Description) Finance: Council Notes: ~~ "ZCQ3-3~ Agenda Item No. J 141S}03 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Resolution determining fair market value for a portion of real property located northeasterly of Cajon Boulevard at University Parkway relative to the proposed construction of a grade separation. BACKGROUND: In 2002, the City applied for and received State funding to design and construct a grade separation at State StreetlUniversity Parkway over the Burlington Northern Santa Fe railroad tracts at Cajon Boulevard. The project is being funded 100% through the State Transportation Congestion Relief Program (TCRP). San Bernardino Associated Governments of San Bernardino County (SANBAG) was requested by the City of San Bernardino and the County of San Bernardino to be the implementing agency for this project. SANBAG is utilizing the County of San Bernardino Real Estate Services (County Real Estate) for the appraisal and acquisition of property for this project. Several alignments of the separation were prepared by SANBAG through a consultant, including an over-crossing and an under-crossing along the east side and the west side of University Parkway. Several workshops were held to review the various alternatives and consideration was given to several factors including aesthetics and cost and an over-crossing along the east side of University Parkway was recommended by staff and approved at the Council meeting of June 17, 2002. Design for the project has been completed by SANBAG and the properties affected by the improvements to be constructed were identified. The property was appraised by the Real Estate Division of the County of San Bernardino on June, 25, 2003 and an addendum submitted on September 12, 2003. The County determined the fair market value of the property to be $397,000. In order for SANBAG to complete negotiations and acquisition of the needed parcels, they must have approval from the City relative to the determination of fair market value. Staff has reviewed the appraisal and concurs with the report. Upon successful negotiations, the necessary easement will be acquired by SANBAG on behalf of the City. A resolution accepting the fair market value determined by the County is attached for your action. FINANCIAL IMP ACT: None. The project is being funded 100% through the State Transportation Congestion Relief Program (TCRP). RECOMMENDATION: Adopt Resolution IF f'-) ~. WHEREAS, the fair market value of said property to be acquired is set forth in the 7 8 amount of Three Hundred Ninety-seven Thousand Dollars ($397,000) in said appraisal; and 9 10 11 WHEREAS, City staff have reviewed the appraiser's determination of the fair market value of the land and his report thereon and concur with said determination; and WHEREAS, full description of the property to be acquired is set forth within said 12 13 appraisal report. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That said parcel of real property to be acquired as described herein, is hereby determined to have a fair market value of Three Hundred Ninety-seven Thousand Dollars ($397,000) as determined by said appraiser.
