STAFF REPORT . section 19.56.290 of the Municipal Code permits a cash payment in-lieu of providing the required number of parking spaces for development within the Central City Parking District. Resolution No. 87-212 which established this fee at $10,000 per parking space, was adopted in June, 1987. The $10,000 figure was based on a determination of the costs associated with land acquisition and construction of an additional parking space in the downtown area. The construction of two additional parking structures in public parking lots #1 and #2 has been discussed by the Mayor. These parking structures would be constructed on property owned by the City which would preclude the city from incurring land acquisition costs. In addition, it has been suggested that additional incentives are necessary to encourage private development in the downtown area. In order to address these two issues, an amendment to Resolution No. 87-212 has been prepared which would give the City the flexibility to reduce the in-lieu fee by an amount equal to the cost of land acquisition. Under the proposed amendment, a development in the downtown area would be able to pay the reduced in-lieu fee as an alternative to providing on-site parking. The in-lieu fees collected could then be used to offset the costs associated with the City's construction of the two proposed parking structures. As proposed in the resolution, the Director of Public Works would determine land acquisition values which would be subject to City Adminis- trator approval. RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE 3 OUNT OF IN-LIEU PAYMENTS FOR PARKING SPACES WITHIN THE CENTRAL CITY PARKING DISTRICT, AS REQUIRED BY CITY ORDINANCE NUMBER 1991. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 5 OF SAN BERNARDINO AS FOLLOWS: 6 WHEREAS, the Mayor and Common council of the city of San 7 Bernardino have determined that an in-lieu payment per parking 8 space within the Central City Parking District shall be set forth 9 annually in accordance with section 19.56.290 of the San 10 Bernardino Municipal Code; and 11 WHEREAS, upon the approval of the Parking Place Commission a 12 ash payment may be made in-lieu of providing the number of . 13 arking spaces or any portion thereof required under Section 14 19.56.190 through 19.56.360 of the San Bernardino Municipal Code; 15 WHEREAS, such in-lieu payments shall be the product of 16 ultiplying the number of spaces for which cash payment is to be 17 the total estimated cost of acquiring and improving land 18 ithin the District for providing one (1) parking space; and .19 WHEREAS, the in-lieu payment shall be made to the City prior 20 0 the issuance of a building permit; and 21 WHEREAS, all funds received from in-lieu payments shall be 22 sed only to acquire land for and construct and improve 23 24 parking facilities<to serve the Parking Such additional parking spaces shall be provided when 25 etermined to be appropriate by the Mayor and Common council upon 26 he recommendation of the Parking Place commission. . 27 NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE MAYOR AND 28 COMMON COUNCIL OF THE CITY OF SAN BERNARDINO: 11/27/89 I~ . . . . . . . ] 2 3 4 5 6 That the in-lieu payment for one parking space within the Central City Parking District shall be $10,000. Upon approval of the City Administrator, the amount of the in-lieu fee may be reduced when a publicly-owned or operated parking structure exists, or is contemplated for construction, within 600 feet of the location for which a building permit is sought. 7 8 9 ]0 11 ]2 ]3 ]4 ]5 ]6 ]7 18 19 20 2] 22 23 24 25 26 27 28 The maximum amount of any such reduction shall be equivalent to the estimated cost of land acquisition for a parking space in the district at the time of payment of such in-lieu fee as detemined by the Director of Public Works/City Engineer.
