Synopsis of Previous Council Action:
10/01/2001 - Resolution No. 2001-301 was adopted, approving Tract No. 14193.
Recommended Motion:
That the Director of Development Services and the City Clerk be authorized to proceed under
SBMC 12.90, with the establishment of a Landscape Maintenance Assessment District in the
Ohio Avenue and Walnut Avenue Area, within Tract No. 14193, to be known as Assessment
District No. 1028.

SUBJECT:
Authorization to proceed --- formation of a Landscape Maintenance Assessment District in the
Ohio Avenue and Walnut Avenue area (Tract No. 14193).
BACKGROUND:
On October 1, 2001, Tract No. 14193 was approved. One of the conditions of approval was the
formation of an Assessment District for the maintenance oflandscaping along portions of Ohio
Avenue, Walnut Avenue, Meyers Road and Olive Avenue, within the boundaries of the tract.
A letter requesting the formation of the district was received from the developer, Covenant
Development, Inc., representing the property owner, along with the processing fee of$4,000.
Tract No. 14193 consists of 76 single family lots. The annual cost of maintenance and
incidentals will be spread across these 76 lots. Part ofthe, formation proceedings includes the
preparation of an Engineer's Report, which will detail the costs necessary to carry out the
ongoing maintenance of landscaping and will be presented with the Resolution of Intention at a
future meeting. Approval ofthis district will be subject to an assessment ballot process, which
requires a majority approval by the property owners within the proposed district boundary. Since
all of the properties are currently under one ownership, no protests are anticipated. Future
homeowners will purchase the homes subject to the assessment district. All potential home
buyers will be given a disclosure notice by the developer, advising them of the existence of an
assessment district and the proposed annual cost.
FINANCIAL IMPACT:
None. Applicant has paid the $4,000 processing fee lUtd.all subsequent work carried out in the
district will be assessed back to property owners. '
RECOMMENDATION:
Staff recommends that authorization be given to proceed with the formation of a Landscape
Maintenance Assessment District in the Ohio Avenue and Walnut Avenue area. (Tract No.
14193.)
