BACKGROUND At its meeting on October 16, 2001, Planning Commission voted 6 to 1 to approve CUP No. 01- 14 to allow Fanatics Restaurant to upgrade its ABC license from a Type 41 license to a Type 48 license with live entertainment. Commissioners Durr, Enciso, Lockett, Ramirez, Sauerbrun and Thrasher voted in favor of the motion, Commissioner Garcia voted against the proposal and Commissioners Derry and Welch were absent. The appellant spoke in opposition of the proposal and disagreed with the Planning Commission's decision at the Meeting of October 16, 2001. As a result, the appellant filed an appeal to the Mayor and Common Council on October 31, 2001. The appellant is asking that the Mayor and Common Council overturn the decision of the Planning Commission and deny the ABC upgrade based on his evidence that was not presented in the initial investigation by the Police Department. The appellant's grounds for the appeal are that the investigation by the Police Department was incomplete. The appellant contents that the neighbors were not consulted and that the Police Department only contacted one resident at 1684 Sheridan Road. The appellant also states that the noise levels are excessive and that there is loitering and public drinking as well as people urinating in public at the commercial retail center. RECOMMENDATION Staff recommends that the Mayor and Common Council deny the appeal and uphold the Planning Commission's approval of Conditional Use Permit No. 01-14, based upon the Findings of Fact contained in the Planning Commission Staff Report, subject to the Conditions of Approval. Page 2 REQUEST AND LOCATION A request for approval of a Conditional Use Permit under the authority of Development Code Section 19.06.020, Table 06.01, (d) (2), to upgrade a Type 41 (on-sale beer & wine -eating place) to a Type 48 (on-sale general -public premise) liquor license with live entertainment at Fanatics Restaurant located at 1689 Kendall Drive, Suite H, in the CG-1, Commercial General, land use district. The applicant has requested an upgrade to the ABC license with live entertainment to attract more customers and increase business by expanding their services. The Type 48 license will allow Fanatics Restaurant to sell liquor in addition to beer and wine. The proposed live entertainment includes small 3 to 4-piece jazz bands. The project site is located in an existing commercial retail multi-tenant center. Fanatics Restaurant occupies approximately 2,687 squaze feet of the 16,955 square feet retail/commercial center. No building modifications aze proposed as part of this project. The hours of operation are from Sunday thru Thursday, 11:00 am to 12:00 am, and Friday & Saturday, 11:00 am to 2:00 am. SETTING/SITE CHARACTERISTICS The site is an irregularly shaped parcel of land approximately 2.61 acres in size and is located at the southeast corner of Kendall Drive and University Pazkway. Surrounding the property to the east across Kendall Drive and to the west are multi-family residential uses in the RM, Residential Medium, land use district. The property to the southeast is single family residential uses in the RS, Residential Suburban. On the northwest at the comer of Kendall Drive and University Parkway is the approved Campus Crossroads project development currently under construction CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) The approval of the Conditional Use Permit for the proposed use is in compliance with the requirements of the California Environmental Quality Act in that the project was found to be exempt from CEQA per § 15301 for an existing facility. CEQA allows for the exemption of projects in existing facilities where no major change are proposed. BACKGROUND On March 20, 2000, Development Permit (Type I) No. 00-16 was approved to allow Fanatics Restaurant to establish alcohol service with a Type 41 (on-sale beer & wine) license. The Police Department has reviewed and investigated this matter. They have expressed no objection to the Type 48-liquor license and live entertainment proposal. Their written reports and findings recommend approval of CUP No. 01-14, on the condition that the applicant obtain all other necessary permits (Attachment C). nditianal Use Permit No. 0/-!4 .fleeting Date: October 16, 2001 Page 3 FINDINGS AND ANALYSIS The proposed use is conditionally permitted within and would not impair the integrity and character of the subject land use district and complies with all of the applicable provisions of the Development Code? Yes, pursuant to Development Code Section 19.06.020 Table 06.01 (D)(2), night clubs are allowed uses in the CG-1, Commercial General, land use district, subject to the approval of a Conditional Use Permit. The proposed project will enhance the center in that it will provide an entertainment outlet to serve the residences and allow the applicant to expand their business. The proposal would not impair the integrity and character of the area in that the proposed activity will be conducted completely within an enclosed structure. The proposed project complies with all applicable provisions of the Development Code. 2. The proposed use is consistent with the General Plan. Yes, the proposed use is consistent with General Plan Policy 1.6.2. that states: "control the location and number of alcohol sales, adult bookstores and business, game arcades and other community-sensitive uses, based on proximity to residences, schools, religious facilities, and parks in accordance with legislative and legal requirements." 3. The approval of the Conditional Use Permit for the proposed use is in compliance with the requirements of the California Environmental Quality Act. Yes, the approval of the Conditional Use Permit for the proposed use is in compliance with the requirements of the California Environmental Quality Act, in that the project was found to be exempt from CEQA, Section 15301, Class 1. CEQA allows for the exempt of projects in existing facilities where no major change are proposed. 4. There will be no potential signifcant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored. No, as noted in Finding No. 3, this project is exempt from CEQA. S. The location, size, design, and operating characteristics of the proposed use are compatible with the existing and future land uses within the general area in which the proposed use is to be located and will not create significant noise, traffc or other conditions or situations that may be objectionable or detrimental to other permitted uses in the vicinity or adverse to the public interest, health, safety, convenience, or welfare of the City. Yes, the proposed project is located in an existing multi-tenant commercial center in the CG-1, Commercial General, land use district. The proposal will operate in a manner consistent with the CG-1 land use district. October 16, 1001 Page 4 conditions that are detrimental to public health. This is because the proposed project complies with all applicable provisions of the Development Code. 6. The subject site is physically suitable for the type and density/intensity of use being proposed. Yes, the proposed project is located in an existing multi-tenant commercial center. As mention in Finding #5, the existing multi-tenant center complied with all applicable provisions of the Development Code for parking and landscaping at the time the center was first occupied in 1990. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to public health and safety. Yes, public access, water, sanitation and other public services were established with development of the multi-tenant center. This proposal does not affect these services. CONCLUSION The proposal meets all necessary Findings of Fact for approval of [he Conditional Use Permit. Staff recommends the Planning Commission: Approve Conditional Use Permit No. 01-14 based upon the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval (Attachment C). In the event this approval is legally challenged, the City will promptly notify the applicant of any claim, action or proceeding and will cooperate fully in the defense of this matter. Once notified, the applicant agrees to defend, indemnify and hold harmless the City of San Bernardino (City), the Economic Development Agency of the City of San Bernardino (EDA), any departments, agencies, divisions, boards or commission of either the City or EDA as well as predecessors, successors, assigns, agents, directors, elected officials, officers, employees, representatives and attorneys of either the City or EDA from any claim, action or proceeding against any of the foregoing persons or entities. The applicant further agrees to reimburse the City of any costs and attorneys' fees which the City may be required by a court to pay as a result of such action, but such participation shall not relieve applicant of his or her obligation under this condition. The costs, salaries, and expenses of the City Attorney and employees of his office shall be considered as "attorneys fees" for the purpose of this condition. As part of the consideration for issuing this permit, this condition shall remain in effect if this Conditional Use Permit is rescinded or revoked, whether or not at the request of applicant. 2. Signs are not approved as a part of this permit. Prior to establishing any new signs, or replacing existing signs, the applicant shall submit an application, and receive approval, for a sign permit from the Planning Department. 3. Hours of operations shall be from Sunday thru Thursday, 1 I :00 am to 12:00 am, and Friday and Saturday, 11:00 am to 2:00 am. 4. This approval shall comply with the requirements of other outside agencies (i.e., San Bernardino County Health Department, San Bernardino Department of Environmental Health Services, and California Board of Equalization), as applicable. 5. If the color of the building is to be modified, the revised color scheme shall be reviewed and approved by the Planning Division prior to painting. 6. This Memorandum was regarding a Conditional Use Permit No. 01-14. On 09/10/01 I was assisting CSR-II SOTO. I saw that she had received a second Memorandum from Senior Planner, Joe Bellandi. Again, this was in regazds to Conditional Use Permit No. 01-14. The applicants, SHASHI PATEL and GIRISH PATEL aze applying for an ABC License Type-48, On Sale, General. They aze also applying, in the second Memorandum, for a Live Entertainment Permit. This is for the business named "Fanatics Restaurant" located at 1689 Kendall, San Bernardino. RECOMMENDATIONS: Approval for C.U.P. No. 01-14, Live Entertainment Permit is recommended, as long as the applicants adhere to San Bemazdino Municipal Code 5.14.010 and more specifically 5.14.050. (this coincides with the Memorandum completed by CSR-II SOTO, approving the C.U.P. No. 01-14 on 08/23/01) FINDINGS: On 09/10/01, I spoke with applicant GIRISH PATEL. I met with him at his business. He confirmed the business hours and that the live entertainment is normally a small band consisting of three to four band members. PATEL also stated that he does not schedule a live band every week-end. I then contacted a resident, whose property is adjacent to the reaz of 1689 Kendall. This residence is located at1679 Sheridan. I contacted a female resident. I asked if she has ever had any problems with litter, loud music, or loitering from the baz, which is located adjacent to her property. The resident did not have any complaints about the business and its operations. Today I checked with the resident at 1684 Sheridan. She has no complaints against the bar. The side of hewr property is adjacent to the block wall for the property. I also spoke with the owner Girish Patel. He said he does not hire a band every weekend. when he does have a band it is usually a 3 to 4 piece band. The set up location is at the far end of the bar which could help to keep any loud music from disturbing the residents. If O.K. I do not see any reason to deny the live entertainment permit. I just need to complete a form that is attached with the approval. NOW, the owner is applying fora "live entertainment" permit at the restauranUbar. Apparently, he has been having live entertainment (Jazz Bands). He ws told that he can not have the bands until he obtains a permit. My only concern is that there are residences to the rear of the business. I also do not know how loud the music is and if the building is soundproof enough to avoid disturbances. The memo from Joe Bellandi,Sr. Planner, states that he needs a response before 9-14-01 (Fri). The statistics reveal 112 Part I Crimes and 40 Part II Arrests. The business is in Census Tract 46.01. There are six on-sale ABC licenses allowed. There are three on-sale ABC licenses existing. FINDINGS: On I-27-00, I spoke with applicant, Sayel Abuhasou at the police departrment. He said there will be about ten employees and he will be the on-site manager. The business will be open seven days a week from II:00 a.m. to 12:00 midnight. He said there will be no video game machines or any pool tables. He said there will be 10-12 televisions. He said he plans to have a full food menu. He plans to have kareoke. The business is in Census Tract 46.01. There are six on-sale ABC licenses allowed and at this time there are two existing on-sale ABC licenses and one pending. The statistics for 1999 reveals 113 Part I Crimes and 54 Part II Arrests. Area Commander Lt. Poyzer was asked for his input. Lt. Poyzer responded by stating that Sgt. Boom checked the location and the standard conditions would be fine. He has no objection to the issuance of a license. Police Department OP Office on Kendall Drive December 4, 2001: I spoke with Sgt. Patterson, Day Shifr Supervisor at the Area "B" COP Office in the North End, located on Kendall Drive. He advised that there was a shooting incident at the Fanatics Bar a month or so ago. The shooting occurred outside but the persons involved appazently came from inside the club. Patterson advises tharthey have had eery few complaints regarding the bar and indicates that the few calls there ue, are about normal for any bar. He went on to say another baz located in the North end is a bigger problem that they are addressing. Sgt. Patterson indicates that he works day s and is not aware of the live entertainment but will check with the other shifts and advise me. Overall, Sgt. I advised ~Ir. `that I was conductive an investigation as the Fanatics ort Club has requested an up?rade in their liquor license to include full cocktails. Mr. indicates he did • not want to interfere with another mans business. He did advise that the owner of Fanatics, when hz wantzd to put the fence up that would allow for him to have smokers and drinking outside, had told him that he would provide security and keep the area clean. Mr. `said that for a little while he did have someone out there and kept the trash and cigarette butts picked up. However. the past 3-4 months or so he has not had any security and sometimes when female customers leave or ente they get catcalls and comments made to them. He also advises that the owner does not keep the area clean and there is ahvays trash out there which ~-Ir. icks up because it affects his business which is primarily day and eazly evenins. dir. Ii`iTERVIE«': • Ms.~adeises that the shopping center opened about 8-9 years ago and that it was no problem until the bar opened. It was quiet in the night and the traffic was normal. ~Ss.~indicates that when the vehicle pulls from the parking area of the center onto the roadway there is a little concrete dip. She indicates 10-1~ times a night the cars pulling from that bar hit that dip and spin their tires and "race" from the location. his indicates that regularly they (patrons of the bar) sit out in the parking lot, talking and hollertne, urinatins in the bushes and sometimes there are fights. l~'hen asked to describe the term ~~regularly" she said some weeks maybe 2-3 times and others maybe ~-6 time and some or all of the activities described occur. Not all of the problems occur every night. She states that the noise from that bar rattles her windows and her china cabinets She says she • has called the police several times on the noise afrer her husband had spoke to them about it. She indicated that the noise, loud music. is almost a nightlc thing. She says that the bar has had live music there in the past and that even Mr. Patel said in the papers he has had live entertainment which is a ~ iolation and so are his many Televisions. ~Ss.•says that he (~fr. Patel) has put up banners twice in the past without permits that she knows of and that the city has had to come and take down. Ms. sacs that there have been bottles thrown in the parking lot and on lawns in the neighborhood. She says that a lot of bottles are thrown and broken by the block wall neaz the shopping center. Ms.~,vas adamant that the bar was responsible for a lot of situations and problems in a predominately residential area. Overview: 1. Police have not had many calls to the location over the period of 18 months that it has been in operation. One major incident involving a shooting, a few minor disturbances including fights and domestic problems but overall less calls for service than other bars operating within their area of responsibility. i`4s. ~ays that on the night of the shooting, the man with the gun was standing in the middle of the street in front of her house shooting down the street and he came from that baz. 2. Adjoining business, food and dining establishments, concerns are the lack of security for their customers entering and leaving while people aze outside drinking. They aze concerned about the trash and debris in their entry areas resulting from the drinking in front of the bar. These business's do not have any objections to the bar itself as long it provides necessary security picks up after its customers. They did mention the loud music however, indicated most of it occurred later in the evening closer to 9:00 PM. Pursuant to Development Code Section 19.06.020 Table 06.01 (D)(2), nightclubs/sports bazs are conditionally permitted uses in the CG-1, Commercial General, land use district, subject to the approval of a Conditional Use Permit. The Mayor and Common Council considered an appeal of the Planning Commission's approval of the Conditional Use Permit and received testimony from azea residents expressing concerns with the proposed use. The Mayor and Common Council continued the item to enable the City Attorney's Office to investigate those concerns. The results of that investigation (Memorandum dated December 6, 2001 from City Attorney Investigator Hugh Gonthier to City Attorney James F. Penman) are incorporated herein by reference. The investigation concluded that activities associated with the current approved use - a restaurant with ancillary sales of beer and wine -have impaired the integrity and character of the subject land use district. Other businesses in the center have been adversely impacted by excessive noise, disorderly conduct, littering, loitering, drinking and urinating in public, and lack of security associated with Fanatics. An intensification of the use, including an upgrade of the ABC license and live entertainment would adversely impact the adjacent commercial and residential uses. 2. .The location, size, design, and operating characteristics of the proposed use are not compatible with the existing and future land uses within the general area in which the proposed use is to be located and will create signifecant noise, and other conditions or situations that may be objectionable or detrimental to other permitted uses in the vicinity and adverse to the public interest, health, safety, convenience, or welfare of the City. The current business obtained a Development Permit to establish a restaurant with ancillary sales of beer and wine, and an Operator's Permit for that use. However, the business owner established a sports bar and has been operating the use in violation of existing City requirements. The sports baz is located in an existing multi-tenant commercial center that provides arange ofneighborhood-serving uses. The current use has created objectionable situations that are adverse to the public interest, health, safety, convenience or welfare of the residents of the ~/~ CUP No. 01-14 Findings of Fact January 22, 2002 Page 2 of 2 neighborhood and has been detrimental to the other permitted uses in the vicinity. The current use has adversely impacted the quality of life of the neighborhood due to noncompliance with previously approved conditions of approval. The current business has conducted live entertainment without permits, and has failed to adequately monitor security resulting in excessive noise, disorderly conduct, littering, loitering, drinking and urinating in public. Due to the business owners' disregard for existing City requirements, intensification ofthe existing use will exacerbate adverse impacts on the adjacent commercial uses and residents. 3. The subject site is not physically suitable for the type and density/intensity of use being proposed. As outlined in the investigation report, excessive noise from the current use and the patrons associated with the use has adversely impacted adjacent commercial and residential uses.
