STAFF REPORT
In August of 1996, Requests for Proposals were sent to
several firms concerning providing survey and preliminary route
selection for State Street, between Rancho Avenue and 16th
Street. In October of 1996, after the selection process was
completed, a short forn agreement for professional services was
signed by the City Administrator. This original contract was for
$16,770.00.
It will be necessary to obtain title reports for the
properties from which right-of-way will be acquired. The
Consultant contacted two title companies. and received written
cost proposals. The Consultant will obtain the title reports and
the City will reimburse for the actual cost incurred. Addition-
ally, the Consultant performed some minor additional services in
coordination with obtaining the title reports.
In order to authorize payment for the required title
reports, it will be necessary to amend the agreement. Amendment
No. 1 authorizes payment of the costs associated with the title
reports and a not-to-exceed figure to the Consultant. However,
the amended agreement will have a maximum compensation of
$27,670.00.
All costs for these additional services will be charged
to the $250,000 allocated under Account No. 129-367-5504-7059.
We recommend that Anendnent No. One be approved.

FIRST AMENDMENT TO AGREEMENT
FOR PROFESSIONAL SERVICES
This Amendment to Agreement is made and entered into this
day of , 1997, by and between the City of San
Bernardino, California, a municipal corporation, hereinafter
referred to as "CITY", and R.J. Mullins & Associates, Inc., a
California corporation, hereinafter referred to as "ENGINEER".
WITNESSETH:
WHEREAS, City and Engineer entered into an Agreement on
October 11, 1996, relative to providing professional design
services for development of a Preliminary Alignment for State
Street; and
WHEREAS, the City desires to incorporate title search
and reports into the preliminary alignment study; and
WHEREAS, The Engineer is best qualified and able to
coordinate and solicit proposals for the title work and incorporate
same into mapping; and
WHEREAS, The Engineer has adequate professional
engineering staff to provide the desired additional services; and
WHEREAS, The Engineer will coordinate the work and pass
the costs of title reports on to the City without any additional
mark-up.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
1. The Agreement between city and Engineer, dated
October 11, 1996, relative to providing professional services in
connection with the preliminary alignment of State Street, is
hereby amended as follows:
a. Section 1, "Scope of Services," is expanded to
included the required additional work to coordinate, solicit
proposals and pay for title reports from the City selected title
company, along the selected alignment.
b. Section 5, "COMPENSATION," is amended to increase the
reimbursement to the Engineer from $16,770.00 to a not to exceed
figure of $27,670.00. The estimated cost of title reports is
$8,400.00 and additional services from consultant shall not exceed
$2,500.00.

2. Compensation for the services shall be paid in
accordance with the agreement with a total cost not to exceed
$27,670.00 plus costs for ordered title reports.
IN WITNESS WHEREOF, the parties hereto have caused this
First Amendment to Agreement to be executed on the date written
above by their duly authorized officers on their behalf.
