Clark, City Clerk TO: DATE: April 22, 1997 RE: RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO REQUESTING THAT THE CITY OF SAN BERNARDINO'S MUNICIPAL ELECTION BE CONSOLIDATED WITH THE NOVEMBER 4, 1997, UNIFORM DISTRICT ELECTION LAW (UDEL) ELECTION CONDUCTED BY THE COUNTY OF SAN BERNARDINO BACKGROUND INFORMATION: On June 2, 1992, the voters of the City of San Bernardino voted to amend City Charter Section 10 to change the dates of the City's primary election from March of odd-numbered years to November of odd-numbered years and the general election dates from May to the following February. The primary reason advanced for the change was the fact that by changing our election dates we would be in a position to request a consolidation with the County's UDEL election and thereby save considerable funds by not having to conduct a stand-alone election. Although a resolution requesting consolidation must be filed at least 88 days prior to the date of the election, I believe it's best to submit this resolution as soon as possible so that we can proceed with planning for the November election. If at a later date the Mayor and Council decide to have charter amendments placed on the November ballot, we can submit another resolution to address those issues. Nomination papers will be issued by the City Clerk's Office; however, the County Registrar of Voters Office will designate polling places, issue absentee ballots, conduct the election, tally votes and conduct the canvass. City Offices up for election in November are: Mayor and Council seats in the First, Second, and Fourth Wards. The nomination period opens Monday, July 14, 1997, and closes Friday, August 8, 1997; however, Election Code Section 10225 requires that if an incumbent officer does not file nomination papers by the 88th day prior to an election, then the nomination period for that office is extended to the 83rd day before the election. 2 75-0264 since the incumbent Mayor has indicated he will not run for another term, the nomination period in that race will close on Wednesday, August 13, 1997. Likewise, if incumbent Council officers up for election do not file nomination papers by August 8, then the nomination period will be extended to Wednesday, August 13, 1997, in the wards where applicable. Recommend adopting form motion. R~l::' ~ City Clerk ? 3
