OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH NEW HOPE MISSIONARY BAPTIST CHURCH RELATING TO TRAINING RELATED WORK EXPERIENCE FOR STUDENTS. This Resolution will authorize the Director of Parks, Recreation and Community Services Department to enter into an Agreement with New Hope Missionary Baptist Church to provide job training work sites at no cost to the City. The proposed Agreement covered in this Resolution provides training related work experience sites for New Hope students at City recreation facilities. The Agreement gives full authority to the City of San Bernardino to supervise New Hope students at selected City job sites of the Recreation Department. A maximum of twenty (20) hours per week for up to a seven (7) week period will serve as the students' training period with the City. The Work Experience Program is unique because it offers free labor of potential employees in exchange for on-the-job training for up to a seven (7) week period. The Parks, Recreation and Community Services Department has had a partnership with New Hope since 1995 in providing work experience sites at senior nutrition kitchens, park sites, recreation centers and to support clerical staff located at its facilities. 6/18/97 amt lICWOOpeStJItus e e e COOPERATIVE WORKSITE AGREEMENT BETWEEN NEW HOPE MISSIONARY CHURCH AND CITY OF SAN BERNARDINO PARKS, RECREATION & COMMUNITY SERVICES I. PARTIES INVOLVED This Agreement is between the City of San Bernardino Parks, Recreation and Community Services Department and New Hope Missionary Baptist Church. It is agreed and understood by both parties that the City of San Bernardino Parks, Recreation and Community Services Department will provide work sites for the participants of the New Hope Missionary Baptist Church Summer Youth Program. The Parks, Recreation and Community Services Department has been authorized to receive up to 25 participants. The number of participants and work period will be determined by agreement of the Parks, Recreation and Community Services Department and the New Hope Missionary Baptist Church. n.FURTHER AGREED That the Parks, Recreation and Community Services Department will provide useful, work site training experiences consistent with the participants' capabilities. The Parks, Recreation and Community Services Department will provide supervision and direction to the participating youth. There shall be no reimbursement or compensation on the part of the Parks, Recreation and Community Services Department, either in wages or benefits of any kind. Workers Compensation payments shall be the responsibility of the New Hope Missionary Baptist Church. The City shall not assume any administrative cost of program sponsorship except those incurred by itself in providing for planning, monitoring or supervision. m.PROGRAM COMPONENTS Accurate time and attendance records will be kept in conjunction with the supervising staff provided by the New Hope Missionary Baptist Church. The work areas for each participant will be selected by the Park, Recreation and Community Services Department upon the contingent agreement of the New Hope Missionary Baptist Church. Hours worked by participants will not exceed 20 hours per week. Should a New Hope Missionary Baptist Church student participant display inappropriate behavior or fail to perform in a satisfactory manner, the site supervisor or manager may excuse the participants from the program. e e e New Hope Missionary Baptist Church agrees to be responsible for the [mancial reimbursement of the participants on a bi-monthly basis including processing of time sheets and paychecks. New Hope Missionary Baptist Church agrees to respond as needed to emergencies or site meetings as requested by the Parks, Recreation and Community Services Department. IV.HOLD HARMLESS New Hope Missionary Baptist Church shall defend, indemnify and hold City, its officers, agents and employees harmless from and against any and all liability, loss, expense (including reasonable attorney fees) or claims for injury or damages arising out of the performance of this agreement but only in proportion to and to the extent such liability, loss, expense, attorney's fees or claims for injury or damages were caused by or resulted from the negligence or intentional acts or omissions of New Hope Missionary Baptist Church, its officials, agents or employees. City shall defend, indemnify and hold New Hope Missionary Baptist Church and its officers, agents and employees harmless from and against any and all liability , loss, expense (including reasonable attorney fees) or claims for injury or damages arising out of the performance of this agreement but only in proportion to and to the extent such liability, loss, expense, attorney's fees or claims for injury or damages caused by or resulted from the negligence or intentional acts or omissions of City, its officers, agents or employees. V. TERMINATION CONDITIONS Whenever it shall be necessary for either party to give notice to the other, such notices shall be sent to the Director of Parks, Recreation and Community Services Department at the following address: 547 North Sierra Way, San Bernardino, CA 92410, and such notices shall be deemed to be completed five (5) days after. This agreement may be terminated at any time by giving either party fifteen (15) days written notice of such action in accordance with the agreement. - 2 - e e e VI.IN WITNESS WHEREOF, the said parties hereunto set their hands and seal this day and year.
