Staff Report
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Mayor to execute Amendment No. 7 to the Agreement with the San Bernardino City Unified
School District to provide contractual services for seventeen (17) CAPS before & after-school
recreation programs at school district sites for the period July I, 2006 through June 30, 2007 and
ratifying all action taken between July 1,2006 and the approval of the Resolution.
Backlrround:
The Creative Before & After-School Program for Success (CAPS) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The City has been a sub-contractor to the school district in this
program since 1999. Each school site provides teachers and aides to lead educational and
tutorial programs. The Parks, Recreation and Community Services Department provides various
recreational activities to youth in the program such as; physical fitness, homework help, sports,
and art & crafts.
The current Agreement with the School District has been Amended several times. Recently,
Amendment No.5 extended the Agreement through June 30, 2007 with the District agreeing to
compensate the City for their services and not to exceed the amount of $459,095. Amendment
No.5 has been executed by both parties.
Amendment No.6, also executed recently, added funding for staffmg costs to complete the
school year. This increase is $6,792 bringing the budget total for all 17 school sites to $465,887.
The School District has determined an additional adjustment is needed to complete the program
through the contract period.
Financial ImDact:
Amendment No. 7 will increase funding for staffing costs incurred dUfing the contract period
July 1, 2006 through June 30, 2007 by $7,000 bringing the total contract amount to $472,887.
Recommendation:

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

16 SECTION 2. The tenn of Amendment is July 1, 2006 through June 30, 2007; therefore,
17 any action taken between July 1, 2006 and the date that this Resolution is executed is hereby

SECTION 3. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the

AGREEMENT FOR CONSULTANT SERVICES IN
COLLABORATION WITH DISTRICT FOR
THE CREATIVE BEFORE AND AFTER SCHOOL PROGRAM FOR SUCCESS (CAPS)
THE AGREEMENT made and entered into the 18th day of July, 2005, by and between the SAN
BERNARDINO CITY UNIFIED SCHOOL DISTRICT, hereinafter referred to as the
"DISTRICT", and CITY OF SAN BERNARDINO PARKS, RECREATION AND
COMMUNITY SERVICES DEPARTMENT, hereinafter referred to as the
"CONSULTANT" is hereby amended this 9th day of January, 2007, hereinafter Amendment
No.7.
RECITALS
WHEREAS, the DISTRICT is authorized by Section 53060 of the California Government Code
to contract with and employ any persons for the furnishing of special services and advice in
financial, economic, accounting, engineering, legal, or administrative matters, if such persons are
specially trained and experienced and competent to perform the special services required; and,
WHEREAS, the CONSULTANT itself is, or those hired by the CONSULTANT are, specially
trained, experienced and competent to render the special services required by the DISTRICT,
and such services are needed on a limited basis; and,
NOW, THEREFORE, in consideration of the covenants and conditions hereinafter set forth, the
DISTRICT and the CONSULT ANT mutually agree to amend this agreement as follows:
I. CHANGES TO THE AGREEMENT:
Pal!e 3. Article IV. Consultant's Fee and Payment Thereof, Paragraph A is amended by
replacing the total amount not to exceed set forth in Amendment No.6 for the period July I,
2006, through June 30, 2007, with the new total amount not to exceed of $472,887.00
(Four Hundred Seventy-two Thousand Eight Hundred Eighty-seven Dollars and
zero cents).

AMENDMENT CONDITIONS:
Any prior Amendment to this Agreement is hereby revoked to the extent it is inconsistent
with this Amendment. All other terms and conditions will remain in full force and effect.

forth below.
