BACKGROUND: Assessment Districts are formed to provide funding for the ongoing maintenance of the landscaping in the designated areas, typically new subdivisions. Contracts are awarded and provide for two one-year extensions of the contract on mutually agreeable terms. All Assessment Districts, with the exception of Assessment District Nos. 1025 and 1027, which are new districts, have had the same contract for the past three years and have been rebid in accordance with the contract provisions. With the exception of 4 Assessment Districts, districts are grouped into contract areas and are combined with other districts to form projects of sufficient size as to insure bids are competitive and all contractors have adequate work to justify coming into the area. There are 33 individual landscape maintenance districts grouped into 9 contract areas. The 4 single district contract areas (areas C, D, F & I) are not in close proximity to any other district and it would not be efficient to combine them with other districts. The attached vicinity map shows the general contract areas. Plans and Specifications for the various districts were prepared and a Notice Inviting Bids was advertised locally in the San Bernardino County Sun Newspaper, the City's web site, Bid America web site, F.W. Dodge San Bernardino Plan Room, Daily Construction Plan Room in Anaheim and Manhattan Beach, and the San Bernardino Area Chamber of Commerce. Bids were opened on November 20,2001, and the following companies responded (apparent low bids are shown in bold): AREA "A" - Ward 5. Although the apparent low bid for an area might not be the lowest bidder for each district within the given area, contracts are awarded for the lowest bid on the overall area. Two contracts areas, specifically area "D" and area "F" will need to be awarded to the second lowest bidder, since the low bidder did not submit a bid bond, which is required as set forth in the special provisions and bid specifications. Although some of the districts' contract costs increased over last year, there are adequate reserves set aside to allow for increases without increasing assessments. Additionally, none of the contract costs increased over a previously approved assessment, thus Proposition 218 Assessment Ballot procedures will not be necessary when the assessment rolls are approved the following year. Three of the four low bidders (i.e. Golden West landscape Contractor, R P Landscape & Irrigation and Trugreen Landcare) have had previous contracts with the City and have performed satisfactorily. We have not had any prior experience with D.M.S. Landscape Services, but have contacted references (City of Ontario and City of Yorba Linda) and none have reported any problems with performance. The contract costs will be reimbursed through the assessment rolls, with the exception of those districts where a portion of the costs determined to be a General Benefit cannot be assessed back to the district, pursuant to Proposition 218, and thus will need to be paid from the General Fund. The General Benefit amount varies for these districts based upon the formula set forth in the Engineer's Report, based on whether any maintenance is performed on an arterial or collector street. For AD 1020 (Mill Street), the General Benefit has been determined to be 25% of the total contract costs. Thus 25% of$I,723.50, or $430.88, will need to be funded by the General Fund and not reimbursed by assessments. Staff Report -Page 5 For AD 1025 (Palm & Washington), the General benefit has been determined to be 25% of 65% of the total contract costs, Thus 25% of65% of $2,706.00, or $439.73, will need to be funded by the General Fund and not reimbursed by assessments. For AD 1027, (Waterman and Washington), the General Benefit amount has been determined to be 25% of39% of the total contract costs. Thus, 25% of39% of$8,190.14, or $798.54 will need to be funded by the General Fund and not reimbursed by assessments. The total General Benefit amount for all three districts is $1,669.15. The remaining districts will be reimbursed through the assessment rolls. FINANCIAL IMPACT: None. The total contract maintenance costs of $245,832.14 will be reimbursed through the annual assessment rolls for the various Assessment Districts, with the exception of $1 ,669.15, which will be funded from Account Number 001-182-5505-0000 (Real Property Landscape Contracts).
