council discussed a recommendation to impose a 10% tax on admissions for entertainment and amusement events within the City which would bring in an additional $352,000 in revenue in fiscal year 1983-84. The Council discussed the type of events that would be taxed. Council Member Quiel made a motion, seconded by Council Mem- ber Strickler and unanimously carried, to direct the City Attorney to prepare an ordinance and work in consultation with the City Administrator for imposition of alO% entertainment and amusement tax for events within the City and refer the proposed ordinance to the Ways and Means Committee for study. BUSINESS LICENSE INCREASE The Council discussed a proposal for increasing business license revenues by changing several flat rate categories to gross receipts. Council Member Quiel made a motion, seconded by Council Mem- ber Castaneda and unanimously carried, that the proposed business license increase be submitted to the Legislative Review Committee for their review. STREET SWEEPING CHARGES Council Member Quiel made a motion, seconded by Council Mem- ber Reilly and unanimously carried, to direct the City Attorney to prepare an ordinance to institute a street sweeping fee that will be collected in conjunction with refuse disposal fees. LIBRARY BUDGET The Council discussed the $200,000 allocated for debt ser- vice on the new City library. City Administrator Matzer answered questions stating that if the Council were to eliminate the $200,000 debt service for the Library, that they would be able to balance the preliminary budget. - 7 - 6/29/83 Council Member Hernandez made a motion, seconded by Council Member Castaneda, that the $21,000 allocated in the Mayor's Office for a Public Information Officer, be removed from the budget. Lorraine Velarde, Administrative Assistant to the Mayor, ex- plained why the position is necessary. Council Member Castaneda withdrew his second to the motion. The motion died for lack of a second. Council Member Olliel made a motion, seconded by Council Mem- ber Strickler, to adopt the preliminary budget with removal of the $200,000 for library debt service and allow the City Administra- tor to balance the remainder of the budget (approximately $17,000). The Council discussed FAU money allocated to the 40th Street widening project and the Del Rosa Avenue extension project. City Attorney Prince answered questions regarding the Mayor's veto power. Manuel Moreno, Superintendent of Public Services, answered questions regarding street maintenance, the 40th Street widening project and the Del Rosa Avenue extension project. Council Member Marks made a substitute motion, seconded by Council Member Hernandez, that the $637,500 amount allocated for the 40th Street widening project be reduced by one half and that the Director of Public Works and Superintendent of Public Services be instructed to submit a street improvement priority list for the remaining funds to the Mayor and Common Council for their approval. Roger Hardgrave, Director of Public Works/City Engineer, ex- plained how FAU funds are generated and answered questions regard- ing the Tippecanoe Avenue bridge project. The substitute motion carried by the Council Members Castaneda, Reilly, Marks, Noes: Council Member Hernandez. Absent: following vote: Olliel, Frazier, None. Ayes: Strickler. Council Member Marks made a motion, seconded by Council Mem- ber Castaneda, to eliminate the Del Rosa extension project at this time due to budget constraints and instruct the Director of Public Works and Superintendent of Public Services to submit a street improvement priority list for the remaining funds to the Mayor and Common Council for approval. The Director of Public Works/City Engineer explained that the box culvert portion of the Del Rosa project uses up the majority of the funds allocated to the project. The Council referred back to their previous action. It was pointed out that the Del Rosa Avenue extension project might show up as a priority for use of the FAU funds when the Director of Public Works and Superintendent of Public Services prepares the priority list. COUNCIL MEMBER HERNANDEZ EXCUSED At 5:22 p.m., Council Member Hernandez was excused from the Council Meeting. Council Member Marks made a substitute motion, seconded by Council Member Castaneda and unanimously carried, that the $358,300 identified in fiscal year 1983-84 for the Del Rosa Ave- nue extension project, plus the $318,750 available from the 40th Street widening project be analyzed by the Director of Public - 8 - 6/29/83 Works and the Superintendent of Public Services in such a manner as to submit a priority street improvement project list for Coun- cil consideration at the earliest possible date. Council Member Quiel made a motion, seconded by Council Mem- ber Castaneda and unanimously carried, to close the public hearing on the budget, to adopt the preliminary budget by deleting the Library debt service in the amount of $200,000 and direct the City Administrator and Finance Department to balance the remainder of the preliminary budget (approximately $17,000 remaining). RES. 83-206 - RESOLUTION OF THE CITY OF SAN BERNAR- DINO APPROVING AND ADOPTING THE PRELIMINARY BUDGET OF SAID CITY FOR THE FISCAL YEAR 1983-1984. The City Clerk read the title of the resolution. Council Member Quiel made a mot~on, seconded by Council Mem- ber Castaneda and unanimously carried, that further reading of the resolution be waived and said resolution be adopted. Resolution No. 83-206 was adopted by the following vote: Ayes: Council Members Castaneda, Reilly, Marks, Quiel, Frazier, Strickler. Noes: None. Absent: Council Member Hernandez. FAMILY SWIM PASS - PUBLIC PLUNGES A memorandum dated June 22, 1983 was received from John Kramer, Recreation Superintendent, stating that by direction of the Mayor and Common Council, his department has investigated the feasibility of a family swim pass. He recommended in his memoran- dum that such a pass be established at a rate of $35.00 per season. Council Member Marks made a motion, seconded by Council Mem- ber Quiel, that the family pass program for ~se of public plunges be approved. The motion carried by the following vote: Ayes: Council Members Reilly, Marks, Quiel, Frazier, Strickler. Noes: Council Member Castaneda. Absent: Council Member Hernandez.
