Background: On August 7, 2006, the Mayor and Common Council allocated funds as part of the FY 2006/07 Capital Improvement Program (CIP) for Traffic Controls for the above locations. On August 21, 2006, the Mayor and Common Council awarded a contract to Oak Engineering, Inc. in the amount of $354,050.00 for Traffic Signal Improvements at 5th Street and "F" Street (TC04-16); 30th Street and `B" Street (TC04-17); Highland Avenue and "E" Street (TC04-21), per Project Plan No. 11176. On the southwest corner of Highland Avenue and "E" Street, a waterline was accidentally broken due to the contractor's boring equipment making contact with the waterline outside of the marked location. Due to technical problems, the San Bernardino Municipal Water Department (SBMWD) was unable to turn off the water for four hours. The continual flow of water caused significant roadway damage. The contractor is requesting compensation for delay incurred awaiting the water line repairs. The initial cost estimate of the repair was $50,000. Based on the contractor's time and material for the repairs, as well as negotiation with the contractor, the agreed cost of delay and roadway repair has been reduced to $24,679.90. SBMWD has agreed to reimburse the City the amount of $24,679.90 as its share of the cost of the delay and repairs. At 5th Street and "F" Street, an existing pedestrian pushbutton was identified for repair. However, due to previous damage and precise field measure, the pedestrian pushbutton had to be relocated to comply with new ADA regulations. At 30th Street and "'E" Street, the existing signal poles and foundations were found to need replacement due to previous base-plate damage. Also, elevations had to be adjusted to avoid underground utility conflicts with the new ADA ramps being installed. Change Order No. One, in the amount of$32,929.90, consists of the following changes: Item No. 1-1 Install temporary 1-A pole at Highland Avenue and"E" Street. Item No. 1-2 Delay due to waterline breakage and repair at Highland Avenue and `B" Street. Item No. 1-3 Repair asphalt roadway, curb & gutter and sidewalk at Highland Avenue and "E" Street damaged by water line break. Item No. 1-4 Relocate pedestrian pushbutton at 5th Street and"F" Street. Nos. 250-370-5504-7430, 7431 & 7432 for this project. This funding will be adequate to cover the cost of this change order and all other costs for this project as indicated in the attached spreadsheet. The estimated project costs are as follows: TOTAL Original Contract Amount $ 354,050.00 Contract change Order No. One $ 32,929.90 Revised Construction Cost $ 386,979.90 This change order represents an increase of 9.3% in the contract amount. The cost of construction engineering and inspection is estimated to be approximately $5,000, bringing a total cost of change order to be $37,900. The Water Department will reimburse the City $24,679.90, bringing a net cost of change order to $13,220.10. TOTAL COST CCO#11 $ 32,929.90 JUSTIFICATION: Install Temporary 1-A Pole At the southeast corner of Highland Ave & "E" Street, it was necessary to place the new Item traffic signal pole in the same location as the existing pole, because of conflict with No. 1-1 numerous utilities at the same intersection. It was necessary for the contractor to remove the existing pole and wire a temporary pole to support the mast arm and signal heads during removal of the existing foundation and construction of a new foundation for the permanent signal pole. Delay due to Water Line Repair During construction, a water main, which had been incorrectly marked, and was damaged by the contractor's conduit boring operations. The waterline began leaking and, due to Item technical problems, could not be shut down for 4 hours. During this period, the force of No. 1-2 the water caused the roadway, curb&gutter, and sidewalk to be undermined. This item is to compensate the contractor for delays incurred while waiting for the line to be shut down and repaired. The Water Department has agreed to reimburse the City $24,679.90 for its share of the cost of delay and repairs. Repair of Asphalt Roadway, Curb & Gutter, and Sidewalk Item 1-3 The waterline break described in Item No. 1-2 above caused significant damage to the No. roadway, curb & gutter, and sidewalk. This item is to compensate the contractor for repair of the damaged areas of the street, curb& gutter and sidewalk. Item Install a Pedestrian Push Button at 5th Street& "F" Street No. 1-4 It was necessary to relocate the pedestrian push button for compliance with ADA regulations. Installation of a new foundation with anchor bolts was required. Replace (2) 1-A Poles and Install new Foundations at 30th Street & "E" Street on the Southbound Median Island and 30th Street& "E" Street at the Southwest Corner Two new 1-A poles had to be replaced. The 1-A pole at the southwest corner of 30d' Item 1-5 Street & "E" Street had to be reconstructed to match the new grades for the handicapped No. ramp. The 1-A pole at the median island at 30`h Street & "E" Street had to be replaced after the contractor found that the anchor bolts, which had been sheared off in a prior accident,had been replaced by others using unacceptable methods.
