STAFF REPORT On November 20, 1989, the Mayor and Common Council adopted Resolution No. 89-459 amending the sewer fees collected. Due to a clerical e~ror, a critical point was left out of line 22 of the resolution. Specifically, the words "per bedroom" were deleted. This omission has a significant effect on the overall program and the words "per bedroom" need to be added to the resolution. For examp,e under the present wording, a 3 bedroom house would pay only about $223, instead of $669 as intended. Upon discussion with the City Attorney's staff, the most effective way to accomplish this is the adoption of another reso- lution amending the recent Resolution No. 89-459. The proposed resolution is the same as the recently adopted one with the addition of the words "per bedroom" and other minor changes to implement the amendments. RESOLUTION NO. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING INCREASED INSPECTION AND CONNECTION FEES FOR CONNECTING ANY PROPERTY TO A PUBLIC SEWER AND RESCINDING RESOLUTION NO. 89-459. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Pursuant to Sections 13.08.020, 13.08.040 and 13.08.050 of the San Bernardino Municipal Code, the following inspection and connection fees for connecting any property to a public sewer are authorized immediately. A public hearing has been concluded as required. A. Each application for a permit to connect any property with a public sewer shall be accompanied by an inspection fee of Fifteen Dollars ($15.00). B. Each application for a permit to connect any property with a public sewer, shall be accompanied by a connection fee designated for off-site trunk lines and collection facilities required for the disposal of sanitary sewage, which fee shall be deposited in the Sewer Line Construction Fund of the City, in an amount as follows: 1. Residential - for single family houses, duplexes, triplexes and apartment houses, Two Hundred Twenty-Three Dollars ($223.00) per bedroom. 2. Mobile Homes - for mobile homes, Two Hundred Twenty- Three Dollars ($223.00) per mobile home connection. 3. Motels and Hotels - for motels and hotels, Eighty-Nine Dollars ($89.00) per dwelling unit. 4. Hundred Seventy-Eight Dollars ($178.00) for each 3,000 square feet or fraction thereof. 5. The Sewer Connection and Inspection fees shall be adjusted annually each July 15th in accordance with the change in the Construction Cost Index as published in the latest Engineering News Record as of that date. C. Each application for a permit to connect any property with a public sewer shall be accompanied by a connection fee designated for construction and improvement of the Wastewater Treatment Plant, to provide additional capacity to meet increased demand, which fee shall be transmitted to the Water Department, in an amount as follows: 1. Residential - for each single family house and for each dwelling unit in a duplex or triplex in accordance with the following schedule: EFFECTIVE DATE AMOUNT January 1, 1989 $2,260 per dwelling unit 2. Multiple residential and non-residential - for multiple dwellings in excess of three units, mobile home parks, motels, hotels and commercial, institutional and industrial connections, and any other type of connection, the General Manager of the Water Department shall estimate the amount of sewage effluent resulting from the connection and shall set the fee at a rate per gallon per day of estimated effluent in accordance with the following / / / / / / / / PZ/dys December 7, 1989 2 . 1 . 2 3 4 5 6 7 8 9 10 11 12 13 14 . 15 16 17 18 19 20 21 22 23 24 25 26 27 . 28 . . . schedule: EFFECTIVE DATE AMOUNT $8.05/per gallon January 1, 1989 3. The General Manager's estimate may be appealed to the Board of Water Commissioners, which shall hear and determine the matter. The decision of the Board shall be final. D. Each application for a permit to connect any property located outside the corporate limits to City public sewer shall be accompanied by a connection .fee designated to recover extra administrative costs relating to processing an application for property located outside the corporate limits of the City and served by the City sewer system, which fee shall be deposited in the General Fund of the City. Such fee shall be, in the amount of One Thousand Dollars ($1,000.00) per connection. SECTION 2. Resolution 89-459 is hereby rescinded.
