(Central City North RedeveloDment Proiect Area) BACKGROUND/CURRENT ISSUE: On January 7, 2002, the Community Development Commission approved the HOME Grant Agreement with TELACU I Housing-San Bernardino, Inc., for the development of the 75-unit Senior Housing Project located at the northwest comer of 6th and F Street. TELACU broke ground on the project in September 2002 (see Exhibit "A"). The project is almost 85% complete. During the construction phase, it was determined that the sidewalk surrounding the project (6th Street to "F" Street) should be replaced instead of repaired as was originally planned due to deteriorated and unsafe conditions. The sidewalk replacement and the installation of the decorative parkway and landscaping improvements are proposed to showcase a unified theme and intended to set the stage for all other new developments pending in the "Old Towne" neighborhood to conform to similar parkway enhancements. The proposed decorative parkway enhancements are similar to the ones being installed at one of the entryways of the NIP! Target Area (see Exhibit "B" attached, Sample of NIP I Parkway on Sierra Way). It is estimated that the replacement sidewalk improvements and enhancements will not exceed $75,000. Staff recommends an amendment to the current HOME Grant Agreement to increase the present grant amount of $300,000 by $75,000. ENVIRONMENT AL IMPACT: This Project was previously environmentally assessed and approved by the Planning Commission as part ofthe CUP planning process. FISCAL IMPACT: The $75,000 grant obligation will be funded from the HOME Grant Program, 2003-2004 budget. RECOMMENDATION: That the Community Development Commission adopt the attached Resolution. The Commission hereby approves Amendment No. I to the Agreement 5 attached hereto and incorporated herein by reference. Section 2. The Executive Director is hereby authorized to appropriate the sum of 6 7 $75,000 from the federal HOME Grant Program, fiscal year 2003-2004, for the Off-Site Improvements and to execute the Amendment No. I to the HOME Grant Agreement on behalf of the Agency in the form attached hereto, together with such nonsubstantive changes therein as may be approved by the Executive Director and the Agency Counsel. 8 9 10 Section 3. THIS AMENDMENT NO. I to the HOME Grant Agreement dated January 7, 2002 ("Agreement") referred to as "Amendment," is made and entered into this 3rd day of November, 2003 by and between the Redevelopment Agency of the City of San Bernardino, a public body, corporate and politic, referred to as "Agency," and TELACU I Housing-San Bernardino, Inc., a California nonprofit corporation, referred to as "Developer." Agency and Developer agree as follows: RECITALS WHEREAS, Agency and Developer have previously entered into the Agreement dated January 7, 2002 referred to as "Agreement," for the purpose of developing a 75-unit Senior Affordable Rental Housing Complex located at 602-666 West 6th Street (the "Project"); and WHEREAS, Agency and Developer desire to amend the Agreement to increase the Project financing and Agency Grant to accommodate unanticipated off-site improvement costs (such as: sidewalk, curb, gutter replacement or other relate off-site improvements and parkway enhancements and treatments, as approved by the City of San Bernardino) ("Off-Site Improvements") and said Off-Site Improvements are necessary and desirable for the completion ofthe Project as provided herein. NOW, THEREFORE, in consideration of the mutual covenants herein set forth and the mutual benefits to be derived therefrom, the parties agree to modify the Agreement in the following two areas only: 1. B. [ss404] Agency Grant 2. [ ss406] Amount of Agency Grant The Agency Grant shall not exceed the lesser of the difference between the Improvement costs and the HUD Section 202 Capital Advance, or not more than $375,000. Any unexpended Agency Grant funds shall be returned to the Agency within 60 days following the completion of the Project and the issuance of the Certificate of Occupancy. All other terms of the HOME Grant Agreement shall remain in full force and effect.
