Synopsis of Previous Council Action:
7/9/01 Allocation of $219,400 in the 2001/02 Capital Improvement Program (CIP) for Street
Improvement/Safety Improvement-Citywide (Account No. 129-367-5504-7239).
8/20/01 Resolution approving Contract Amendment No. I with Korve Engineering, Inc. for the design
of the traffic signal and street improvements at Kendall Drive and Wagonwheel Road.
Recommended Motion:
1) Adopt Resolution.
2) That the Mayor and Common Council authorize the Director of Finance to amend the FY 2001/02
budget to transfer $162,000 from Account No. 129-367-5504-7239 (Street Improvement/Safety
Improvement-Citywide) to Account No. 129-367-5504-7276 (Traffic Signal at Kendall Drive and
Wagonwheel Road).

STAFF REPORT
Based on review of the sealed competitive bids received, staff has determined that DBX, Inc., the
apparent low bidder, has met the minimum requirements of the specifications and bid guidelines,
and therefore recommends that the Mayor and Common Council award the referenced contract
accordingly.
Financial Impact:
Funding for this project, in the amount of $162,000 is available for this project in Street
Improvement/Safety Improvement Account No. 129-367-5504-7239. In order to accommodate
the design, construction, inspection, and contract administration, staff recommends that
$162,000 be transferred from Account No. 129-367-5504-7239 to Account No. 129-367-5504-
7276.
Recommendation:
That the Mayor and Common Council authorize the Director of Finance to amend the FY
2001102 budget to transfer $162,000 from Account No. 129-367-5504-7239 (Street
Improvement/Safety Improvement-Citywide) to Account No. 129-367-5504-7276 (Traffic Signal
at Kendall Drive and Wagonwheel Road); and adopt resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO DBX, INC., FOR INSTALLATION
OF TRAFFIC SIGNAL AT KENDALL DRIVE AND WAGONWHEEL ROAD, PLAN
NO. 10369.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. DBX, Inc. is the lowest responsible bidder for installation of traffic
signal at Kendall Drive and Wagonwheel Road, per Plan No. 10369. A contract is awarded
10 accordingly to said bidder in a total amount of $121,449.50 with a contingency amount of

$20,000.00 but such award shall be effective only upon being fully executed by both parties.
All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to
execute said contract on behalf of the City; a copy of the contract is on file in the office of the
City Clerk and incorporated herein by reference as fully as though set forth at length.
16 SECTION 2. This contract and any amendment or modifications thereto shall not take
17 effect or become operative until fully signed and executed by the parties and no party shall be

obligated hereunder until the time of such full execution. No oral agreements, amendments,

course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
23 within sixty (60) days of passage of the resolution.
