Recommended Motion(s): (Communiiv Development Commission) MOTION: THAT THE COMMUNITY DEVELOPMENT COMMISSION AUTHORIZE THE REDEVELOPMENT AGENCY TO TRANSFER TITLE TO THE PROPERTY LOCATED AT 247 WEST THIRD STREET ("PROPERTY") IN THE CITY OF SAN BERNARDINO TO THE COUNTY OF SAN BERNARDINO WITH THE FOLLOWING PROVISIONS: (I) THAT THE ULTIMATE USE OF THE PROPERTY BY THE COUNTY BE FOR THE CONSTRUCTION OF A NEW MULTIPLEX CENTRAL COURTHOUSE ONLY, (2) THAT IN THE INTERIM, THE COUNTY MAY USE SUCH PROPERTY FOR TEMPORARY PARKING, AND (3) THAT IN THE EVENT THE COUNTY FAILS TO INITIATE DEVELOPMENT OF THE NEW COURTHOUSE ON THE PROPERTY BY JANUARY 1,2014, THE PROPERTY WILL REVERT BACK TO AGENCY OWNERSHIP. APN 1986-01-03. to the County of San Bernardino to Accommodate Future Courthouse Expansion BACKGROUND: On January 4, 1996 the Agency and the State of California entered into a Construction Project Management Agreement for development of the Caltrans office building and parking structure on property owned by the Agency in downtown San Bernardino (the "Super Block"). Pursuant to the Agreement, the State was not required to pay for the property at time of construction, but instead was obligated to pay the Agency a total of $6,516,856 for the property at some undetermined later date. On or about May 3, 2000, the Agency entered into an Agreement for Purchase and Sale with Caltrans whereby the Agency agreed to buy the Caltrans property at 247 West Third Street ("Property") for $2,700,000 and, in lieu of making payment, credit Caltrans a like amount toward the outstanding purchase price balance on the Super Block properties. On December 3, 2001, the City Council adopted Resolution 2001-367 urging the County Board of Supervisors to commence the process for constructing a new multiplex courthouse and, in so doing, indicated its intent to have the Agency acquire the Property and to donate the Property to the County for courthouse purposes. CURRENT ISSUE: Caltrans has transferred title to the Property to the Agency. Given the City Council direction, it is appropriate for the Commission to officially authorize the Agency to transfer title to the Property to the County based on the three (3) conditions noted in the above motion. It is proposed that the Property be used in part to accommodate the parking needs of the 303 W. 3'd Street building. In order for the 303 LLC to receive approval of a DP-I enabling them to proceed with the rehabilitation of the 303 building and ultimate sale to the County, they must evidence adequate parking. Furthermore, in order for the County to ultimately own and occupy the 303 W. 3rd Street property, they must meet the City's parking requirements. The transfer of the Property to the County will enable them to use the Property for parking, and thus, meet the City's parking requirements. ENVIRONMENTAL IMPACT: None. FISCAL IMPACT: The Property donation to the County will require the Agency to write-off a $2.7 million asset.
