RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO
AWARDING CONTRACT FOR CONSTRUCTION OF IMPROVEMENTS
ASSESSMENT DISTRICT NO. 985
(Industrial Parkway Improvement District)
WHEREAS, on September 6, 1989, the Mayor and Common
(the "Common Council") of the City of San Bernardino,

California ("the City"), adopted Resolution No. 89-346, the
Resolution of Intention for Assessment District No. 985,
declaring its intention, pursuant to the provisions of
Division 12 of the Streets and Highways Code of the State of
California, the Municipal Improvement Act of 1913, to order the
acquisition and construction of certain public improvements

14 described therein: and
15
WHEREAS, Willdan Associates, Inc., the Engineer of
Work (the "Engineer"), has prepared a report pursuant to
16

Sections 10203 and 10204 of said Code, and said report has been
confirmed by the Common Council and is now on file in the office
of the City Clerk of the City of San Bernardino: and

WHEREAS, the Common Council has ordered the publica-
tion of a notice inviting sealed proposals or bids for the con-
struction of said improvements: and
WHEREAS, pursuant to<said notice inviting sealed pro-
posals or bids the Director of Public Works/City Engineer did,
at the time and place specified in said notice as the time and
26 place for opening sealed proposals of bids, i.e., 2:00 p.m. on

September 22, 1989, at the Public Works Department on the third
floor of the City Hall of the City, at 300 North "D" Street, San

Bernardino, California, open and examine all sealed proposals or
bids submitted; and
WHEREAS; the Director of Public Works/City Engineer
4 has examined all proposals or bids submitted and has made his
5
report to the Common Council regarding the proposals or bids
submitted;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
7
8 COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AS FOLLOWS:
SECTION 1. The Common Council does hereby
9
10 determine that the bid of Riverside Construction Company is the
11 lowest regular bid for the work to be performed in constructing
12
said improvements of any responsible bidders and said bid is
13 accompanied by a bid check or bond as required in the notice
14 inviting bids. The Common Council does hereby award the
contract for said work to Riverside Construction Company at the

16 price named in its bid, and the Mayor and the City Clerk are
17 authorized to execute and attest the contract on behalf of the
18 City; provided, however, that the award of said contract and its
19 performance by the City of San Bernardino shall be contingent
20 upon the sale and delivery of improvement bonds at a price and
21 upon terms and conditions deemed satisfactory by the Common

Council in its sole and absolute discretion.
SECTION 2.
All bi4s or proposals for said
improvements, other than the said lowest regular bid above
accepted and the next two lowest bids, are hereby rejected and
the Director of Public Works/City Engineer is directed to return
to each bidder whose bid is so rejected the check or bond which
accompanied his bid; and upon execution of the contract for said

improvements by the said lowest bidder, the next two lowest bids
shall be rejected and the Director of Public Works/City Engineer
shall return to each of the bidders who submitted said bids the

check or bond which accompanied their bid.
SECTION 3.
Reference is made to Resolution
No. 89-346 and to the Report of the Engineer of Work, for a full
6
7 and complete description of the improvements, for a description
8 of Assessment District No. 985, for a description of the bonds
9
to be issued to represent unpaid assessments and for further
10 particulars. The work and all proceedings therefor shall be
11
performed under and in accordance with the Municipal Improvement
12 Act of 1913, Division 12 of the Streets and Highways Code of the
13 State of California.
14 SECTION 4. The City Clerk is hereby directed to
. 15 publish once in the Sun, a newspaper of general circulation
16 published and circulated in the City of San Bernardino, wherein

the Notice of Improvement was published, a notice of the award
contract for the construction of the improvements. Said
shall contain the matters required by law.

I HEREBY CERTIFY that the foregoing resolution was
