RAYA Subject: RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A SIDE LETTER TO RESOLUTION NO. 2001-94, RESOLU- TION ESTABLISHING MANAGEMENT/ CONFIDENTIAL COMPENSATION & UNCLASSIFIED BENEFITS PLAN Dept: HUMAN RESOURCES Or.r>"'~L III ~il .. rt Date: /' APRIL 1,2002 Synopsis of Previous Council Action: On 3/4/02, the Mayor and Common Council adopted Resolution No. 2002-75, Resolution of the City of San Bernardino amending Resolution 6413, Sections Twelve and Fourteen, entitled in part, "A Resolution. . . establishing a basic compensation plan. . . ," by upgrading information codifying prior Council actions (Management/Confidential and Unclassified). Recommended Motion: Adopt Resolution. ~3~ "' . CITY OF SAN BERNARDINO -REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT Adopt Resolution approving a Side Letter to Resolution No. 2001-94, Resolution Establishing Management/Confidential & Unclassified Compensation and Benefits Plan, amending and adding benefits provided to Police Safety Management Employees. BACKGROUND There are fifteen (15) Police Management employees, these include the Chief of Police, Assistant Chief, three (3) Captains and ten (10) Lieutenants. All Police Managers are members of the Management, Confidential and Unclassified Association (MCUA). As such, they are entitled to the benefits received by members of the MCUA. Because of the unique nature of police work, these employees have at times received additional benefits in order to ensure parity with members of the Police Officers Association (POA), whom they supervise. This action will provide the Police Managers benefits that are more closely in line with those received by members ofthe POA. Specifically, they include: Uniform Allowance: Police Managers will receive an annual uniform allowance of $600. Payment for this amount will be retroactive to March 15,2001. Holidav Sellback: Police Managers may sellback up to one-quarter (25%) of their annual holiday leave. Maximum sellback will be 28 hours. Vacation Sellback: Effective January 2002, employees may sellback up to forty (40) hours of vacation time per year. MOU Incentive Pay: Effective April I, 2002, all Police Managers in possession of a POST Management Certificate shall be entitled to receive, in addition to their regular salary, $450 of incentive pay per month. The $450 represents a $150 increase over the 2001 Management Incentive Payment. PERS Nel!otiations: If the City enters into negotiations with the POA pertaining to the 3% @ 50 PERS retirement benefit, or any other PERS retirement issues, the City agrees to discuss similar issues with the Police Managers. Police Manal!ers Association: The Police Managers agree to refrain from discussing organizing into a recognized bargaining unit for or bringing forth any additional request with the exception of PERS retirement benefits for a period of three (3) years from the date of this agreement. FLSA Issues: Ifthe City agrees to implement the 3% @ 50 PERS Retirement Benefit during the term of this side letter, the Police Managers agree to recognize their status as Exempt employees and as such agree to waive any and all claims, past and future, regarding this issue. .. These additional benefits will encourage qualified candidates to promote into Management positions and help retain quality employees in the Management ranks. FINANCIAL IMPACT It is estimated that the total maximum cost for these additional benefits assuming each employee qualifies or utilizes the benefit is $92,000. The cost for the remainder of the fiscal year is minimal, and will be absorbed by the Police Department. RECOMMENDATION Adopt Resolution. EXHIBIT A SIDE LETTER TO RESOLUTION NO. 2001-94 FOR POLICE SAFETY MANAGEMENT EMPLOYEES The following sets forth the side letter to Resolution No. 2001-94 for Management and Confidential and Unclassified Employees: H. Uniform Allowance: Police 1. (Amend) Once each fiscal year, Police Safety Management members will receive an annual uniform allowance of $600 to be paid in a lump sum amount during the first pay period of March. Payment for this amount will be retroactive to March 15,2001. 1. PERS: Safetv Emolovees: (Add) 5. (Amend) Effective April 1, 2002, four hundred fifty dollars ($450) additional compensation per month shall be paid each Police Safety Management member who has obtained a POST Management Certificate. . . . . Q. Vacation Leave: (Add) 5. Effective January 2002, Police Safety Management members may sell back up to forty (40) hours of vacation time per year providing that the following conditions have been met: Police Safety Management members must have a mInImum of one hundred twenty (120) hours in their vacation balance before sell back occurs. Police Safety Management members must have taken a one-consecutive (I) week vacation during the past calendar year prior to the sell back of hours. Eligible Police Safety Management members shall notify the Finance Department by August I ofhislher request to sell back for the prior fiscal year ending June 30. The City shall compensate eligible Police Safety Management members on the first payday in September. Compensation will be calculated using the June 30th hourly rate. x. Holidavs: (Add) Police Safety Management members may sell back up to one-quarter (25%) of their annual holiday leave. Maximum sellback will be 28 hours. Eligible employees shaH notify the Finance Department by August I of his/her request for sellback for the prior fiscal year ending June 30. The City shall compensate eligible employees on the first payday in September.
