STAFF REPORT The attached correspondence from San Bernardino County outlines a proposal whereby the city of San Bernardino would join with the County and other cities to participate in the development of a Regional Air Quality Element. This Element is a requirement of the SCAB Air Quality Management Plan. The AQMP provides for a series of actions to be taken by cities pursuant to an Air Quality Element adopted into their respective General Plans by January 1, 1991. The County of San Bernardino will serve as the lead agency for selecting a Consultant and for developing the Regional Air Quality Element. The City of San Bernardino will be able to use the information developed in meeting its Obligation to have an Air Quality Element in place by January 1, 1991. Based on the population, the City's "contribution range" would be between $9,400 and $18,800. It is therefore recommended that the resolution presented be adopted and that the Mayor and Council designate Larry Reed as the member of the Technical Committee and that a member of the Common Council be designated as the City's representative . on the Advisory Committee. NOTE: This matter was originally referred to the Ways and Means Committee; however, at that time, there was not sufficient background information available to the Committee. The background information has now been obtained and will be available to the Commit- tee at its next regular meeting, in order that the many facets of the program can be examined in detail. I have enclosed the information you requested regarding San Bernardino County's proposal for your city's participation in a Regional Air Quality Element. The Clean Air Act*, AB 2595, provides the legal authority for the South Coast Air Quality Management District (SQAQMD) to adopt and enforce regulations to achieve and maintain ambient air quality. These regulations are contained in the SCAQMD Air Quality Management Plan (AQMP) which was adopted by the California Air Resource Board in August 1989. The AQMP is a 20 year comprehensive control program designed to bring the South Coast Air Basin in the compliance with State and Federal air standards. The AQMP states that local jurisdictions must be responsible for implementing parts of the plan along with other agencies including SCAG, California Air Resource Board, and the SCAQMD. The preparation for an air quality element for local jurisdictions is referenced in Sections I, II, and IV within the AQMP. I. Executive Summary All cities and counties should adopt air quality elements into their General Plans by January 1, 1991. Through these elements action programs are to be developed applicable to each jurisdiction to further implement. control measures in the AQMP. II. Transportation and Control Measures 2b. Truck Dispatching, Rescheduling and Rerouting Adopt Air Quality Element by July 1, 1990 to alter truck delivery by rerouting trucks and changing times of delivery. IV. Energy Conservation Control Measures Measure 17. Local government to amend General Plan to attain jObs/housing balance performance goals by January 1, 1991. Beginning in 1990 the SCAQMD will be responsible for reporting every six months to the California Air Resource Board to assess the progress made by local jurisdictions in adopting policy and regulation to reduce air poll~tion in the South Coast Air Basin. Accordina to the SCAOMD the adootion of an air aualitv element is a vital steo in identifvina and adootina control methods to reduce air oollution in the Countv Coast Air Basin. San Bernardino County has already received formal commitment from 12 of the 14 cities that fall within the SCAQMD. Control measures in the A~ propose a wide variety of means for achieving the goals of regional mobility, balanced growth_ and cleaner air, including local air quality elements. All of the measures have a legal mandate to be implemented. If local implementation is not successful the South Coast Air Quality Management District (SCAQMD) will be in a position to execute its regulatory authority and intervene, which may cause loss of certain local decision-making powers, including land use controls over pollution generating development. Although full implementation is to occur over a 20 year period, results of reduced air pollution must be shown in the first five years of the AQMP. San Bernardino County is proposing a cooperative effort to meet the first phase mandate by SCAQMD that local jurisdictions adopt air quality elements that study and develop policies to reduce air pollution. Therefore, your formal commitment to participate in t~e Regional Air Quality Element is now requested. You are urged to respond as soon as possible to this proposal and adopt the enclosed resolution addressing the need for a Regional Air Quality Element. (This resolution is being provided as a guide. It can be revised as necessary for your jurisdiction.) . Attached you will also find a proposed work program which explains scheduling, citizen participation, technical and advisory committees, and an estimate of each city's proportionate cost for preparing the Element. We request your Council to approve the resolution which recognizes the need for improved air quality in San Bernardino County area and: 1) recognizes the County as the lead agency for the project in cooperation with SANBAG and the cities in San Bernardino County within the SCAQMD; 2) allocates funding in the dollar amount range proposed for each participating city; 3) authorizes transfer of allocated funding to the County by April 1, 1990 (arrangements can be made on an individual basis to transfer those funds no later than July, 1990); 4) appoints the Planning Director or his designee to the Technical Committee to be formed as part of this effort; and . 5) appoints a Council member to the Advisory Committee. RESOLUTION NO. 1 2 3 4 5 6 A RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING PARTICIPATION WITH SAN BERNARDINO COUNTY FOR THE PREPARATION OF A REGIONAL AIR QUALITY ELEMENT FOR THE PURPOSE OF IMPROVING AIR QUALITY WITHIN SAN BERNARDINO COUNTY. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: WHEREAS, the City of San Bernardino, San Bernardino 7 County, California, is within the jurisdiction of the South 8 9 10 ]] ]2 13 ]4 15 ]6 ]7 ]8 19 20 2] ~ 23 24 25 26 27 28 Coast Air Quality Management District the agency (SCAQMD) , responsible for monitoring and reducing air pollution for the South Coast Air Basin. WHEREAS, the SCAQMD has adopted a 1989 revised Air Quality Management Plan (AQMP) for the purpose of setting forth a comprehensive control program that will lead the South Coast Air Basin into compliance with all Federal and State air quality standards including the Federal Clean Air Act. WHEREAS, the AQMP has proposed that cities and counties within the South Coast Air Basin adopt air quality elements as part of their general plans. WHEREAS, the preparation of an Air Quality Element is desirable to provide for the safety and welfare of the community by promoting physical development and economic growth that is compatible with regional air quality standards. WHEREAS, a regional .a~proach and cooperative effort with San Bernardino County, SANBAG, and other San Bernardino County cities within the South Coast Air Basin will greatly improve the efficiency of the policies and strategies in achieving the goals of cleaner air and compliance with Federal and State standards. WHEREAS, the San Bernardino County Board of Supervisors has requested participation in the development of a Regional Air . . . . . . . The City of San Bernardino will allocate funding in the amount of $9,400 to $18,800 dependent upon the final cost of the program, to be transferred to the County by April 1, 1990. SECTION 4. The City of San Bernardino will authorize a Council Member to represent the city as a member of the Advisory Committee to be coordinated by San Bernardino County to facilitate direct City involvement in the Element. SECTION 5.
