A petition was received through LAFCO (Local Agency Formation Commission), for the annexation of a 1 acre parcel of land, located at the Southeast corner of Hill Drive and 3rd Avenue, to the City of San Bernardino. On November 6, 1989, authorization to proceed was granted and Resolution No. 89- 435 was adopted, determining the amount of property tax transfer from the County of San Bernardino to the City. LAFCO has modified the proposal to include the single parcel located on the West side of Third Avenue. The change in proposal also requires that a new resolution be adopted to determine the property tax transfer to include this parcel. The adoption of the attached resolution fulfills the City's compliance with Section 99 of the Revenue and Taxation Code. Exhibit "A" of the resolution, states the actual dollar amounts proposed for transfer and the local agencies affected. A RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC 2570 AND REPEALING RESOLUTION NO. 89-435 WHEREAS, on the 6th day of November, 1989, the Mayor and Co_on Council of the City of San Bernardino did adopt Resolution No. 89-435, determining the amount of property tax revenues to be exchanged between the" City of San Bernardino and the County of San Bernardino, resulting from the jurisdictional change described in LAFC 2570; and WHEREAS, LAFC 2570 was amended on November 29, 1989, by the Local Agency Formation Commission to include additional territory. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Co_on Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior 17 to the issuance of a certificate of filing by the Local Agency Formation 18 Executive Officer, the governing bodies of all local agencies whose service 19 area or service responsibilities will be altered by a proposed 20 jurisdictional change will negotiate and determine by resolution the amount 21 of property tax revenues to be exchanged between and among such local 22 23 24 25 26 27 28 agencies. . ....-~.- B. Except as provided in Section 99.1 of the Revenue and Taxation Code, in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the Board of Supervisors of the County of San Bernardino shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. REPEALING RESOLUTION NO. 69-435 BERN~O 2570 ~ the Board of Supervisors of the County of San Bernardino have determined the amount of property tax revenues to be exchanged as a result of jurisdictional change described by LAFC No. 2570. SECTION 2. Implementation. A. The negotiated exchange of property tax revenues between the City of San Bernardino and the County of San Bernardino attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above described jurisdictional change, is hereby approved and accepted. B. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the Local Agencies whose service area or service responsibilities will be altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the provisions of Section 96 of the Revenue and Taxation Code. SECTION 3. City of San Bernardino Resolution No. 69-435 is hereby repealed. SECTION 4.
