CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
Subiect:
Resolution of The Mayor and Common Council of The City of San Bernardino adopting a
process for evaluating applicants to the city's tow rotation consistent with Resolution 1999-86.
Backl!round:
On May 20, 1999, Mayor Valles and the Common Council adopted Resolution 1999-86, which
establishes the standard criteria for companies to provide tow services for the City. Section 2,
Element 6 reads in part, "City shall enter into agreements with tow carriers not to exceed one
company per 35,000 residents of the City. When rounding to the next highest number, this
fonnula equates to six tow carriers at the current population of 185,272 (2000 Census).
An opening on the rotation was created in May 2001, when the agreement between the City and
Lorna Linda towing (AKA: University Towing) was terminated. The opening has since been
filled by Hayes Towing on an interim basis.
When the opening was created by Loma Linda's termination, the Legislative Review Committee
requested that the Police Department develop a process to be used to evaluate and grade
prospective tow companies who seek a position on the rotation list.
Several meetings were held with the Legislative Review Committee, and on one occasion
(August 23. 2001) with several interested tow carriers. Input was received from all interested
parties as to what was important for the Police Department to document and what was not
important. It was considered by all interested parties throughout the process that the grading be
as objective as possible. Comments were offered by the Legislative Review Committee, tow
carriers both big and small, tow carriers currently on the rotation and carriers that would be
applying as well as representatives from the Police Department.
Taking all comments and suggestions into consideration, the evaluation process and grading
sheet were finalized at the September 6th meeting of the Legislative Review Committee. (Refer
to attached grading sheet).
By formally adopting the process as developed, any future applicants to the City's tow rotation
can be assured that they will be evaluated and graded by the same criteria used for all existing
carriers on the rotation, Formally adopting this process also assures any and all future applicants
that they will be treated and evaluated as objectively as possible.

The Police Department is in the process of evaluating four eligible tow companies that have
applied for the current opening. If the process is approved at this meeting, the Police Department
will be bringing forward a request for Council action at an upcoming meeting to recommend
appointing a sixth tow company to the rotation.
Financial ImDact:
There is no financial impact to the City. Any future applicant that is awarded a position on the
City's rotation will incur an equal share of the $24,000 per month Franchise Fee, which is
invoiced to the participating tow companies.
Recommendation:
Adopt Resolution.
