The assessments were to run for a period of 10 years. Revenues for the construction of the fire station were derived from the sale of Certificates of Participation. The COP's were paid off by the City several years ago, but the assessments, which went to reimburse the City, were to be collected through the 1998-99 Tax Year. Proposition 218, which was approved by the voters last November, requires the continuance of assessments in any existing assessment district to be subject to approval of a majority of the property owners within the district. However, certain types of assessment districts are exempt from Proposition 218' s requirements. After reviewing Assessment District No. 971, it was determined that the district is not exempt, and therefore would require approval by property owners. It is unlikely that approval would be obtained since the fire station has already been built and the assessments were just to reimburse the City. On May 19, 1997, authorization was given to terminate the assessment district. The attached resolution formalizes this action. We recommend termination of Assessment District No. 971.
