Staff Report
SUBJECT:
Resolution establishing the northwesterly right-of--way boundary for a portion of University
Pazkway, northeasterly of Kendall Drive.
BACKGROUND:
On May 7, 2001, Resolution No. 2001-91 was adopted, vacating a portion of the northwesterly
side of University Pazkway, northeasterly of Kendall Drive. The vacation was a result of a
request by the adjoining property owner, University Commons, LLC, and the City's
determination that the right-of--way along this portion of University Parkway was in excess of the
City's standards for major arterial streets. Although the public right-of--way was vacated, the City
still had fee title to the 40-foot strip. Subsequently, University Commons requested to purchase
the land from the City. After the normal procedures for the sale of City property was carried out,
a portion of the 40-foot strip was sold to University Commons, as authorized by Resolution No.
2001-237, adopted July 23, 2001.
Since a small strip remains between University Commons property and the easterly line of the
vacated 40-foot strip, this action is necessary to establish the new right-of--way line for
University Pazkway, as set forth in the attached resolution.

RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING THE
NORTHWESTERLY RIGHT-OF-WAY BOUNDARY FOR A PORTION OF UNIVERSITY'
PARKWAY, NORTHEASTERLY OF KENDALL DRIVE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the northwesterly right-of--way boundary for a portion of Universit}•
Parkway, northeasterly of Kendall Drive is hereby established as described in the Exhibit "A".
attached hereto and made a part hereof, and that the same is set aside for public street and highway
purposes.
SECTION 2. That the City Clerk is hereby authorized and directed to cause a certified
copy of this Resolution to be filed with the County Recorder's office of San Bernazdino County.

At the Mayor and Common Council meeting of January 22, 2002, the City of San Bemazdino
adopted Resolution No. 2002-18 -Resolution of the City of San Bernardino establishing the
northwesterly right-of--way boundary for a portion of University Parkway, northeasterly of
Kendall Drive.
Section 2 directs the City Clerk to cause a certified copy of the resolution to be filed with the
County Recorder's Office of San Bemazdino County; therefore, I am providing you with one
