STAFF REPORT In 1993, Police and Fire Management employees petitioned to form a bargaining unit separate from the San Bernardino Confidential and Management Association (SBCMA). The petition was turned down by the Mayor and Common Council. In January 1995, Legal Opinion No. 95-01, "Establishment of a Separate Bargaining Unit for Police and Fire Management," concluded in part: "However, if the police management employees request the establishment of a bargaining unit made up only of peace officers, the Council has no discretion and must grant the request . . . " In October 1996, Police Safety management employees submitted a petition for recognition to form a bargaining unit separate from their current unit, the San Bernardino Confidential and Management Association. Based on data obtained from cities surveyed by Ralph Andersen & Associates in the 1996-97 management/confidential compensation study, the City of San Bernardino's benefits practices for Police Safety management employees are not consistent with the survey cities in certain benefits. Police Safety management employees will remain as members of San Bernardino Confidential and Management Association, and will not be forming a separate bargaining unit at this time. It is recommended that effective as of July 1, 1997, concurrent with Council approval of the Fiscal Year 1997-98 budget, the following benefits be effective for Police Safety Management employees: * Retirement--increase City contribution of employees' share from 7% to 9% Uniform Allowance--provide $500 once each fiscal year, similar to the Police Officers' Association, during the first pay period in March. One- time only, a uniform allowance will also be provided concurrent with Council approval of the Fiscal Year 1997-98 budget. POST Reimbursement--add monthly payment of POST, similar to POA, based on the employee's POST certificate level. * * Cost is approximately $82,385 for year one. This is because the uniform allowance would be provided twice the first year only, concurrent with Council approval of the FY 1997-98 budget, and during the first pay period in March 1998. Thereafter, the uniform allowance would be provided once each fiscal year, for a cost of $73,585/year for the package. RECOMMENDATION Adopt resolution. .' POST Reimbursement, for Police Safety Management employees, effective as ofJuly 1, 1997, concurrent with Council approval of the Fiscal Year 1997-98 City budget. 1- . e e e cg(Q)~W SIDE LEITER TO RESOLUTION NO. 89-129 FOR POLICE SAFETY MANAGEMENT EMPLOYEES This exhibit sets forth the Side Letter to Resolution No. 89-129, for full-time, regular, active Police Safety Management employees. H. fW. Add: Police Safety Management members will receive 9% City payment of the 9% contribution to PERS. V. Uniform Allowance (new section) Once each fiscal year, each Police Safety Management member shall receive an annual uniform allowance of $500 to be paid in a lump sum amount during the first pay period of March. New employees must wait until the first pay period of March to receive their annual uniform allowance. Note: One-time only, a uniform allowance of $500 will also be provided concurrent with the adoption of the Fiscal-Year 1997-98 budget to Police Safety Management members who are actively employed in the Police Department as of July 1, 1997. POST Reimbursement (new section) All Police Safety Management members shall be entitled to receive, in addition to their regular salary and as may be appropriate, one of the levels of incentive payment as outlined below: 1. One hundred dollars ($100) additional compensation per month shall be paid each member who has obtained a POST Intermediate Certificate; or, 2. One hundred fifty dollars ($150) additional compensation per month shall be paid each member who has obtained a POST Advanced Certificate; or, 3. One hundred seventy-five dollars ($175) additional compensation per month shall be paid each member who has obtained a POST Supervisory Certificate; or, 4. Two hundred dollars ($200) additional compensation per month shall be paid each member who has obtained a POST Management Certificate. EXHIBIT A e e e .
