Background: On December 4,2000, the Mayor and Common Council entered into an agreement with Fourth Street Rock Crusher and the San Bernardino City Unified School District to construct Phase I of State Street between Baseline and Arroyo Valley High School entrance. The construction of Phase I has been completed and is open. On January 22, 2001, the Mayor and Common Council authorized staff to submit a Surface Transportation Program Fund (STP) grant application to SANBAG for Phases lBI and III of the State Street extension project in the amount of $2,005,000. The required local match for this grant was $674,000 of which $150,000 was to come from Fourth Street Rock Crusher. The Phases lB and III State Street improvement project consists of two paved lanes, grading, drainage improvements, and street lighting for the ultimate four lane improvements between 5th Street and the Arroyo Valley High School entrance as well as a traffic signal at the intersection of State Street (interim alignment) and 5th Street. Phase II consists of new road construction (2 lanes paved), widening, limited drainage improvements, and street lighting between Baseline and 16th Street. The City also received credit during the competitive project evaluation process for the Phase I State Street improvements completed by Fourth Street Rock Crusher and participated in by Fourth Street, the School District and the City. The City was later notified by SANBAG of this grant approval and is therefore recommending approval of this agreement providing for that participation. The project is 90% designed and is currently undergoing the environmental review process. Financial Impact: Funding for the Phase lB and III State Street Project in the amount of $400,000 was approved in the FY 2001102 Capital Improvement Program in Account No's. 129-367-5504-7123/7238 (Yz cent Sales Tax - State Street). Exhibit A AGREEMENT TO CONSTRUCT STREET IMPROVEMENTS AND TRAFFIC SIGNAL - STATE STREET PHASE IB AND III BETWEEN THE CITY OF SAN BERJ"IARDINO AND FOURTH STREET ROCK CRUSHER AGREEMENT This Agreement is made and entered into on , 2002 by and between the City of San Bernardino (hereinafter referred to as "the City") Fourth Street Rock Crusher a California corporation (hereinafter referred to a "Fourth Street"). RECITALS A. The City and Fourth Street have previously cooperated in Phase I improvements to State Street between Base Line and the Arroyo Valley High School entrance approximately 600 feet south. B. To improve safety for community residents, provide enhanced access to the high school, and allow for economic development along this corridor, the City and Fourth Street contemplate designing and installing road improvements commencing at Fifth Street, and continuing to the north as a portion of State Street, more particularly shown on Exhibit "B" attached hereto and made a part hereof. These "Phase I B and III" street improvements shall consist of two paved lanes (including temporary redwood header and no sidewalk) and grading for the ultimate improvements between Fifth Street and 600 feet south of Base Line (high school entrance), as well as traffic control signals with safety lighting and handicap ramps at the intersection of State Street and Fifth Street, collectively referred to as "the Project". C. The City and Fourth Street desire to speGify the terms of participation in the cost to engineer, acquire the right-of-way, and construct the Project. AGREEMENT The parties agree as follows: 1. Obligations of Fourth Street Rock Fourth Street shall: a. Pay $150,000 to the City upon start of construction of the Phase 1B and III of the Project. b. Reasonably cooperate with the City on the acquisition of right-of-way necessary to complete the Phase 1B and III of the project. - 1 - ~ e 2. Obligations of the Citv The City shall: a. At no additional cost to Fourth Street, have the plans and specifications prepared for the Project, and provide utility identification and location, and all necessary construction-engineering services, contract administration, right-of-way acquisition, pennits, authorizations, and any other actions necessary to construct the Project. b. To retain or cause to be retained for audit by the City or other governmental auditors for period of three (3) years from the date of final payment by the City, all records and accounts relating to the construction of the Project. 3. Standards for Construction. The project will be constructed in six (6) phases. The phases will include the ultimate construction of a four- lane roadway with new traffic signals at Sib Street at State Street, Rancho Avenue at Slate Street, Base Line at State Street, and a future traffic signal at glh Street and State Street. The Phase V bridgework and Phase VI ultimate roadway improvements will be constructed at a later date when monies become available. The phase boundaries are shown on the attached Vicinity Map. O;ISTPCaUVaIOO I a.abz.doc 11 F.7 ~ -., ~ EXBmrr A: PROJECT DESCRIPTION/SCOPE OF WORK PART 1 STATE STREET EXTENSION PROJECT The State Street Extension Project is a six (6) phased plan for the ultimate construction of Rancho Avenue, south of Slh Street (FoothiIl Blvd.) northerly to the present terminus of State Street at 16th Street. State Street is designed to be a four lane principal arterial with connections to Interstate 10 at Rancho Avenue and to Interstate 215 at University Parkway as part of the General Plan Circulation Element. See the attached Project Vicinity Map and Phase Rough Estimate Sheets for phasing parameters and scope of work. The work to be done under the proposed STP Funding Application consists of acquiring all of "the necessary project right-of-way and all project construction including construction engineering and design, with the exclusion of Phases IA roadway work, 5, and 6. City staff is designing Phases IA, IB, and 2 of this project. The Phase lA roadway construction, which includes a new traffic signal at Base Line, will be financed with the City's ~ cent sales tax revenues. This construction will be completed by September 2001. The Phase 5 bridge design is complete. The bridge construction will occur at a latter date when additional funding become available. All Phase 6 roadway widening construction to full improvements (curb and gutter) will also occur at a later date. The consultant preparation of Phase 3 and Phase 4 Plans, Specifications, and Cost estimates is 850/. complete. The proposed interim alignment of State Street, until Phase 5 bridge monies can be identified, wiIl be east of the Lytle Creek Channel and will cross over private property, San Bernardino County Flood Control property, Caltrans (Route 66) right-of-way at Sib Street, and a Department of Water Resources easement/right-of- way. The preliminary engineering for Phases J and 4 consists of designing the grading necessary to accommodate a four-lane roadway with two lanes of actual paving, and widening the existing bridge at Sib Street. The two traffic signals at the proposed access road to Sib Street, and Rancho Avenue at Sib Street will also be designed. The design also includes guardrail and protective fencing, as weIl as minor drainage structures for roadway local drainage. The project, to comply with anticipated funding, is being designed in metric. The City will submit all of the required environmental documents and right-of-way documents for this project. c , ~ EXHmIT A: PROJECT DESCRIPTION/SCOPE OF WORK PART Z (B) Project Organizational Structure: STATE STREET EXTENSION PROJECT The City of San Bernardino shall be the "lead Agency" for all aspects of this project. Mr. Jarb Thaipejr, Senior Civil Engineer, will be the designated project manager. The Senior Civil Engineer shall be in charge of project implementation and construction inspection. The construction inspector shall be designated, once the project is awarded and shall act as the laison between the contractors and the project manager. The project manager shall be the contact person with Caltrans Local Assistance and SANBAG. He will be responsible for all progress reports as stipulated in the STP Guidelines. . (C): Required Environmental Documents: An Air Quality Analysis and Biological Study have been obtained as required for an environmental review in accordance with CEQA. The City's Environmental Review Committee, based on an Initial Study prepared by Michael W. Grubbs, Senior Civil Engineer, has recommended a proposed Negative Declaration. This proposal will go before the Mayor and Common Council for their approval sometime in early 2001. I') r EXHIBIT A: PROJECT DESCRIPTION/SCOPE OF WORK PART 3 (E) Project Readiness: STATE STREET EXTENSION PROJECT On October 11, 1996, R. 1. Mullins and Associates, Inc. was contracted to research and prepare ownership plats, prepare a survey plat and planimetric map from field survey, and design the alignment based on City, State and Federal guidelines. This work was done to insure that a roadway was feasible in the area, to be able to provide a basis for final design drawings, and to develop preliminary estimates in order to submit Federal and State-aid grant applications. In May of 1997, letters of interest were sent for proposals on the final design and preparation of construction documents for the project. In September of 1997, a contract for final design services was approved and awarded to the firm of HNTB Corporation for the portion of the roadway between its connection with Rancho Avenue and rjh Street. State Street between 91h Street and ISIh Street, is being designed by City staff. c On March 15,1999, the Mayor and Common Council also approved a contract with T.Y. Lin International for an independent structural plan review of the State Street bridge crossing at Lytle Creek. On March 22, 1999, the City Administrator approved a contract with Ealco Consultants to perform an appraisal of the properties within the roadway alignment between Rancho Avenue and rj" Street. At this time, the street improvement plans by HNTB Corporation and the City are 85% complete. The bridge plans are in the second independent review process. After the plan review process is completed by T. Y. Lin International, we will proceed with the plan review and permitting process with Caltrans, San Bernardino County Flood Control, U.S. Army Corps of Engineers, Southern California Edison and the State Fish and Game Agency. The City has appropriated $712,000.00 towards the project in the 200012001 Vz cent sales tax budget, of which $343,887.00 has been encumbered for the engineering and appraisal process. The remaining $368,113.00 is still in this years budget, although a portion of that funding will be utilized on the Phase I A construction. Recently, the City of San Bernardino Unified School District has asked the City to construct the traffic signal at the proposed intersection of Base Line and State Street. The cost of this new signal is estimated at $110,000.00. The staffs are recommending that the funding for this signal come from the remaining balance of State Street and that the work be completed in Phase I (A) of the project, prior to the opening ofthe new high school. Subsequent to these discussions, a three-way agreement has been reached to design State Street between Base Line and the high school entrance, 800' southerly of Base Line. .. In conclusion, the engineering documents are nearly complete and the project should be .. ready to construct in the I" halfof2001, after the permitting process is completed. Since the date of that letter, we have discovered that the City's condition of approval related to signalization of the intersection of Fourth Street and Mount Vernon A venue, provides as follows: "The City shall monitor the intersection and, upon a determination by the Director of Public Works/City Engineer that Level of Service "E" has been reached, the City shall install the signal. Santa Fe shall participate in the cost of the signal to the extent of35% of the actual design and construction cost; however, Santa Fe's obligation shall not exceed $40,000." Since the City has not yet installed the signal, BNSF (the successor-in-iIlterest of the Atchison, Topeka And Santa Fe Railway Company) has not yet been asked to make any payment. BNSF continues to be willing to financially support the City's State Street project and, at the appropriate time, would agree to contribute to the City, for utilization in the State Street project, the amount of money BNSF would have been required to contribute for the Fourth Street/Mount Vernon Avenue signalization project. As stated in Mark's November 28,2000 letter, BNSF;'s willingness to support the State Street project is on the condition that the transfer of the Foilrth Street/Mount Vernon Avenue signalization project funds would not delay or otherwise adversely affect the signalization of that intersection.
