DBA: Glen Helen Blockbuster Pavilion, will be offering concerts for the 1997 season, with an average crowd expectancy in excess of 15,000 per concert. The primary entry point to Blockbuster parking will be Institution and Powerline Roads, where concert traffic will flow off the north bound 1-215 freeway at Palm and continue west bound to entry point. Traffic will be passing through two (2) intersections and one (1) railroad crossing; all of which are located in the City of San Bernardino. To facilitate a safe and expedient route of travel, San Bernardino Police Department personnel will be deployed, in an off-duty capacity, to minimize congestion. The City will be reimbursed for all services and equipment through a contract with Pavilion Partners, Inc. 75-0264 . . . 1 AGREEMENT FOR SERVICES 2 (Glen Helen Blockbuster Pavilion) 3 THIS AGREEMENT, made and entered into this 15th day of ~ April, 1997, by and between the City of San Bernardino, acting 5 by and through the San Bernardino Police Department, 6 hereinafter called "CITY" and Pavilion Partners DBA Glen Helen 7 Blockbuster Pavilion, hereinafter called "PARTNERS". 8 WITNESSETH: By and in consideration of the covenants and 9 the conditions herein contained, the PARTNERS and CITY do 10 hereby agree as follows: 11 1. CITY agrees to provide one (1) police officer and 12 either three (3) or four (4) Community Service Representatives 13 (c.S.R.sl* with vehicles for traffic control during various 14 events occurring at the Glen Helen Blockbuster Pavilion. 15 Traffic control services will be needed at the following 16 locations: 17 18 19 20 21 22 23 24 25 26 27 28 a. 1-215 Northbound off ramp at Palm b. Palm and Kendall c. Palmi Institution and Cajon Boulevard d. Institution and Powerline Road 2. The S.B.P.D. coordinator shall be Sgt. Don Soderbloom, Administrative Sergeant for Area B, telephone number (909 l 384 -5786. The PARTNERS coordinator shall be Mr. Nick Kotos, telephone number (909) 880-6500. In consideration for the above services and upon receipt of an itemized invoice, PARTNERS agrees to pay City in accordance with the following rates: Patrol Officer 37.79 per hour CSR II 23.13 per hour CSR I 21.48 per hour VehiclelEquipment Usage $ 79.68 ($ 99.60*) per event *Events with expected attendance in excess of 15,000 will require one (1) additional CSR. 5. This agreement may be amended by written mutual consent of both parties hereto. 6. In event of disaster or unforeseen emergency, CITY . shall be excused from providing scheduled traffic control services without prior notice. Either party may cancel this agreement by giving thirty day notice to the other. 7. The rates indicated in this agreement are for estimate purposes only. In the event of a wage increase, PARTNERS agrees to pay the increased rates. 8. PARTNERS agrees that reasonable additional charges may be assessed for S.B.P.D. supplies expended (flares), additional equipment utilized, damage to uniforms or property repaired or replaced at City expense, etc., which are directly related to the services referenced herein. PARTNERS agrees that any cancellation of this request for service later than 4:00 p.m. on the day preceding the requested service may result in a charge of four (4) hours for each officer assigned. 10. No additional gifts, donations, or gratuities may be accepted by S.B.P.D. personnel in their behalfs or in the behalfs of the Department. 11. PARTNERS shall indemnify, defend and hold CITY, its officers, employees and agents, free and harmless from any claim, demand, liability, suit, judgment or expense (including, without limitation, reasonable costs of defense) arising out of or related to CITY's performance of services under this agreement, except that such duty to indemnify, defend and hold harmless shall not apply where injury to person or property is caused by CITY's willful misconduct or sole negligence.
