BACKGROUND Effective January 1, 2001, California Senate Bill 739 altered the requirements for employee associations to request the right to an agency shop. An agency shop agreement between a union and the City of San Bernardino requires all employees in a bargaining unit to become dues paying members, or alternatively, pay an equivalent fee to the union. The San Bernardino Public Employees Association (SBPEA) complied with all the mandated requirements set forth in SB 739. On October 19, 2001, the State of California Department of Labor Relations mailed ballots to all General Unit Employees as identified by the City. The ballots were due to the State of California on November 6, 2001; on November 14, 2001, representatives of the City of San Bernardino, SBPEA and the State of California counted the ballots. A total of 207 ballots were received; 140 voted for the agency shop with 67 voting against it. The Agency Shop has brought to light an issue involving unit assignment of employees working for elected officials. Under the City Charter, employees of elected officials are unclassified and as such are considered "at will employees." In spite of this, there are fourteen (14) employees in ten (10) classifications assigned to the General and Mid-Management bargaining units who work for elected officials. The City Attorney's Office has issued an opinion, which determined that assignment to these bargaining units conferred certain rights on these employees, which are in conflict with the City Charter. As a result of this opinion, staff is recommending that the Management/Confidential Association be re-titled to the Management/Confidential and Unclassified Association and that the affected positions be remove from the General Unit and Mid-Management salary resolutions and place them in the Management/Confidential and Unclassified Association. All employees will receive benefits as described in the Management/Confidential and Unclassified Resolution. The affected employees have been notified of this action and the change in benefits. Benefit changes will occur during the next open enrollment period. Salaries, however, will remain the same until the Management/Confidential and Unclassified group receives an increase; a cost of living increase of 2% is scheduled for July I, 2002. As a result, the newly created Unclassified positions will have a different salary ranges than the like positions in the General Unit and Mid-Management groups. One employee, who is currently in the Mid-Management group but will be placed in the Management group, currently receives 40 hours of Administrative Leave. Upon placement into the Management group, this employee will receive 56 hours of Administrative Leave. All other employees will not receive Administrative Leave but will receive overtime as they currently do. FINANCIAL IMPACT There will be an increase in the City's life insurance for these employees. The amount of the life insurance will increase from $10,000 to $25,000 for each employee. The current maximum City-paid contribution for employees in the General Unit is $400 per month and $443 per month for Mid-Management employees. The new maximum contribution will be $881 per month. There are currently thirteen (13) General Unit employees and one (I) Mid-Management employee who will be moved into the Management/Confidential and Unclassified Association. Current Maximum Benefit Cost: 13 x $400 per month = $5,200 I x $443 per month = $ 443 Total Monthly Cost = $5,643 x 12 months = $67,716 current maximum annual cost Proiected Maximum Benefit Cost: 14 x $881= $12,334 per month x 12 months = $148,008 projected maximum new annual cost TOTAL PROJECTED MAXIMUM ADDITIONAL ANNUAL COST: 580,292 Staff recommends that the estimated cost of $80,292 be absorbed by the affected Departments (Mayor's Officer, City Treasurer, and City Clerk).
