The majority of these are landscape maintenance assessments districts that were formed as a result of a petition from the developers of various tracts. The assessment districts provide a means of funding the maintenance of landscaping that was installed throughout these developments, as a condition of approval. The annual assessments include the contract costs for maintenance, water and energy, inspection and administration. The landscape maintenance districts are AD 951 (Zones I and 2), 952 (Zones 1,2, 2A, and 3), 953, 956,959,968,974,975,976,981,982,986,989,991,993, 997,1001,1002,1005,1007,1016, 1017 and 1019. The 1997/98 Assessment Roll for AD 1019 was previously approved on November 5,1996 and is not a part of this action and is only referenced for information. There are also 3 Assessment Districts for the maintenance of a sewer lift station. These districts are AD 962,963 and 989 (which also includes landscape maintenance). Since all of these districts are for maintenance, the assessments are collected in perpetuity. Additionally, there are presently 3 assessment districts that were formed for construction. These districts are AD 973 and 1004, which are for traffic signal construction, and Chapter 12.92 1993-01, which was for street widening improvements. AD 973 will terminate in 1999, AD 1004 will terminate in 2002 and the Chapter 12.92 1993-0 I district will terminate after this year's assessment. With the passage of Proposition 218 in November of 1996, new procedures and requirements became necessary not only for the formation of assessments districts but also for the annual levies. However, certain types of districts are "exempt" from the procedural requirements of Proposition 218. The exemptions can be based on, but not limited to, a district being formed by 100% approval of the property owners at the time the district was formed. This is the case with a large portion of the districts since these were formed when they were still under one ownership. Exemptions are also allowed for districts that were formed for construction or maintenance of streets and street improvements, including traffic signals and landscaping within the street right of way. Assessments for districts that are found to be exempt do not need to go through the property owner ballot approval process that is now required by Proposition 218, unless there is an increase in the assessment amount. Even in the case of an increase, if the methodology or the rate of assessment remains the same, the exemption may still apply. After careful review of the various districts with the City Attorney's staff, the Assessment Districts being submitted for approval have been found to be exempt, for one or more of the reasons stated above, with the exception of two assessment districts: The first one is the Downtown Parking District (AD 947) and the second is the Vanderbilt Fire Station Construction District (AD 971). The Fire Station was financed through the issuance of COP's (Certificates of Participation ). The COP's have been paid offby the City and the assessments were to reimburse the City's up-front costs. There were two years remaining on the assessments for a total amount of approximately $292,000. Neither of these districts are being submitted for assessments since the City Attorney's office has determined that we could not legally continue these assessments without following the provisions of Proposition 218. The attached summary lists the various districts being submitted, the present and prior year's assessment amounts and the reasons for the exemptions.
