Clark, City Clerk Operator's Permit Fee (San Bernardino Municipal Code Section 5.82.040) James F. Penman, City Attorney; Fred Wilson, Acting City Administrator; Barbara Pachon, Director of Finance; Lee Gagnon, Business Registration Supervisor BACKGROUND INFORMATION: At the meeting of the Mayor and City Council held on June 16, 1997 I presented an agenda item (#18) outlining those taxes which have been increased between January I, 1995 and November 6, 1996 and which under the provisions of Proposition 218 must be submitted to the voters for their approval. Our recommendation was that rather than place two increased business registration fees on the November ballot, that instead we roll back those fees to rates which were in place prior to July 1996 and the Council approved that motion. Included in our recommendation was a motion directing the City Attorney's Office to repeal Municipal Code Section 5.82.040 which established an Operator's Permit Fee. The Operator's Permit Fee of $59.00 was newly established in July 1996. It is not considered a tax and therefore there is no need to submit it to the voters for approval nor is there a need to repeal the fee. Attached is a copy of the staff report presented on July I, 1996 relating to the establishment of a fee upon filing an Operator's Permit. Since the fee was approved, we have realized slightly over $5,000 in revenue. CUrrently, there is no fee charged for the investigation process which initiates in the City Clerk's Office and is then forwarded to the Police Department. A non-refundable investigation fee is required for other types of applications such as for Bingo Investigation, Dine and Dance/Live Entertainment and Games of Amusement. During calendar year 1995, the City Clerk's Office logged and processed 163 Operator Permits requiring a Police Department investigation. During the first six months of 1996, we have already processed 107 applications. In response to the City Council's request for revenue enhancement ideas, this department proposed an Operator's Permit fee to incorporate the costs experienced by both the City Clerk's Office and the Police Department. This proposed recommendation was approved by the Mayor and Council during their recent budget deliberations. A cost analysis has been done of the City Clerk's and Police Department's costs in processing Operator's Permit applications and the combined costs come to $59.48; we are therefore recommending 'that the Mayor and Common Council approve the proposed fee of $59.00 for all Operator Permit applications. RECOMMENDATION That said ordinance be laid over for final adoption.
