Synopsis of Previous Council Action:
November 3, 2003 - Mayor and Common Council approved Resolution 2003-296 to apply for
grant funds under the provisions of the 2002 Resources Bond Act (Proposition 40) for two
programs: the Roberti-Z'berg-Harris Urban Open Space and Recreation Program and the Per
Capita Grant Program.
Recommended motion:
Adopt Resolution.

Staff Report
Subiect:
A Resolution of the City of San Bernardino authorizing the Mayor of the City of San Bernardino
or her designee to apply for grant funds under the provisions of the 2002 Resources Bond Act
(Proposition 40) for the Roberti-Z'berg-Harris Urban Open Space and Recreation Program, and
repealing Resolution No. 2003-296.
Backl!round:
On November 3, 2003 the Mayor and Common Council adopted Resolution No. 2003-296,
which permitted the City to apply for grant funds under the provisions of the 2002 Resources Act
(Proposition 40) for the Roberti-Z'berg-Harris Urban Open Space and Recreation Program.
However, at the time this resolution was adopted, the state had not posted the requirements for
the program. The new requirements no longer require city matching funds. Therefore, the State
has requested that we submit a new resolution for the Roberti-Z'berg-Harris Block Grant
Program to reflect this change.
Upon receipt of the contract the City will then be authorized to prepare applications for various
projects for enhancement of our parks and recreation facilities under RBZ. Projects to be funded
the RBZ were approved in the 2003-04 CIP.

A RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
MAYOR OF THE CITY OF SAN BERNARDINO OR HER DESIGNEE TO APPLY FOR
GRANT FUNDS UNDER THE PROVISIONS OF THE 2002 RESOURCES BOND ACT
(PROPOSITION 40) FOR THE ROBERTI-Z'BERG-HARRIS URBAN OPEN SPACE AND
RECREATION PROGRAM, AND REPEALING RESOLUTION NO. 2003-296.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
WHEREAS, the people of the State of California have enacted the CALIFORNIA CLEAN
WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS AND COASTAL PROTECTION ACT
OF 2002 which provides funds for the Roberti-Z'Berg-Harris Block Grant Program for grants to
eligible Applicants, and

WHEREAS, the California Department of Parks and Recreation has been delegated the
responsibility for the administration of the program within the State, setting up necessary procedures,
and

WHEREAS, said procedures established by the California Department of Parks and
Recreation require the City of San Bernardino's Governing Body to certify by resolution the approval
of the Applicant to apply for the Roberti-Z'Berg-Harris allocation; and
WHEREAS, the City of San Bernardino will enter into a Contract with the State of
California for the Project;

NOW, THEREFORE, BE IT RESOLVED that the City of San Bernardino hereby:
1. Approves the filing of an Application for local assistance funds from the Roberti-Z'Berg-
Harris Block Grant Program under the California Clean Water, Clean Air, Safe Neighborhood Parks
and Coastal Protection Act 01'2002; and

") Certifies that the City of San Bernardino has or will have sufficient funds to operate and
19 maintain the Project(s); and
20 3. Certifies that the City of San Bernardino has reviewed, understands, and agrees to the
General Provisions contained in the Contract shown in the Procedural Guide; and

4. Certifies that the Project conforms to the recreation element of any applicable city or county
general plan; and

5. Appoints the City of San Bernardino Parks, Recreation and Community Services
Department's Director as agent to conduct all negotiations, execute and submit all documents
including, but not limited to, applications, payment requests, and other documents, which may be
necessary for the completion of the Project.
BE IT FURTHER RESOLVED, that Resolution No. 2003-296 is hereby repealed.
