STAFF REPORT
SUBJECT
Ordinance adopting Section 15.16.400 of the City of San Bernardino Municipal Code,
designating the Building Official as an authorized representative of the Fire Chief to
enforce building standards adopted by the California State Fire Marshal, related to new
construction and alterations.
BACKGROUND
The City of San Bernardino Fire Department is responsible for maintaining fire safety
and building standards by enforcing the California State Fire Marshal regulations related
to maintenance of existing buildings and use. This requires knowledge of fire protection
and building code standards.
The new Ordinance Section 15.16.400 of the San Bernardino Municipal Code will ensure
that the Building Official will have the authority to enforce the codes adopted by the
California State Fire Marshal relating to fire and panic safety. The adoption of the
ordinance will designate the Building Official to act as an authorized representative of the
Fire Chief.
Pursuant to Section 13146, Health and Safety Code, the Chief of any city, and authorized
representatives shall have the responsibility for enforcement of building standards
adopted by the California State Fire Marshal. These standards are published in California
Code of Regulations, Title 24 which includes the part known as the California Building
Code, also referred to as the California Building Standards Code.

None.
RECOMMENDATION
That said ordinance be laid over for final adoption.

MARSHAL RELATED TO NEW CONSTRUCTION OR ALTERATIONS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:
Whereas, Section 13146 of the California Health and Safety Code requires the Fire Chief or an
authorized representative, to enforce building standards adopted by the California State Fire
Marshal;
Now Therefore:
Section 1. San Bernardino Municipal Code Section 15.16.400 is hereby added to read as
follows:
"15.16.400 Authorized Fire Chief Representative.
Pursuant to California Fire Code Section 101.2.2.2 and California Building Code Section
1 0 1.17.14 the Building Official is hereby authorized to act as an authorized representative
of the Fire Chiefto enforce building standards adopted by the California State Fire
Marshal related to new construction or alterations."
