Background: On August 7, 2006, the Mayor and Common Council allocated funds, as part of the FY 2006/07 Capital Improvement Program (CIP) for installation of a new traffic signal at the intersection of Mill Street and Macy Street (TC04-0I). This traffic signal is required to mitigate the impact of residential development being built along both sides of Mill Street at Macy Street. The project is partially funded by contributions from developers. Additionally, a developer recently dedicated the final portion of right-of-way needed for the signal. This project consists of the following: 1. Installation of new traffic signal equipment, including safety lighting. 2. Construction of new handicap ramps and sidewalk to meet ADA requirements. 3. Construction of curb & gutter and street improvements. 4. Restoration of existing roadway improvements disturbed by construction. The plans and specifications for this project were completed and the project was advertised on October 31, 2006. The project was advertised locally in the San E!ernardino County Sun Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction Bid Source, Bid Ocean, the City's web site, and with the San Bernardino Area Chamber of Commerce. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO OAK ENGINEERING, INC., FOR INSTALLATION OF TRAFFIC SIGNAL AND STREET IMPROVEMENTS AT MILL STREET AND MACY STREET, PER PROJECT PLAN NO. 10486. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Oak Engineering, Inc., 1305 W. Second Street, Pomona, CA 91766, is the lowest responsible bidder for Installation of Traffic Signal and Street Improvements at Mill Street and Macy Street (TC04-01), per Project Plan No. 10486. A contract is awarded accordingly to said bidder in a total amount of $303,285.00, with a contingency amount of S28,715.00'but such contract shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or moditications thereto shallnol lake effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of this resolution. ill!
