CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolutions of the City of San Bernardino authorizing the Mayor of the City of San Bernardino or her designee to apply for grant funds under the provisions of the 2002 Resources Bond Act (Proposition 40) for two programs: the Roberti-l'berg-Harris Urban Open Space and Recreation Program and the Per Capita Grant Program. Back2round: The City has received notification of allocations under subject Bond Act. The City is allocated $513,951 in the Roberti-l'berg Harris Program and $835,000 in the Per Capita Program. To submit the application for the funding, the State requires that two separate resolutions be adopted by the City, one for each program. Once the Mayor and Common Council adopt these two resolutions applying for the grant funding, the City will then receive a contract from the State. Upon receipt of the contract the City will then be authorized to prepare applications for various projects for enhancement of our parks and recreation facilities. Projects to be funded under Prop 40 have been approved in the 2003-04 CIP. Financial Impact: These two programs do not require City matching funds. Recommendation: Adopt Resolutions. ~, RESOLUTIJCD rP1[ 1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE MAYOR OF THE CITY OF SAN BERNARDINO OR HER DESIGNEE TO APPLY 3 FOR GRANT FUNDS FOR THE ROBERTI-Z'BERG-HARRIS URBAN OPEN SPACE AND RECREATION PROGRAM UNDER THE PROVISIONS OF THE 2002 4 RESOURCES BOND ACT (pROPOSITION 40). 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 6 OF SAN BERNARDINO AS FOLLOWS: 7 8 9 10 11 12 13 14 15 16 17 18 19 20 WHEREAS, the people of the State of California have enacted the 2002 Resources Bond Act which provides funds for the Roberti-Z'berg-Harris Open Space and Recreation Program; and WHEREAS, the Legislature of the State of California has enacted the Roberti-Z'berg- Harris Open Space and Recreation Program, which provides funds to certain political subdivisions of the State of California for acquiring lands and for developing facilities to meet urban recreational needs; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the grant program, setting up necessary procedures; and WHEREAS, said procedures established by the California Department of Parks, and Recreation require the Applicant's Governing Body to certify by resolution the approval of the City to apply for the Roberti-Z'berg-Harris Program allocation; NOW, THEREFORE, BE IT RESOLVED that the City of San Bernardino I. Approves the filing for local assistance funds from the Roberti-Z'berg-Harris Urban Open Space and Recreation Program under the 2002 Resources Bond Act; and 21 2. Certifies that City of San Bernardino has or will have sufficient funds to operate and 22 23 3. 24 25 4. 26 27 28 maintain the Project(s); and Certifies that City of San Bernardino has reviewed, understands and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and Appoints the Director of Parks, Recreation and Community Services Department as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion ofproject(s).
