Description) Council Notes: Finance: ~S 0 .:2oo~ - "/.:l41 Agenda Item No. ~ I;J..,} '1/ Df4 , CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Adopt a resolution approving a quitclaim deed to Calmat Co., a Delaware corporation, vacating a water facilities easement to the owner of record to clear the title of the property. Background: Hillwood Development Company, LLC intends to develop almost 1,625,917 square feet of industrial space in the City of San Bernardino on land, owned by CalMat Co., affected by an easement for water facilities in favor of the City of San Bernardino, as described in document recorded December 1, 1950 in Book 2680, Page 563 of the Official Records of the County of San Bernardino (Exhibit "A''). The original water facilities easement was conveyed by quitclaim deed to the San Bernardino Water Utilities Corporation, which was condemned into the City of San Bernardino Municipal Water Department. The easement for water facilities is, therefore, the Water Department's, as successor-in-interest to the San Bernardino Water Utilities Corporation. Hillwood's site plan showing the intended development and the location of the easement is attached as Exhibit "B". Without release of the easement, the parking area and proposed buildings are compromised. Water Department staff has confirmed that there are no facilities located in the easement currently and there are no plans for future facilities that require this easement. The property is currently owned by CalMat; therefore, the easement will be released back to Calmat. Hillwood has a contract with CalMat to purchase the property and, therefore, intends to clarify entitlements. Hillwood has offered $1000 to the Department as consideration for the quitclaim. This consideration essentially covers the staff research and processing time to prepare the quitclaim. The quitclaim deed is attached as Exhibit "C". WHEREAS, the City of San Bernardino, as successor-in-interest to the San Bernardino Water Utilities Corporation, owns an easement for water facilities situated in the City of San Bernardino, County of San Bernardino located in the general vicinity of Cajon Boulevard and Southern Pacific Rail Road; and WHEREAS, Hillwood Development Company, LLC intends to develop almost 1,625,917 square feet of industrial space on land owned by CalMat Co., and affected by this easement; and. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That the City of San Bernardino, a Municipal Corporation, does hereby approve the easement as declaration of surplus property; SECTION TWO: That a Quitclam, Deed to Calmat Co., a Delaware corporation, referred to herein, a copy of which is attached hereto, marked as Exhibit" 1", and hereby referred to and made a part hereof as fully as though set forth at length herein, is hereby approved.
