REQUEST FOR COUNCIL ACTION STAFF REPORT On December 21, 1992, authorization was given to proceed with the acquisition of right-of-way for the Easterly extension of Orange Show Road, from Arrowhead Avenue to Tippecanoe Avenue. One of the parcels acquired was an approximately 2.13 acre parcel with a 5,700 square foot building, formerly used as a church. In order to facilitate the installation of street improvements for the extension of Orange Show Road, the building will have to be demolished, as stated in the specifications for the construction contract, which is presently out to bid. It is estimated that the demolition will cost between $10,000-$15,000. Since the building was set to be demolished and due to time constraints to commence construction of the roadway, no marketing was done for the sale of the building. However, a letter of intent to purchase the building was received from Jesus Outreach Ministries. They wish to purchase the building and are willing to pay all relocation costs. We feel that this would be a more economical approach since it would save having to pay demolition costs. Since the building cannot be given away for free, we are recommending the sale price of$1. This Agreement, dated this day of , 19_, between JESUS OUTREACH MINISTRIES ("BUYER") and the CITY OF SAN BERNARDINO ("CITY") for the sale ofa City owned building, located at 1214 South Waterman Avenue. RECITALS A. The CITY has purchased and is the present legal owner of real property located at 1214 South Waterman Avenue, Assessor's Parcel Number 0136-431-22 & 23, for right of way purposes for the extension of Orange Show Road. B. Said property contains a building of approximately 5700 square feet, previously used as a church. C. The CITY intends to demolish said building to facilitate the construction of street improvements for said Orange Show Road. D. The CITY has estimated the cost of demolition between $10,000 - $15,000. E. BUYER has presented CITY with a letter of intent to purchase and remove said building from the property at the BUYER'S expense. . F. CITY desires to sell the building to save the cost of demolition. NOW THEREFORE, IT IS AGREED BETWEEN THE P ARIlES AS FOLLOWS: I. Descriotion of Prooertv to be Sold The property to be sold consist of a building ONLY, approximately 5700 square feet in size, includirig fiidures and appurtenances, located at 1214 South Watemian Avenue, on the real properij described as Lots 101 and 102, Valley Farms Tract No. 1995, as per map recorded in Book 29 of Maps, pages 13, records of San Bernardino County, State of California, also known as Assessor's Parcel Number 0136-431-22 & 23. No land is being sold or transferred as part of this agreement. 2. Purchase Price - BUYER agrees to pay CITY the sum of ONE DOLLAR ($1) as full consideration for this purchase. 3. Removal of BuildinlZ - BUYER agrees to remove said building from the above described real property within sixty (60) days of the date of this agreement. Said removal shall be done at the BUYER'S sole expense and CITY assumes no liability or expenses in connection with the removal of said building. . EXlllBIT "An . 4. Permits - BUYER shall obtain all necessary permits and pay fees in connection with the removal and relocation of said building and shall comply with all State, County and City codes and regulations regarding such relocation. 5. Condition of Prooertv - The building is being sold is "AS-IS" and CITY makes no warranties as to the condition of the building, including but not limited to the inclusion of hazardous materials nor to the fitness for intended use by BUYER 6. Right of Entrv - BUYER shall have right of entry to the herein described real property for the sole purpose of removal and relocation of said building. Said right of entry shall cease upon the removal of said building from the premises or sixty (60) days after the date of this agreement. 7. BUYER shall defend, indemnify and hold harmless the CITY against all claims, demands, suits, judgements, expenses and costs on account of injury or death of persons or loss or damage of property arising out of the removal and transportation of said building.
