CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolution of the City of San Bernardino authorizing two one-year renewals of agreement with U.S. Armor approved in Resolution No. 2001-377. Backl!round: Every year, the Police Department estimates the number of new and replacement ballistic vests for police officers and reserve officers they will need for the fiscal year and requests a purchase order for this amount. When ballistic vests expire, the manufacturers no longer warranties that item. Also, vests must be replaced due to the extreme heat in which officers wear these vests, the materials break down over the years making them less effective. In FY 2001/02, the city bid for new vests. Notices of Invitation for Bids were sent to II vendors, the San Bernardino Chamber of Commerce, the SUN newspaper and on the City's Web Page. U.S. Armor was the vendor that met and exceeded all items called for in the specifications and thus awarded the bid for ballistic vests. In Resolution number 2001-377, there was no mention of granting two single year options to the annual purchase order for ballistic vests. However, it was included in the vendor's Request for Quotes (RFQ F-02-29) that they signed when they submitted their bids. Option year one, if exercised, shall be effective July 1, 2002 through June 30, 2003. Option year two, if exercised, shall be effective July 1, 2003 through June 30, 2004. Actual option year pricing shall be negotiated between the City and U.S. Armor prior to exercising any given option year. Before the beginning of each option year, U.S. Armor shall be contacted to ensure the pricing of the ballistic vests have not increased. If there is more than a 5% increase, the police department will initiate a new bidding process. Option years shall become effective only upon issuance by the City of a duly authorized Purchase Order. Upon contact with U.S. Armor, they will not increase the price on the Threat II level vests for fiscal year 2002/2003. Financial Impact: Police Department will budget for $50,0000 in account 001-224-5111 for purchase of ballistic vests in proposed budget for fiscal year 2002/2003. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Resolution No. 2001-377, which awarded U.S. Armor a purchase order for ballistic vests, threat level II in the amount of S50,000, be amended to allow for two single year options to the purchase order. U.S. Armor stated they wiII not increase the price for fiscal year 2002/2003. Before the beginning of each option year, U.S. Armor shall be contacted to ensure the pricing of the ballistic vests have not increased.
