Contract Change Order No. 1 approved, at an increase in
contract price of $11,375.00.
Contract Change Order No. 3 approved, at an increase in
the contract price of $42,496.00.
Resolution No. 96-327 adopted authorizing execution of

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Authorization was granted at the Council meeting of 11-
20-95 to execute a Standard Agreement with California State
University, San Bernardino, relative to installation of traffic
signals at Northpark Boulevard and Coyote Drive.
This Agreement provides, in general, that the City would
proceed to install the traffic signals, and the University would
pay 1/2 of the cost, plus $2,000 as their share of the first year
maintenance and operation costs. In addition, the University
will finance the cost of the necessary street improvements to
accommodate these signals.
Amendment No. Two will authorize payment to the City of
$67,700.54 as reimbursement of costs incurred for the street
improvements necessitated by installation of the traffic signals.

8. All contracts in excess of S 1 0.000.00 will be sU::lject to the examination and audit of the Auditor General

9. By signing of this contract, the Contractor dOES swear under penalty 01 perjury that no more than one
linal unappealable firlding 01 contempt of court by a Federal Court has been issued against Contractor
within the immediately preceding two-year I>!rlod because 01 Contractor's failure to comply with an
order 01 a Federal Court which orders ContractNto comply with an order of the .National Labor Relations
Board.
10. Contractor's performance will be evaluated ty the University upon completion of the project and a
Contract/Contractor Evaluation. Std. Form 4, will be prepdled and retained on file for any contract in
excess 01 S 1 0.000.00.
11. In addition to the right of the State to terminat'~ lor cause as provided under the terms of paragraph #3
of Standard Agreement Form 2, either party ma( terminate the agreement without cause with thirty (30)
day's written notice.

Contractor agrees that the awarding departmen- or its delegatee will have the right to review, obtain and
copy all records pertaining to performance 01 -he contract. Contractor agrees to provide the awarding
department or its delegatees access to its premis!!S. upon reasonable notice, during nonnal business hours
lor the purpose 01 interviewing employees and inspecting and copying such books, records, accounts
and other material that may be relevant to a IT atter under investigation for the purpose of determining
compliance with Public Contract Code Section 10115 et.seq. Contractor further agrees to maintain such
records for a period of three (3) years after findl payment under this contract.
